A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA
BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 259 -30TH STREET,
HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hemosa Beach, at a public
hearing held on September 7, 1977, in the Council Chambers of the City Hall, consid-
ered the request of Mr. and Mrs. Ulrich de la Camp for permission to be allowed to
enclose a 91611 x 91 611 area · of first floor patio ·under an existing second floor
overhang to within 6 ft. of the front property line; on property known as Lot 19,
Block 116, Shakespeare Tract; and
WHEREAS, at said public hearing, the following facts were presented for consideration;
that the lot is located in an-area recently rezoned from R-2 to R-1; that prior to the
rezoning, the front setback requirement for the block was 3 ft.; that it is now 10%
of the lot depth,(or 7 ft.); therefore, the existing second floor is encroaching 1 ft.
into the new required front setback; and
WHEREAS, at said public hearing, the owner said the property line is quite a way from
the walk street, and they have fully conformed in all other ways; and
WHEREAS, at said public hearing, a letter was submitted by the adjacent property
owner in support of the request; and
WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments
that the request is justified for the following reasons:
1. That there are exceptional or extraordinary circumstances or conditions
applicable to the property involved because it is in keeping with the
character of the neighborhood.
2. That such variance is necessary for the preservation and enjoyment of
a substantial property right possessed by other property in the same
vicinity and zone, and denied to the property in question because most
properties in the area enjoy this kind of setback.
3. That the .granting of such variance will not be materially detrimental
to the public welfare or injurious to the property or improvements in
such vicinity and zone in which the property is located because there
are no open space changes, this could not be construed as detrimental.
4. That the granting of the variance will not adversely affect the compre-
hensive General Plan because there are no density ramifications.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board
of Zoning Adjustments does hereby grant the variance by the following vote:
AYES : Comms. Beard, Cummings, Ebey, Simpson, Toth, Chmn. Sims
NOES: None

of Zoning Adjustments of the City of Hermosa Beach at a regular meeting held on the
