HomeMy WebLinkAboutBZA Resolution 154-263 - (1236 3rd St)RESOLUTION B.Z.A. 154-263 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 1236 THIRD STREET, HER- MOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hear- ing held in the Council Chambers of the City Hall on December 19, 1977, considered the request of Mr. and Mrs. Michael Fife for permission to remodel an existing nonconfonning single garage, adding a second space and a roof deck/trellis above; a retaining wall and fence, and a new stair entry, both within the front setback, on property known as Lot 50 and 10' of 49, Tract 733; and WHEREAS, at said public hearing, the following facts were presented for consideration; that there are six houses with garages to property line on this block, all built in 1928; that, in 1947, the Planning Commission granted a variance to allow construction of a playroom over garage four houses to the west and, in 1974, the BZA granted a var- iance at the same location to erect a three-car garage with dwelling area above; that the existing single g·arage is built to front and side property lines; that the grade of the lot and location of existing residence precludes meeting front setback require- ments; that the proposed remodel will provide an additional off-street parking space and the roofdeck will increase the usable open space on the property by approximately 150 sq. ft.; and WHEREAS, at said public hearing, the applicant stated that the deck over the garage will not be completely covered; and WHEREAS, at said public hearing, no one appeared to speak in opposition to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the variance request is justified for the following reasons: 1. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved because of the grade of the lot, the fact that the garage already exists on the property line and is an excavation, it is directly adjacent to Prospect Avenue which is a main artery and the improve- ment should help with separation of the property from the heavy traffic corridor. 2. That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question because the condition of garages to the property line exists all along that block. 3. That the granting of such variance will not be materially detrimental to the public ~el fare or injurious to the property or improvements in such vicinity and zone in which the property is located because no testimony was received that it would have a detrimental effect on surrounding property, and addition of off- street parking is an improvement to the neighborhood. 4. That the granting of such variance will not adversely affect the comprehen- sive General Plan because there is no effect on density. NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments does hereby grant the variance request by the following vote: AYES: Comms.
