RES-26-7551 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH, CALIFORNIA, DECLARING ITS INTENTION TO ORDER CERTAIN IMPROVEMENTS AND TO LEVY AND COLLECT ASSESSMENTS WITHIN THE HERMOSA BEACH LANDSCAPING AND STREET LIGHTING DISTRICT 2026- 2027 FOR THE FISCAL YEAR BEGINNING JULY 1, 2026 AND ENDING JUNE 30, 2027; AND APPOINTING A TIME AND PLACE FOR A PUBLIC HEARING IN RELATION THERETO WHEREAS, the City Council (“Council”) of the City of Hermosa Beach (“City”) adopted Resolution No. RES-26-7541 dated March 10, 2026, directing the Director of Public Works to prepare and file an Engineer’s Report for the Hermosa Beach Landscaping and Street Lighting District (“District”) pursuant to the Landscaping and Lighting Act of 1972 (Sections 22500-22679 to Part 2 of Division 15 of the California Streets and Highways Code) (“Act”); and WHEREAS, the District provides for the installation, maintenance, servicing, and operation of public landscaping, street lighting, traffic signals, and appurtenant improvements within the boundaries of the District (“Improvements and Services”); and WHEREAS, the Engineer of Work (Jeffrey M. Cooper, PE, of NV5) has prepared and filed with the City Clerk the Engineer’s Report (entitled “Engineer’s Report, City of Hermosa Beach Landscaping and Street Lighting District 2026-2027”) in accordance with the Act (Article 4 of Chapter 1); and WHEREAS, the Council has reviewed and approved the Engineer’s Report; and now desires to declare its intention to order the Improvements and Services, and levy and collect assessments within the District for Fiscal Year 2026-2027. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: Docusign Envelope ID: 4744C903-90C3-82B3-830A-CD38F096B335 Page 2 of 4 RES-26-7551 SECTION 1. Recitals. The recitals above are true and correct, and are hereby incorporated herein by this reference. SECTION 2. Intention to Order Improvements and Levy Assessments. The Council hereby declares its intention to order the continued maintenance, operation, servicing, and improvements within the District; and to levy and collect assessments within the District for the Fiscal Year commencing July 1, 2026, and ending June 30, 2027. SECTION 3. Description of Improvements and Services. The Improvements and Services consist generally of the continued maintenance, operation, and servicing of public landscaping, street lighting, traffic signals, irrigation systems, street trees, medians, parkways, and appurtenant facilities located within public street and sidewalk rights-of-way throughout the District (as more particularly described in the Engineer’s Report). SECTION 4. District. The District is designated as the “Hermosa Beach Landscaping and Street Lighting District 2026-2027”. The boundaries of the District are coterminous with the boundaries of the City as shown in the Engineer’s Report and accompanying assessment diagram on file in the Office of the City Clerk. SECTION 5. Assessment Rate. The proposed assessments for Fiscal Year 2026- 2027 are not proposed to increase from the assessments levied during Fiscal Year 2025-2026, and shall remain at forty-one dollars and forty-five cents ($41.45) per Equivalent Dwelling Unit (“EDU”) as set forth in the Engineer’s Report. SECTION 6. Engineer’s Report. Reference is hereby made to the Engineer’s Report on file with the City Clerk for a full and detailed description of the improvements, the boundaries of the District and any zones therein, and the proposed assessments upon assessable lots and parcels of land within the District. SECTION 7. Applicable Law. The Improvements and Services shall be provided pursuant to the Act and in accordance with the plans, specifications, and descriptions contained in the Engineer’s Report on file with the City Clerk. SECTION 8. Collection of Assessments. The assessment shall be levied and collected at the same time and in the same manner and with the same interest and penalties as general taxes of the City, which are collected for the City by the Los Angeles County Tax Collector. SECTION 9. Exempt Property. Public property owned by any public agency and used for public purposes, together with railroad and utility rights-of-way, shall be exempt from assessment as provided in the Engineer’s Report and applicable law. The Council acknowledges that the City intends to contribute funds from the General Fund in the approximate amount of four hundred twenty-two thousand, eight hundred sixty-five dollars and forty cents ($422,865.40) to offset the operational costs of the District for Fiscal Year 2026-2027, as described in the Engineer’s Report. SECTION 11. Public Hearing. NOTICE IS HEREBY GIVEN the Council shall conduct a public hearing on Tuesday, June 23, 2026, at 6:30 p.m. (or as soon thereafter as the matter may be heard) in the City Hall Council Chambers located at 1315 Valley Drive, Hermosa Beach, California, to consider the levy and collection of assessments within the District and to hear and consider all protests and comments regarding the proposed assessments. SECTION 12. Notice. The City Clerk is hereby authorized, designated, and directed to give notice of the public hearing in the time, form, and manner required by law. SECTION 13. Newspaper Publication. The Easy Reader is hereby designated as the newspaper of general circulation in which the notice of public hearing shall be published pursuant to applicable law. SECTION 14. California Environmental Quality Act (“CEQA”). The City Council finds the following pursuant to the CEQA Guidelines: a. Section 15378. Adoption of this Resolution is not a “project” within the meaning of Section 15378 because it constitutes an administrative and fiscal action initiating annual assessment proceedings, and initiating annual assessment proceedings does not authorize or approve any specific physical change to the environment. b. Section 15301 (Class 1 – Existing Facilities). The action is exempt from CEQA because it involves the continued maintenance, operation, and servicing of existing public landscaping, lighting, traffic signals, and related improvements with no expansion of existing use. c. Section 15061(b)(3) (Common Sense Exemption). The action is exempt from CEQA pursuant to Section 15061(b)(3) because it can be seen with certainty that there is no possibility that adoption of this Resolution may have a significant effect on the environment. d. Section 15300.2. None of the exceptions set forth in Section 15300.2 apply.
