A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA
BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 164 FIRST STREET, HER-
MOSA BEACH, CALIFORNIA.
WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at public hearings
held on November 21, 1977 and December 19, 1977, considered the request of Mr. and Mrs.
John S. Harris for permission to add a second unit to an existing single family resi-
dence with a fireplace encroaching into westerly sideyard; also to provide three park-
ing spaces 8½1 x 20 1 , one of which is tandem, and one 8½ x 20 open parking space
encroaching into the easterly sideyard to the property line, on property known as Lot
15, Block 41, 1st Addition to Hermosa Beach Tract; and
WHEREAS, at the first public hearing, the Board indicated they did not feel they could
approve the original request for four 8 x 20 parking spaces and suggested the applicant
revise his plans and resubmit an alternate plan; and
WHEREAS, at the second public hearing, the applicant submitted alternate plans per
paragraph 1 above; and
WHEREAS, at said public hearing, a letter from a neighboring property owner supporting
the request was received and no one appeared to speak in opposition to the request; and
WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments
that the revised variance request is justified for the following reasons:
1. That there are exceptional or extraordinary circumstances or conditions
applicable to the property involved because of the width of the property and
being in an R-3 zone which is reduced to R-2 usage because of the lot size,
it is the most equitable way to produce four parking spaces. The existing
structure would have to be demolished or have considerable alteration in order
to meet present code.
2. That such variance is necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vicinity and
zone, and denied to the property in question because of the size of the lot and
the fact that it is committed to R-2 usage, and there are many other properties
within that same vicinity and zone which are currently enjoying multiple units
rather than a single family dwelling.
3. That the granting of such variance will not be materially detrimental to
the public welfare or injurious to the property or improvements in such vicinity
and zone in which the property is located because it does not directly affect,
any other property within that particular zone vicinity.
4. That the granting of such variance will not adversely affect the comprehen-
sive General Plan because it is in compliance with the General Plan.
AND, FURTHER, that the approval is subject to the following condition:
1. That a 6 ft. high masonry wall be required to be constructed along the
easterly property line adjacent to the open parking space.
NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board
of Zoning Adjustments does hereby grant 'the variance request by the following vote:
AYES: Comms. Anderson, Beard, Cu11111ings, Ebey, Simpson, Chmn. Sims
NOES: None
ABSENT: Comm. Toth
