A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA
BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 1001 FOURTH STREET,
HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public
hearing held on September 7, 1977, in the Council Chambers, City Hall, considered
the request of Mr. Ronald Cuttriss for permission to maintain a 6 ft. high fence
encroaching into the required 10 ft. front yard setback, on property known as Lots
21 and 22, Hopkins Sub; and
WHEREAS, at said public hearing, the following facts were presented for consideration;
that the applicant was issued a building permit for construction of a fence; that he
was advised by a building inspector making a foundation excavation inspection to
relocate fence behind front yard setback; that when inspection for final was done it
was noted fence was within front yard setback; that the street is laid out at an
angle; that it meets vision clearance requi'rements; and
WHEREAS, at said public hearing, no one spoke in support of or opposition to the
request; and
WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments
that the variance request is justified for the following reasons:
1. That there are exceptional or extraordinary circumstances or conditions
applicable to the property involved because of confusion at the time the
fence was originally laid out and due to the unusual angle of the street.
2. That such variance is necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vic-
inity and zone, and denied to the property in question because there are
many other fences in the city which have minor nonconformities.
3. That the granting of the variance will not be materially detrimental to
the public welfare or inju~ious to the property or improvements in such
vicinity and zone in wh1ch the property is located because corner vision
clearance is adequate, and neighbors have testified that there is no
injurious effect on surrounding properties.
4. That the granting of the variance: will not adversely affect the compre-
hensive General Plan because density is not a factor.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board
of Zoning Adjustments does hereby grant the variance by the following vote:
AYES: Corruns. Beard, Ebey, Simpson, Toth, Chmn. Sims
NOES: Comm. Cummings
ABSENT: None
CERTIFICATION
I hereby certify that the foregoing Resolution BZA 154-248 was adopted by the Board
of Zoning Adjustments of the City of Hermosa Beach at a regular meeting held on the
7th day of September, 1977.
