HomeMy WebLinkAboutBZA Resolution 154-246 - (1836 The Strand)- RESOLUTION B.Z.A. 154-246 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 1836 STRAND, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on August 15, 1977, in the Council Chambers of the City Hall, consid- ered the request of Carol Warrian for pennission to make structural alterations to an existing nonconforming building with nonconforming use; and WHEREAS, at said pubHc hearing, the following facts were presented for consideration; that the applicant has a legally nonconforming five-unit building with two parking spaces; that a portion of the present construction is allowed as repair to existing structure, however, applicant proposes to extend the existing decks in the front of the building an additional 3 ft., add additional railing and trellis over deck at the rear, and enclose and add a conical shaped roof at corner of existing deck at rear; and WHEREAS, at said public hearing, the applicant stated they were working from approved plans, the balcony over the garage was already there; their purpose was to make the place look nicer; the trellis is being added just for shade; they are bringing the building up to code as much as possible; the building was in a bad state of obsoles- cence with many areas of dry rot; that structural is really an all-encompassing phrase; and WHEREAS, at said public hearing, two residents of the area spoke in support of the request; and WHEREAS, at said public hearing, no one appeared to speak in opposition to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the variance request is justified for the following reasons: 1. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved because preliminary drawings were approved and work has started. 2. That the variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vic- inity and zone, and denied to the property in question because otherwise the property cannot be completed and without some of these particular structural alterations there could be excessive additional financial bur- den to the owner. They are trying to correct problems with dry rot, etc. 3. That the granting of the variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located because the altera- tions are minor in nature. 4. That the granting of the variance will not adversely affect the compre- hensive General Plan because density is not affected. NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments does hereby grant the request by the following vote: AYES: Comms. Beard, Cummings, Ebey, Simpson, Chmn. Sims NOES: None ABSENT: Comm.
