HomeMy WebLinkAboutBZA Resolution 154-254 - (1852 Rhodes St)RESOLUTION B.Z.A. 154-254 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH DENYING A VARIANCE TO PROPERTY LOCATED AT 1852 RHODES STREET, HER- MOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on September 19, 1977 in the Council Chambers of the City Hall, consid- ered the request of Sandra Hubert and Patricia Leahy for permission to exceed the maximum height limit of 25 ft. in the R-1 zone by 3 ft. in order to make a second story addition, on property known as Lots 38 and 39 and the SQ 15 .• '45 ft. of Lots 21 and 22, Tract 2548; and WHEREAS, at said public hearing, the applicants• representative stated they are add- ing to and restoring a very old home; the original floor is 31811 high; the area exceeding the height limit is a relatively small area; and it is not blocking any other building; that that portion contains clerestory windows on the north for light; and WHEREAS, at said public hearing, six residents of the area appeared in opposition to the request and presented a petition bearing the signatures of 48 residents also in opposition to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the request is not justified for the following reasons: 1. The Board can find no exceptional or extraordinary circumstances or conditions applicable to the property involved because they can obtain light through other structural means as there are many alternatives. 2. That the granting of the variance•.would not be preserving a property right possessed by other people in the same vicinity and zone, and denied to the property in question as the lack of the 3 ft. in height will not prevent them from developing the property. 3. That the granting of the variance will be materially detrimental to the property or improvements aAd the public welfare as indicated by the petition in opposition signed by residents of the area and the residents who appeared to give testimony in opposition to the request. NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments does hereby deny the variance by the following vote: AYES: Comms. Beard, Cunvnings, Ebey, Simpson, Toth, Chmn. Sims NOES: None ABSENT: None CERTIFICATION I hereby certify that the foregoing Resolution B.Z.A. 154-254 was adopted by the Board of Zoning Adjustments at a regular meeting held on the 19th day of September, 1977.
