P.C. RESOLUTION 00-48
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA
BEACH, CALIFORNIA, APPROVING A ROOF DECK ADDITION FOR AN EXISTING
SINGLE FAMILY RESIDENCE WITH A NONCONFORMING FRONT YARD
SETBACK, AT 304 MANHATTAN AVENUE, LEGALLY DESCRIBED AS THE WEST
50 FEET OF LOT 8, TRACT 1073.
The Planning Commission of the City of Hermosa Beach does hereby resolve and order as
follows:
Section. L An application was filed by George Shweiri, owner of real property located at
304 Manhattan Avenue, requesting approval of a 399 square foot roof deck area addition to an
existing nonconforming single family residence.
Section 2. The Planning Commission conducted a hearing to consider the application on
August 15, 2000, at which testimony and evidence, both written and oral, were presented to and
considered by the Planning Commission.
Section 3. Based on the evidence received at the public hearing, the Planning Commission
makes the following factual findings:
1. The applicant is proposing a 399 square foot roof deck area addition to a single family
residence, resulting in a 52.4 percent increase in valuation, pursuant to Section 17.52.030 of
the Zoning Ordinance;
2. Approval of the expansion is consistent with the intent and goals of Chapter 17.52 of the
Zoning Ordinance;
3. The scale of the proposed expansion is consistent with planning and zoning requirements for
the R-3 zone and does not warrant requiring the current nonconformities to be brought into
conformance;
4. The proposed addition is consistent with the parking requirements of Section 17.44.140 of
the Zoning Ordinance;
5. The project is Categorically Exempt from the requirements of the California Environmental
Quality Act, pursuant to CEQA guidelines, Section 15301 e (2) with the finding that the
project is in an area with available services and not in an environmentally sensitive area.
Section 4. Based on the foregoing, the Planning Commission hereby approves a 399 square
foot roof deck area addition, subject to the following Conditions of Approval:
1. The project shall be consistent with submitted plans. Modifications to the plan which do
not involve any further expansion shall be reviewed and may be approved by the
Community Development Director.
2. Precise height shall be reviewed at the time of plan check for building permits.
3. This approval shall be null and void one year from the date of approval unless Building
Permits have been obtained. The applicant may apply in writing for an extension of tine
to the Planning Commission prior to the date of expiration.
