P.C. RESOLUTION NO.02-16
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
HERMOSA BEACH, CALIFORNIA, MODIFYING THE APPROVED
PRECISE DEVELOPMENT PLAN (P.C. RESOLUTION 99-50) AND THE
APPROVED PARKING PLAN (P.C. RESOLUTION 00-32) BY
ELIMINATING THE REQUIREMENTS FOR SHARED PUBLIC USE OF
THE OFF -SITE SURFACE PARKING LOT LOCATED AT 702 11TH
PLACE (AKA 1131 PACIFIC COAST HIGHWAY).
Section 1. An application was filed by Beach Cities Christian Fellowship, lessee of the
surface parking lot, seeking amendment of the Precise Development Plan that allowed the construction
of the parking lot, and seeking amendment of the Parking Plan that allowed said off -site parking to
provide required parking for expmision to the church. The amendment is to eliminate the conditions of
both the Precise Development Plan and Parking Plan approvals that required the parking lot to be
shared for public use.
Section 2, The Planning Commission conducted a duly noticed public hearing to consider the
application for amendment to the Precise Development Plan and Parking Plan on March 19, 2002, at
which testimony and evidence, both written and oral, was presented to and considered by the Planning
Commission.
Section 3. Based on evidence received at the public hearing, the Planning Commission
makes the following factual findings:
1. The property owner (Best California Gas) is leasing the subject property to the church
(Beach Cities Christian Fellowship) for use as a parking lot to supplement its parking.
2. The parking is a permitted commercial use within the C-3, General Commercial Zone and the
parking lot has been constructed and operated consistent with the approved Precise Development Plan with
the exception of the requirement to share the parking for public use.
Sgatioii . Based on the foregoing factual findings, the Planning Commission makes the
following finding pertaining to the application for amending the Precise Development Plan and Parking
Plan:
1. The conditions of approval requiring the church to share the use of the parking lot for
public use, with posted signs and hours restrictions, was based on the original request of the applicant.
Because of the public use of the parking lot, the fees for the Precise Development Plan and plan
checking and building permit fees were waived. Since the parking lot has been completed, the
applicant determined that this condition is unduly restrictive, and the Commission finds it appropriate
to remove the condition, in order to allow the church to use the parking lot at its discretion as long the
church reimburses the City for the waived fees.
Se�ctioii 5. Based on the foregoing, the Planning Comimission hereby modifies the subject
Precise Development Plan as set forth Resolution 99-50, and modifies the subject Parking Plan, as set
forth in P.C. Resolution 00-32, to delete conditions of approval that require shared common parking for
public use, and to delete all references to the off -site parking lot as a common parking facility, subject
to the following condition of approval:

1. The Precise Development Plan application fees, plan check, and building permit
fees that were waived by the City Council because of the proposed shared use of
the parking lot for public use shall be paid by the applicant.
Section 6. Pursuant to the Code of Civil Procedure Section 1094.6 any legal challenge to
the decision of the Planning Commission, after a formal appeal to the City Council, must be made
within 90 days after the final decision by the City Council.
