P.C. RESOLUTION NO.03-25
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA
BEACH, CALIFORNIA DENYING A REQUEST TO EXTEND A PRECISE
DEVELOPMENT PLAN FOR REDEVELOPMENT OF AN EXISTING COMMERCIAL
BUILDING AT 1605 PACIFIC COAST HIGHWAY, THE HERMOSA PAVILION.
The Planning Commission of the City of Hermosa Beach does hereby resolve and order as
follows:
Section 1. An application was filed by Gene Shook, owner of real property located at 1605 Pacific
Coast Highway, to extend a Precise Development Plan 01-19, approved May 12, 2002, for redevelopment
of a commercial building and entertainment center with 108,430 square feet of development consisting
of 25,380 square feet of office, 68,000 square feet of fitness club and 15,050 square feet of retail. The
request is made pursuant to Section 17.58 .050 which states that a Precise Development Plan approval
is valid for one year, and if development fails to commence within such time limitation, and no
extension is granted, shall become null and void.
Section 2. The Planning Commission conducted a hearing to consider the request for an extension
on May 20, 2003, at which testimony and evidence, both written and oral, were presented to and
considered by the Planning Commission.
Section 3. Based on the evidence received at the hearing, and the past performance of the property
owner with respect to previous entitlements, which have expired, the Planning Commission makes the
following findings:
1. The applicant has not provided any reasonable justification for extending the deadline
for acting on the Precise Development Plan approval.
2. The applicant has not demonstrated due diligence in implementing the project in the year
that has elapsed since obtaining approval, as no final plans demonstrating efforts to comply with the
Conditions of Approval of the Precise Development Plan 01-19, Variance 01-4 and Parking Plan 01-4
have been submitted, and no construction plans have been submitted.
3. The applicant has previously shown a lack of preparation and due diligence in
implementing project approvals for this property and has failed to take the necessary steps following
project approval to implement construction. Two prior entitlements, in January and July 1999 failed to
show any progress towards implementation and expired. Because of this past performance the
Commission has no reason to expect due diligence or timely processing should the project be extended.
Section 4. Based on the foregoing, the Planning Commission hereby denies the request to extend
the Precise Development Plan for the subject property, thereby also invalidating the Parking Plan and
Variance.
