HomeMy WebLinkAboutBZA Resolution 154-265 - (27 7th St)RESOLUTION B.Z.A. 154-265 A RESOLUTION OF THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF HERMOSA BEACH DENYING A VARIANCE TO PROPERTY LOCATED AT 27 SEVENTH STREET, HER- MOSA BEACH, CALIFORNIA. WHEREAS, the Board of Zoning Adjustments of the City of Hermosa Beach, at a public hearing held on December 19, 1977, in the Council Chambers of the City Hall considered the request of Mr. and Mrs. Nonnan Allin for pennission (1) to make an over 40% second unit addition to a single family residence with existing nonconforming front and sideyard':setbacks; (2) to exceed the allowable 65% lot coverage by approximately 5½%; (3) to provide less than the required usable open space; and (41 to provide less than the required garage depth, on property known as Lot 18, Block 8, Hermosa Beach Tract; and WHEREAS, at'said public hearing, the following facts were presented for considerat-i,on; that the existing dwelling has a 11611 front yard setback and a 2 19" westerly sideyard in lieu of the 4 ft. required on each; that the proposed lot coverage is 70.7% in lieu of the 65% allowed; that the proposed usable open space does not meet the min- imum dimensions to meet code although there is more than required open space; that the proposed tandem garage depth is 37½ feet in lieu of the 40 ft. required; and WHEREAS, at said public hearing, the applicant stated that the proposed open space fails to meet code in one dimension by only 911 ; that they are providing four covered parking spaces where there is now one; that major remodeling of the existing dwelling would cause a great financial burden; that many of the properties within 100 yards have lot coverage in excess of 65% and several variances have been granted recently for lot coverage in the immediate area; and WHEREAS, at said public hearing, a petition bearing 72 signatures of residents in support of the request was submitted and a letter from one property owner in opposi- tion to the request was submitted; and WHEREAS, after due consideration, it is the opinion of the Board of Zoning Adjustments that the variance request is not justified because the Board cannot find that there are exceptional or extraordinary circumstances or conditions applicable to the prop- erty involved as the same rules apply to all properties in the vicinity; NOW, THEREFORE, BE IT RESOLVED, that in view of the above findings of fact, the Board of Zoning Adjustments does hereby deny the variance request by the following vote: AYES: Comms. Anderson, Beard, Cummings, Ebey NOES: Comm. Simpson, Chmn. Sims ABSENT: Comm.
