RES-26-7550 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH, CALIFORNIA, APPROVING THE ENGINEER’S REPORT FOR THE HERMOSA BEACH LANDSCAPING AND STREET LIGHTING DISTRICT 2026-2027 WHEREAS, the City Council (“Council”) adopted Resolution No. RES-26-7541 dated March 10, 2026 directing the Director of Public Works to prepare an Engineer’s Report in accordance with Article 4 of Chapter 1 of the Landscaping and Lighting Act of 1972 (Section 22500 et seq. of Part 2 to Division 15 of the California Streets and Highways Code) (“Act”) for the Hermosa Beach Landscaping and Street Lighting District (“District”) for the fiscal year commencing July 1, 2026 and ending June 30, 2027; and WHEREAS, the District provides for the installation, maintenance, servicing, and operation of public landscaping, street lighting, traffic signals, and appurtenant improvements within the boundaries of the District (“Improvements and Services”); and WHEREAS, under the direction of the Director of Public Works, NV5 (through Jeffrey M. Cooper, PE, as the expert Assessment Engineer acting as the duly appointed Engineer of Work) prepared and filed in the office of the City Clerk a written report (“Engineer’s Report”) in accordance with the Act (Article 4 of Chapter 1); and WHEREAS, the Council has carefully examined and reviewed the Engineer’s Report and has preliminarily determined that the Engineer’s Report is sufficient and that the assessments described therein are apportioned in accordance with the special benefits received by the properties within the District. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. Recitals. The recitals above are true and correct, and are hereby incorporated herein by this reference. SECTION 2. Approval. The Engineer’s Report is hereby approved as filed. . The Council finds the following pursuant to the CEQA Guidelines: a. Section 15378. Adoption of this Resolution is not a “project” within the meaning of Section 15378 because it constitutes an administrative and fiscal action approving an Engineer’s Report and initiating annual assessment proceedings, and initiating annual assessment proceedings does not authorize or approve any specific physical change to the environment. b. Section 15301 (Class 1 - Existing Facilities). The action is exempt from CEQA because it involves the continued maintenance, operation, and servicing of existing public landscaping, lighting, traffic signals, and related improvements with no expansion of existing use. c. Section 15061(b)(3) (Common Sense Exemption). The action is exempt from CEQA pursuant to Section 15061(b)(3) because it can be seen with certainty that there is no possibility that adoption of this Resolution may have a significant effect on the environment. d. Section 15300.2. None of the exceptions set forth in Section 15300.2 apply. SECTION 4. Severability. If any section or provision of this Resolution is for any reason held to be invalid or unconstitutional by any court of competent jurisdiction or contravened by reason of any preemptive legislation, the remaining sections and/or provisions of this Resolution shall remain valid. The Council hereby declares that it would have adopted this Resolution, and each section or provision thereof, regardless of the fact that any one or more section(s) or provision(s) may be declared invalid or unconstitutional or contravened via legislation. SECTION 5. Certification. The City Clerk shall certify to the passage and adoption of this Resolution; cause the same to be entered among the original resolutions of the City; and make a minute of the passage and adoption thereof in the records of the proceedings of the Council in the minutes of the meeting at which time same is passed and adopted. SECTION 6. Effective Date. This Resolution will become effective immediately upon adoption.
