RESOLUTION 00-41 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HERMOSA BEACH, CALIFORNIA, DENYING A REQUEST FOR A CONDITIONAL USE PERMIT AMENDMENT TO MODIFY THE SEATING PLAN, FOR A RESTAURANT WITH LIVE ENTERTAINMENT AND ON -SALE GENERAL ALCOHOL, AT 50A PIER AVENUE, AND LEGALLY DESCRIBED AS LOTS 8, 9, AND 10, BLOCK 12 HERMOSA BEACH TRACT Scctiog 1, An application was filed by Fred Hahn, seeking to amend the previously approved restaurant seating plan of an existing restaurant "Patrick Malloy's" with an existing Conditional Use Permit for live entertainment and on -sale general alcohol (C.U.P. 98-6) ect oli 2, The Planning Commission conducted a duly noticed de novo public hearing to consider the application to amend the Conditional Use Permit on June 20, 2000, at which testimony and evidence, both written and oral, was presented to and considered by the Planning Commission. Section 3. Based on evidence received at the public hearing, the Planning Commission makes the following factual findings: 1. The applicant is proposing to amend the seating plan to expand the number of stand- up tables, eliminate a divider between the bar and dining areas and create bank seating along the west wall. The approved seating plan will serve as the official plan regulating occupant load based on the requirements of the Building Code. 2. The site is located in the downtown district, which has several restaurants with live entertainment; 3. The site is zoned C-2 allowing the proposed live entertainment and general alcohol sales with a Conditional Use Permit. Section 4_. Based on the foregoing factual findings, the Planning Commission makes the following findings pertaining to the application to amend the Conditional Use Permit: 1. The site is zoned C-2, and located in downtown district which has a restaurant trade orientation, and the amendment will intensify the use of existing restaurant to primarily a bar use. 2. The proposed amendment will change the primary use of the restaurant to a bar and increase the occupant load which is not in accordance with the original approval of this business as a sit-down restaurant.
