A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA
BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 1060 NINTH STREET,
HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public
heariqg held on September 7, 1977 in the Council Chambers of the City Hall, consid-
ered the request of Mr. and Mrs. Roger L. Lent for permission to add more than 40%
to an existing single residence with nonconforming west sideyard of 3 ft. in lieu
of the 4 ft. required; on prop_erty known as Lot 32, Tract 5826; and
WHEREAS, at said public hearing, the applicant presented photographs of other houses
on the street that have gone up two stories and indicated he would be willing to
sign a deed restriction 1 imiti.ng the property to single family use; that if the sec-
ond story was built out just to the setback requirement it would result in abnormally
small bedrooms; and
WHEREAS, at said public hearing, a petition signed by three adjacent property owners
was presented in support of the request; and
WHEREAS, at said public hearing, no one appeared to speak in opposition to the
request; and
WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments
that the request is justified, subject to conditions, for the following reasons:
1. That there are exceptional or extraordinary circumstances or conditions
applicable to the property involved because the existing house is of
extremely small square footage and requires a relatively large addition
to meet the requirements of a contemporary house.
2. That such variance is necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vic-
inity and zone,:and denied to the prpperty in question because other
properties in the vicinity are ·adding second stories.
3. That the granting of the variance will not be materially detrimental to
the public welfare or injurious to the property in the same vicinity and
zone in which the property is located because it is not detrimental since
in large parts of the city a 3 ft. setback is adequate and if the addition
were less than 40% it would be possible without a variance.
4. That the variance will not adversely affect the comprehensive General Plan
because it is maintaining R-1 usage on an R-1 lot, althotigh .it:will affect
density since it is adding bedrooms.
AND, FURTHER, that the variance is granted subject to the following condition:
1. That a deed restriction be required limiting the property to single
family use.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact,
of Zoning Adjustments does hereby grant the variance by the following vote:
AYES: Comms. Beard, Cummings, Ebey, Simpson, Toth, Chmn. Sims
NOES: None
ABSENT: None CERTIFICATION
