( RESOLUTION B.Z.A. 154-264 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH GRANTING A VARIANCE ON PROPERTY LOCATED AT 1042 STRAND, HERMOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hear- ing held on December 19, 1977, in the Council Chambers of the City Hall, considered the request of Earl Donaldson, Henry Bowman, Richard Greenwald and Thelma Greenwald for per- mission to make structural alterations to an existing nonconforming apartment building in a C-1 zone, consisting of four new balconies, a tile mansard roof, and redesigning the front entry, on 'property known as Lots 6 & 7, Block 11, Hermosa Beach Tract; and WHEREAS, at said public hearing, the following facts were presented for consideration; that the building is nonconforming in relation to use; i.e., number of units, excessive lot coverage, usable open space, no parking facilities, required setbacks, etc.; that the request is in exception to Section 1304 of the Zoning Code; and WHEREAS, at said public hearing, the applicant stated that all apartments have kitchens and bathrooms; the existing stucco is in hazardous condition; the overhang is in a weak condition and deteriorating; the proposed tile overhang will replace that and come out the same distance; the additional balconies will enhance the appearance of the property; and WHEREAS, at said public hearing, no one appeared to speak in opposition to the request; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the variance request is justified for the following reasons: 1. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved because balconies in front already exist and it would add to the appearance of the building; it is minor in nature and within the spirit of the City Council and Coastal Zone Commission expressions on this subject. 2. That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question because other rental properties within the same vicinity and zone have been allowed variances to upgrade and rehabilitate. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicin- ity and zone in which the property is located because encroachments are per- mitted for commercial enterprises in the same vicinity and zone. 4. That the granting of such variance will not adversely affect the compre- hensive General Plan because it does not affect density. NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments does hereby grant the variance l:>yr the following vote: AYES: Comms. Beard, Currunings, Simpson, Chmn. Sims NOES: Comms. Anderson, Ebey ABSENT: Comm.
