A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA
BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 2306 BORDEN AVENUE,
HERMOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public
hearing held on September 19, 1977 in the Council Chambers of the City Hall, consid-
ered the request of Mr. and Mrs. Ralph Halliwell for permission to add a second story,
consisting of two bedrooms, bathroom, dressing room, study and recreation room to
their existing single family residence with an existing garage attached to the house
which has a nonconforming rear yard setback of 2 ft. in lieu of the 3 ft. required
off an alley; on property known as Lots 22 and 23 and N. 51 of Lot 24, Tract 2143; and
WHEREAS, at said public hearing, the following facts were presented for consideration;
that the new addition will meet all setback requirements; and
WHEREAS, at said public hearing, the applicant stated that all the homes on that street
were built at approximately the same period from the same plan, about 1942-44, and that
the garages are all the same setback; and that they were willing to sign a deed restric-
tion; and
WHEREAS, at said public hearing, one resident of the area spoke in opposition to the
request; and
WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments
that the request, subject to conditions, is justified for the following reasons:
1. That there are exceptional or extraordinary circumstances or conditions
applicable to the property involved because the addition to the house
itself does not affect the setback of the existing garage, and recon-
struction of the garage would cause undue financial hardship.
2. That such variance is necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vic-
inity and zone, and denied to the property in question because by allow-
ing this request, the people can remodel the home to meet their needs and
stay within the community; the garage as it stands is in line with other
garages with equivalent one-foot setback.
3. That the granting of such variance will not be materially detrimental to
the public welfare or injurious to the property or improvements in such
vicinity and zone in which the property is located because although there
have been objections raised, they were not relative to the problem requir-
ing a variance, but were relative to any addition to the house whatsoever,
and it does not appear that the portion of the property requiring a var-
iance will have any adverse effect on surrounding property.
4. That the granting of the variance will not adversely affect the comprehen-
sive General Plan because it is in conformity with the General Plan with
the deed restriction, and keeps lot coverage down to 44%.
AND, FURTHER, that subject request is granted subject to the following condition:
1. That a deed restriction be required limiting the property to single family
usage.
_; NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board
of Zoning Adjustments does hereby grant the variance by the following vote:
AYES: Comms. Beard, Cummings, Ebey, Simpson, Toth, Chmn. Sims
NOES: None
