RESOLUTION B.Z.A. 154-250
A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA
BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 218 MANHATTAN AVENUE,
HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public
hearing held on September 7, 1977, in the Council Chambers of the City Hall, consid-
ered the request of Alicia Duran and Pette Parkin for permission to make structural
alterations to a nonconforming building with a nonconforming use, on property known
as Lot 3, Block 44, 1st Addition to Hermosa Beach Tract; and
WHEREAS, at said public hearing, the following facts were presented for considera-
fion; that the applicants have a five-un-it building on a lot that would only allow
four units under present code and the existing lot coverage is 68% in lieu of the
65% maximum allowed; that the request is to add a deck over the garage; and
WHEREAS, at said public hearing, the applicants stated that the deck would not
increase the lot coverage; that they would like to make the existing garage roof
usable and livable space; there is sound-proofing in the building now, so they do
not expect any problem with the apartment below; and
WHEREAS, a petition was submitted signed by six neighboring residents in favor of
the request; and
WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjust-
ments that, subject to conditions, the variance request is justified for the follow-
ing reasons:
1. That there are exceptional or extraordinary circumstances or conditions
applicable to the property involved because the structural alteration
is minor and technical in nature.
2. That such variance is necessary for the preservation and enjoyment of a
substantial property right enjoyed by other property in the same vicinity
and zone, and denied to the property in question because there are other
decks on the same street.
3. That the granting of such variance will not be materially detrimental to
the public welfare or injurious to the property or improvements in such
vicinity and zone in wh~ch the property is located because there is evid-
ence from surrounding property owners that the alteration will not have
a deleterious effect on surrounding properties.
4. That the granting of such variance will not adversely affect the compre-
hensive General Plan because it does not increase density.
AND, FURTHER, that the variance is granted subject to the following conditions:
1. That the building does not exceed the existing 68% lot coverage.
2. That the deck remains unenclosed.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above finding of fact, the Board
of Zoning Adjustments does hereby grant the variance by, the following vote:
AYES: Conms. Beard, Cummings, Ebey, Simpson, Chmn. Sims
