RESOLUTION B.Z.A. 154-252
A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA
BEACH DENYING A VARIANCE ON PROPERTY LOCATED AT 136 SECOND STREET, HER-
MOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public
hearing held on September 7, 1977, in the Council Chambers of the City Hall, consid-
ered the request of Mr. William D. Taggart for permission to be allowed a 6 ft. high
fence to property line along easterly sideyard, on property known as NE·35 ft. of
Lots 14 and 15, Tract 1122; and
WHEREAS, at said public hearing, the following facts were presented for consideration;
that the applicant's request involves a portion of his fence that is within the
required front yard setback and, if granted, he will have to go to the City Council
for the portion on city property; that the applicant and the city differ on whether
or not the fence was built with a permit; that the city has no permits which refer
to the fence; and
WHEREAS, at said public hearing, the applicant reviewed the plans with the Board
and stated he felt he had a city permit granted by a former building official for
the fence; that there were other fences in his block built on city property; and
WHEREAS, at said public hearing, no one appeared to speak in opposition to the
request; and
WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments
that the variance request is not justified for the following reasons:
1. That there are no exceptional or extraordinary circumstances or condi-
tions applicable that would warrant a six-foot fence on property line.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board
of Zoning Adjustments does hereby deny the variance request by the following vote:
AYES: Comms. Cummings, Ebey, Simpson, Toth
NOES: Comm. Beard, Chmn. Sims
ABSENT: None
CERTIFICATION
I hereby certify that the foregoing Resolution B.Z.A. 154-252 was adopted by the Board
of Zoning Adjustments of the City of Hermosa Beach at a regular meeting held on the
7th day of September, 1977.
