Schubert, excused, Peirce Mr. Rod Merl, Staff APPROVAL OF MINUTES Motion by Comm. Rosenberger, seconded by Comm. Bishop, to approve the minutes of April 24, 1978, with the following corrections: Page 2. manufacturing zone modification, paragraph 5, line 4 ... 11 tax roles 11 • Page 5. condominium ordinance -11 Motion retracted, and second retracted 11 • 11members of the Commission concurred and this was so ordered. Schubert, Peirce SECTION II -Plannin g Issues \ Highway Improvement -Mr. Merl commented on joint discussion of Pacific Coast Highway undergrounding (remarked City monies are available and county funds may be sought). This will occur from Pier Avenue to Herondo, the southern City limits, at a cost of more than $400,000. City has approximately $120,000 and can borrow up to three years funds ($250,000 in total). County might make up the difference. Chmn. Fritz commented on the meeting recently held. The County representative was very con-commital. It would cost each merchant approximately $1,000. The highway would be torn up for approximately four months. The highway commercial zoning question will be looked at by zoning subcommittee for necessary changes. Comm. Rosenberger stated that the development subcommittee has held one meeting regarding traffic circulation. The Zoning Commission will recommend changes that can be made after zoning is looked at more closely. Brief discussion regarding noticing and action by City Council was discussed. GENERAL PLAN AND CIRCULATION The Development Subcommittee met recently to discuss the circulation problem. There are few options to current traffic flow. Committee agreed there are problems with stop signs and use can also be a hinderence. There is more noise and more pollution. Subcommittee will also talk to Police and Fire departments for their needs. Parking Control mentioned that one-waying has cleaned up some situations. In the north end, a suggestion would be one-waying of very narrow streets, for exapmle 29th Street. The Subcommittee will discuss items further and a map with all stop signs and stop lights will be developed by staff. A possibility of.three l anes t peak hours on Pacific Coast Highway is also under discussion. Comm. Rosenberger asked why there is no public hearing on this matter before City Council. This resolution will be on the consent calendar. There is a problem of obtaining addresses1 and Chmn . Fritz commented on the difficulty of implementation. Discussion was held regarding bulk rate and first class mail. Questions were raised as to noticing illegal units and property owners. Comm. Rosenberger would like to have the findings of where this resolution came from and what it is based on. Coun- cil should be aware of procedure problems and cost. It will be suggested that a joint subcommittee meeting should be held. SECTION III -Public Hearings No one from the audience wished to be heard on either consent calendar items. Motion by Comm. Smith, seconded by Corrm. Bishop to approve Items A and B. Item A is approval of Resolution P.C. 78-17, P.C. 78-18, P.C. 78-19 and P.C. 78-20. Item Bis approval of tentative map no. 33436 for a two-uni:t planned development at 525-527 -25th Street. ( Resolution P. C. 78-25). Ayes: Absent: Abstain: Comm. Loosli, Bishop, Rosenberger, Chmn. Fritz Comm. Schubert, Peirce Comm. Smith Condominium Ordinance Revisions were presented with changes made at the last meetings. If the document is approved it will be submitted to the BZA, for environmental review. The City attorney wi 11 have to give information rega r ding noticing of this ordinance. Changes were suggested and Mr. Merl made note. Public hearing was opened at 8:50 p.m. Mr. Jack Wood, 803 Loma Drive commented on the size of the minimum lot. There are 1267 lots in the R-2 area and 1347 lots in the R-3 area. A significant number of lots are affected by this ordinance. Lot size could curtail lot development, and thus encourage high price single family residences. ColllTiission members commented on the uniqueness of the condominium project. Chmn. Fritz interrupted and asked Mr. Wood what his recommendation for a minimum lot size was. He commented that with the present restrictions in the ordinance, the zoning numbering method is useless. Public hearing was closed at 9:19 p.m. Comm. Smith strongly does not approve of Section 4. Comm. Loosli does not like resi- dential using commercial zones. Comm. Rosenberger commented on page 4, section 5 D. Would like to add ... 11 unless the applicant waives this time restraint". Page 5, Section I -1st paragraph, last sentence 11 ••• and contiguous 11 ••• Section four was then discussed. Comm. Smith would like to have the minimum size reduced to allow imagination of design and plan. Comm. Bishop commented on the limi- tations of the small lots to meet code requirements. Comm. Loosli commented on the difference between condominium and duplex units, which are the same in his opinion. The point of the ordinance is better develo pment with open areas on the tiny l ots . Comm. Rosenberger quoted footage recommenda tions for de velopers, the subcommi ttee and Commission. The only difference is the qual i ty of the proposed de velopment. One suggestion would be an overlay zone. Chmn . Fr itz suggested that ea ch Commissioner come up with a plan for Section 4 and joint meeting be held with the City Coun cil . Chmn. Fritz, Comms. Peirce and Rosenberger man the subcommittee. 'PLANNING COMMISSION MINUTES CONTINUED • Meeting reconvened at 9:58 p.m. 393 Aviation MAY 8, 1978 Page 3 This is a commercial planned development. Access would be from Aviation with sub- terranean garages. There are seven condominium units and 1000 sq. ft. of commer- cial building use. Height will be 36 1 per plan check. Turning radius n·ow meets code, as well as parking spaces and other requirements. Three letters in opposition have been received by Commission. Comm. Rosenberger commented on the use of commercial zoned property for mixed resi- dential usage only under commercial planned development Public hearing opened at 10:04 p.m. Mr. Larry Arico, 960 -15th Street, Hermosa Beach, applicant, and Russell Kildorf, 2701 Pacific Avenue, Manhattan Beach, architect, were questioned by Commissioners. A buffer wall would lessen the noise level. Residential and commercial parking will be separated by a gate. This could back up traffic on Aviation. The mix of com- mercial and residential is planned because the area backs up to residential and the area is quiet. The three co-owners will live on the property. Public hearing closed at 10:12 p.m. Comm. Rosenberger is not in favor of the project as it does not seem to be in good use of the commercial land, and particularly this lot. Only 8% would be commercial per plan. Comm. Loosli commented on the manufacturing zone changes and all the opposing arguments. The commercial zone should be enhanced, as it is less than 4% of the City. Comm. Bishop concurred and added emphasis on the commercial zoning adding employment. Comm. Smith did not oppose the mix but would like to see more commercial use. This does not represent a good living situation. Chmn. Fritz does not like the project as it could set a precedent and there is little enough commer- cial property. Mr. Kildorf asked what ratio would be acceptable, but Chairman Fritz could not give specific figures. Comm. Rosenberger commented on other condo-commercial projects in the City; such as that at Manhattan and Pier Avenue. Accumulated impact on the City must be considered, stated Comm. Loosli. Applicants and Commission discussed the commercial zoning and use implication of this zoning (Proposal is 92% residential use). Chmn. Fritz asked Mr. Arico if he understood that this was a commercial zone and_ that a commercial planned development is descretionary . Mr. Arico said he knew that, but also felt t he Commission should realize this is not a good commercial site. Commission indicated it was willing to continue the item for two meetings for redesign with more commercial, however, the applicant requested that they action at this meeting or he would appeal to the City Council. Motion: by Comm. Smith, seconded by Comm. Loosli, to approve project with conditions one through eight as stated. Ayes: Noes: Absent: None Comm. Smith, Loosli, Bishop, Rosenberger, Chmn. Fritz Comm. Peirce, Schubert Applicant was advised of right to appeal through City Managers office. ~ PLANNING COMMISSION MINUTES CONTINUED MAY 8, 1978 Page 4 Resolution P.C. 78-21 Following public hearing, applicant and architect spoke. There are no oral but three written communications in opposition. Commission feels that project exceeds a desir- able percentage of residential usage in relation to commercial. The location is un- suitable because of the near total loss of commercial property and on an arterial is an invonvenient development because of limited and possibly dangerous traffic patterns. There is less than 4% manufacturing use zoned property in the City. General plan addresses the need for employment within the City and this plan negates that purpose. Residential property requires more city services and, therefore, more tax dollars. Loss of commercial use would loose tax dollars. Motion by Comm. Fritz, seconded by Comm. Rosenberger, to adopt Resolution P.C. 78-21 Ayes: Noes: Absent: 316 Pier Avenue Comm. Smith, Loosli, Bishop, Rosenberger, Chmn. Fritz None Comm. Peirce, Schubert Reinstatement for conditional use permit for service of beer and wine in conjunction with a restaurant. There has been a change of ownership which closed the business for more than 90 days. It now requires a new permit. Reinstatement is only for beer and wine. Previous license was for general liquor sales. Public hearing opened at 10:43 p.m. Mr. Moriyuki Sanada, 14030 Chadron, Hawthorne, applicant was present. Restaurant will be Japanese food. Public hearing closed at 10:45 p.m. Motion by Chmn Fritz, seconded by Comm. Smith, to approve with conditions of operation as follows: 1. No off-sale of any alcoholic beverage; no take-out of any alcoholic beverage. 2. Operators of the business must police the sidewalks which are directly adjacent to the business for litter and maintain in a clean and orderly manner on a daily basis. 3. If the Police Chief determines that a police problem exists in relationship to this business, he may require that the business provide a doorman. 4. No change in operating hours (11:30 a.m. to 11:00 p.m.) without prior approval of the Planning Commission. 5. Meals must be available throughout operating hours. No alcoholic beverages may be served if meals are not available. -Meals shall cover a selection of foods including at least three lot entrees. 6. Three-month review. Ayes: Noes: Absent: Comm. The use is consistent with previous use and with the zone. Applicant agreed to conditions. Motion by Chmn. Fritz, seconded by Comm. Rosenberger to approve Resolution P.C. 78-22. Ayes: Noes: Absent: 222 -29th Street Comm. Smith, Bishop, Loosli, Rosenberger, Chmn. Fritz None Comm. Peirce, Schubert Motion by Comm. Rosenberger to continue and so ordered by Chmn. Fritz because the map is not ready. 1200 Hermosa Avenue -Shenanigans This is a review of the conditional use permit carried over from the last meeting. The main question is regarding the service of food which has been unavailable as noted by a staff member and dancing without a permit also. Public hearing opened at 10:50 p.m. Mr. John McCann, 2719 W. 166th Street, Torrance, commented that there has been a recent stock transfer from Charles Ramon. 11Russ 11 is no longer involved. A great expense would be involved in changing the kitchen and tentative opening is May 24th for a seafood/oyster bar. Comm. Rosenberger commented on the bad example set by this 11 restaurant11 • Mr. McCann said food will be available within 30 days and place- ment of chairs and tables will stop the dancing. David Tarling, 147 B Paseo de la Concha, Redondo Beach, the upstairs neighbor, stated that Mr. McCann has been very cooperative. Motion by Chmn. Fritz, seconded by Comm. Rosenberger, and so ordered to continue this matter for 30 days when all conditions will be met. There will be a staff report at the June 12th meeting. Fourth year conmunity development. Matter was continued SECTION IV -Commissioners Items 1500 Strand cementing and landscaping item will be discussed at the next meeting. Stairs must be restructured per the Building Department. Commission expressed con- 'Cern that a situation like this can set a precedent. C.U.P memo was discussed by staff. Comm. Rosenberger suggested that it be in con- junction with E.I.R's for procedures which involve the Planning Commission. This would transfer C.U.P's to the BZA. This would not include condominiums. Commission approves of the plan to send C.U.P's to the BZA. Staff will submit a memo. Alpha Beta Liquor license situation was also discussed. The City Council thinks there are too many liquor licenses at this time. This is an issue because of the approval of the Comedy Store. Council protested its opening. The Commission was advised that the Council wants C,U,P~ appli.cants to be advised that even if they are approved for a C,U,P, they are still subject to a protest by the City Council in regard to their ABC application, Fences on City property on the walk-streets were discussed briefly. Mr. Merl com- mented on how the ABC works and the formula they use, There is no standard but they do not necessari.ly go by it and compare to crime rates, Hence the rule is meaningless. There are also distance rules from chu~ches and schools, Comm. Smith corrmented on the need, or lack of need, for a C,U,P for liquor licenses, i.e. opposi- tion to free enterprise systems . Thus, findings are very important in issues such as these.
