HomeMy WebLinkAboutBZA Resolution 154-253 - (1326 Monterey Blvd)RESOLUTION B.Z.A. 154-253 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 1326 MONTEREY BOULEVARD, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on September 19, 1977, in the Council Chambers of the City Hall, consid- ered the request of Mr. Joe B. Noble for pennission to construct a commercial build- ing with three off-street parking spaces backing out onto Monterey Boulevard; and WHEREAS, at said public hearing, the following facts were presented for consideration; that the site is surrounded by existing development on three sides, with the open side being Monterey; that due to the size of the lot, it is not possible for the applicant to comply with Section 1164 (E) of the Zoning Code which does not allow the backing out of cars directly onto a major street from a commercial lot; and WHEREAS, at said p.ublic hearing, the applicant stated that the increase in taxes imposes a tremendous hardship on property owners who are not allowed to develop their property; there are other properties of similar nature who are enjoying this benefit; the type of business will be general office; and WHEREAS, at said public hearing, no one appeared to speak in opposition to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the variance request is justified for the following reasons: 1. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved because otherwise there is no way to develop as commercial property. 2. That such variance is necessary for the preservation and en.ioyment of a substantial property right possessed by other property·in the same vicin- ity and zone, and denied to the property in question because there are other properties in the City of Hermosa Beach with the same condition or use. 3. That the granting of the variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located because no testimony has been heard that surrounding properties will be injured. 4. That the granting of the variance will not adversely affect the compre- hensive General Plan because the property is in conformity with the General Plan. NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments does hereby grant the variance by the following vote: AYES: Comms. Beard, CuITTnings, Ebey, Simpson, Toth, Chmn.
