RESOLUTION NO. RES-26-7553
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HERMOSA
BEACH, CALIFORNIA, AMENDING THE CITY'S MASTER FEE SCHEDULE TO
INCREASE THE ANNUAL PICKLEBALL MEMBERSHIP AND HOURLY
RESERVATION FEES FOR HERMOSA BEACH RESIDENTS AND FINDING THE
PROJECT EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY
ACT
WHEREAS, the City of Hermosa Beach ("City") is authorized to regulate and
establish fees for such programs and public facility reservations by resolution
pursuant to the California Constitution (Section 7 to Article XI, and Sections 1 (e) (2)
and 1 (e) (4) to Article XIIIC), California Government Code Sections 66014, 66016,
and 66018; and
WHEREAS, it is the intent of the City Council to recover costs reasonably
borne in providing City services pursuant to Hermosa Beach Municipal Code
Section 2.64.010, and to assess charges imposed for the entrance to or use of
local government property; and
WHEREAS, the City conducted Recreation Fee Study of local cities' fees
related to pickleball memberships and reservations, which was presented to the
City Council ("Council") at its regular meeting of May 12, 2026. The review
demonstrates that the City's existing fees are lower than some neighboring
jurisdictions, and do not adequately account the City's administrative and
oversight costs; and
WHEREAS, at its regular meeting of May 12, 2026, the Council directed staff
to prepare fee increases to the annual Pickleball Membership and hourly
reservation rates for Hermosa Beach residents ; and
WHEREAS, management of the Pickleball Membership Program and
associated reservations require staff time and resources; and
WHEREAS, the proposed fee increases are intended to recover and does
not exceed the City's reasonable administrative and oversight costs and provide
a fair and regionally consistent fee structure; and

WHEREAS, there is a reasonable relationship between the amount of the
annual Pickleball Membership and hourly reservation fees and the burdens
imposed on the City by management of the Pickleball Membership Program and
associated reservations, and that the amount of the fee has been calculated
based upon the City's estimated reasonable costs of providing such specific
governmental services; and
WHEREAS, the increase of the annual Pickleball Membership and hourly
reservation fees constitutes a charge imposed for a specific government service
provided directly to the payor that is not provided to those not charged and does
not exceed the reasonable costs to the City of providing such service, and
therefore the fee is not a tax pursuant to the California Constitution (Section
1 (e) (2) to Article XIIIC); and
WHEREAS, the City has made available data regarding the cost or
estimated cost of providing services for the fees at least ten (10) days before the
public meeting held on June 9, 2026, pursuant to the California Government
Code Sections 66016 and 66018; and
WHEREAS, the increase of the annual Pickleball Membership and hourly
reservation fees additionally constitutes a charge imposed for entrance to or use
of local government property, or the purchase, rental, or lease of local
government property, and therefore the fee is not a tax pursuant to the California
Constitution (Section 1 (e) (4) to Article XIIIC); and
WHEREAS, the Council desires to amend the City's Master Fee Schedule
to adopt the increase of the annual Pickleball Membership and hourly
reservation fees for Hermosa Beach residents.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH,
CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. Incorporation of Recitals. The above recitals are true and
correct, and are incorporated herein by this reference.
SECTION 2. Amendment. Exhibit D of the City's Master Fee Schedule,
"Recreation Facilities and Fees," is hereby amended to increase the existing
Pickleball Courts fees to $12 per hour resident reservation fee and $25 annual
membership rate.

SECTION 3. Findings. The City Council finds that the fees set forth in the
Master Fee Schedule do not exceed the reasonable costs to the City of providing
the respective services, as demonstrated in the Recreation Fee Study.
SECTION 4. California Environmental Quality Act ("CEQA"). The City
Council finds that this Resolution is statutorily exempt from CEQA pursuant to
Section 15378(b) (5) of the CEQA Guidelines as it is an organization or
administrative activity of the City that will not result in direct or indirect physical
changes in the environment.
SECTION 5. Severability. If any part of this Resolution or its application is
deemed invalid by a court of competent jurisdiction, the Council intends that
such invalidity will not affect the effectiveness of the remaining provisions or
applications; and, to this end, the provisions of this Resolution are severable.
SECTION 6. Certification. The City Clerk is directed to certify the passage
and adoption of this Resolution; cause it to be entered into the City's book of
original Resolutions; make a note of the passage and adoption in the records of
this meeting; and, within fifteen (15) days after the Resolution's passage and
adoption, cause it to be published or posted in accordance with California law.
SECTION 7. Effective Date. This Resolution will become effective
immediately upon adoption.
