HomeMy WebLinkAboutBZA Resolution 154-256 - (46 20th Ct)RESOLUTION B.Z.A. 154-256 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 46 -20TH COURT, HER- MOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on October 3, 1977, in the Council Chambers of the City Hall, considered the request of Mr. William Chandler Briggs, Jr. for permission to maintain a two-car tandem open parking area 9 ft. wide in the side yard in lieu of the 9 ft. 6. in. width required by the Zoning Code, on property known as Lot 17, Block 20, Hermosa Beach Tract; and WHEREAS, at said public hearing, the following facts were presented for consideration; that the applicant had received all necessary clearances from the city and the Coastal Commission and a permit was issued in May, 1976; that it appears to have been an over- sight on the part of former staff and that the applicant thought he met all city require- ments; and WHEREAS, at said public hearing, no one appeared to speak in opposition to the request; and WHEREAS, after due consideration, it is. the opinion of the Board of Zoning Adjustments that the variance request is justified for the following reasons: 1. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved because there was evidently an error on the part of former City staff which required application for this var- iance. 2. That such variance is necessary for the preservation and enjoyment of a sub- stantial property right possessed by other property in the same vicinity and zone, and denied to the property in question because of the applicant's being unaware for need for a variance, it would be an extreme hardship to rebuild. 3. That the granting of the variance will not be materially detrimental to the public welfare or the property or improvements in such vicinity and zone in .which the property is located because the 6 in. difference is minor in nature. 4. That the granting of the variance will not adversely affect the comprehensive General Plan because there is no effect on density or other notable environ- mental effect. NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments does hereby grant the variance by the following vote: AYES: Corrnns. Beard, Currmings, Ebey, Toth, Chmn. Sims NOES: None ABSENT: Comm.
