Smith, Bldg .. Supt.-s Bud Trott~ License Collector PETITION OF LL, W0 GARDINER Petition of D .. W,. Gardiner, reques·ting a zone variance covering a portion of Lot 32 anaeall of Lot 33, Shakespeare Beach Tract9 3031 ~trand, Zone R=l, to permit ·the construction of 36" eaves in the proposed addition to the existing residence at said address~ Mre Gardiner was present at the meeting and stated that he felt the extra eaves were necessary to insure protection from sunlight on the westerly frontageo After brief discussion of the matter, Comm~ Miller moved the petition be granted to allow a 36" eave overhang on the west port.ion of the house, because it will not affect the line of existing buildings in the block, and it will not obstruct light or air for this or any other buildingo Also, the average set=back in Hermosa Beach is 59, and the set=back in this block is 996190 The motion was sscon.ded by Commo Slack, and Resolution NooPC 36 was adopted by the following vote: AYE: Commo Black, Fisher~ Haneman1 Millers ViaultJ Chairman Dennie, Mayor Edwards NO: None PETITION OF LSe HALEIN Petition of A .. S., Halpin, requesting a zone variance covering Lot 7, Garden View Tract10 410 Ocean View Ave,,~ Zone R-3, to permit the con-, ,,.....,., struction of a garage in the front yard and without the required side yard along the north property line~ Comm~ Viault pointed out the fact that the garage has already been built~ Mro Smith said Mro Halpin had been issued a permit for the
" "'~ . ..-~ ... n "'.:--",.:n:~_i ~"Sir 1 Page 1'wo August 8·.r 19,5 { construction of a retaining wall, but had proceeded with the constructio11 of the garage without taking out further permits~ ( Commo Fisher moved the granting of this petition, because it will conform to the existing garages in that blocko Also, because 0£ the contour of the land, there would be no other way of building a garage., The grant,ing of this petition is to be contingent upon the issuance of the proper per-mits., The motion was seconded by Commo Black, and Resolution NooPC 37 was adopted by the following vote: AYE: Comm& Black, Fisher, H~eman, Miller, Viault, Chairman Dennie, Mayor Edwards NO: None PETITION OF LUCIL~ HARBOLT Petition of Lucile Harbolt, requesting a zone variance covering Lot 5, Block 2, WoJoSmith Tract, 8J8c·l6th Street, Zone R-2 to permit the in-stallation of a roof 011 existing patio of unilite or plaxilite and gutter to catch rain0 Mrso Harbolt was present and explained that the roof will adjoin the exi3t-inglwall, which is built 6" from the west property line and 6" from the rear property lineo She felt this would not be detrimental to surrounding property owners, because she owns the lot to the west, (Lot 4), and thinks the owner of the lot to the south will be putting in a driveway abutting her south property line. There were several suggestions made as to how to allow for fire protection, how to avoid using the)' side yard, etc. There was also discussion as to whether or not the Commission is giving the variance for the building of the roof, or for the use of the lando It was mentioned that if the petition is granted, the petitioner will still have to conform to existing building code requirements concerning fire protection, etco. or will have to petition the council for exceptions to these requirementao Comm. Fisher moved that the perition as presented by the Harbolts be amended from its present wording "to install roof on patio" to read "to extend into the west side yard 2!' and to within 6" of the rear property line"o Petitioner was present and requested that the petition be so changed, with the Planning Commission granting a variance to use the landa This variance is to grant the right to use the lmid for patio purposes onlyo This is to allow•the use of an existing unroofed patio without prejudice to adjoining property~ The motion was seconded by Commo Haneman, and Resolution No.PC 3g was adopted by the following vote: AYE: \..
