A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH
GRANTING A VARIANCE ON PROPERTY LOCATED AT 3422 HERMOSA AVENUE, HERMOSA BEACH,
CALI FO RN IA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public
hearing held on October 17, 1977, in the Council Chambers of the City Hall, considered
the request of Mr. and Mrs. Kenneth Hitchcock for permission to encroach into their
required sideyard seven inches with a heating duct for a new forced air system; on
property known as Lot 3, Block 101, Shakespeare Tract; and
WHEREAS, at said public hearing, the following facts were presented for consideration;
that the building has an existing nonconforming 2 ft. 6 in. south sideyard into which
the applicants have had to encroach an additional 7 inches for a distance of 30 inches
to allow for the venting system for their new forced air system; and
WHEREAS, at said public hearing, the applicant have had the heating duct replaced by
a reputable contractor and done under permit, and further explained the location is
the only economically feasible one; and
WHEREAS, at said public hearing, a letter was presented in support of the request
from a nearby resident;; and
WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments
of the City of Hermosa Beach that the request is justified for the following reasons:
1. That there are exceptional or extraordinary circumstances or conditions
applicable to the property involved because the encroachment is so minor
in nature and was overlooked w~en the permit was issued.
2. That such variance is necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vic-
inity and zone is not applicable in this situation.
3. That the granting of such variance will not be materially detrimental to
the public welfare or injurious to the property or improvements in such
vicinity and zone in which the property is located because there has been
no indication, because of the minor nature of the variance, that there
would be any injurious effect, and there is a letter from a neighbor in
favor.
4. That the granting of such variance will not adversely affect the compre-
hensive General Plan because there is no change in dwelling units per acre.
NOW, THEREFORE, BE IT RESOLVED, that i:hcvi"ew of the above findings of fact, the Board
of Zoning Adjustments does hereby grant the request by the following vote:
AYES: Comms. Cummings, Ebey, Simpson, Toth, Chmn. Sims
NOES: None
ABSENT: Comm. Beard
CERTIFICATION
I hereby certify that the foregoing Resolution BZA 154-260 was adopted by the Board of
Zoning Adjustments at a regular meeting held on the 17th day of October, 1977.
