SOCIAL ELEMENT
Chmn. Fritz said the subcommittee meeting was not held this evening, but he requested
consideration of two sections already reported out, i.e., Emergency Medical Services
and Adult Education.
Comm. Rosenberger had questions concerning the wording of the Emergency Medical
Services section. Chmn. Fritz therefore moved to continue the item, returning
that section to the subcommittee.
Public hearing opened 8:05 p.m.
Mrs. A.G. Isgreen, 726 Prospect Avenue, reported that the Chief has said that the fire
rescue unit is misleading to the citizens as it resembles a paramedic unit; and that
there is money in the budget to implement the Emergency Medical Services program.
Public hearing closed 8:07 p.m.
Chmn. Fritz ordered that the Emergency Medical Services section return to the sub-
committee, and requested copies of the Citizen Participation section for the next
meeting.
140 HERMOSA AVENUE
Request by owner William D. Sowers and applicant Pat Brown for permission to move a
single family house to 140 Hermosa Avenue.
Mr. Mer reviewed the pertinent section of the city code (Section 7.2.6 of the
Building section), a report from Mr. Bosnak of the Building Department, communications
from other city officials, the floor plans, and staff recommendations. He said the
applicant's primary concern at this time is that if in fact the site later becomes
residential, he wants to go through ;the Coastal Zone Commission now; but that the
Planning Commission should in no way prejudge the proposed zone change, and that if
the zone is changed, the conditions of that zone must be met. He said the applicant
would have to meet the setback and lot coverage requirements. He said there is no
contiguous ownership of this and the adjacent lot.

Dennis Sowers, 204 Strand, Hennosa Beach, representing the owner; and Pat Brown,
200 Pier Avenue, technical adviser, were present. Mr. Sowers said there is a time
limit to removal of the house and he would need to know by the end of the year, or
at the latest, the beginning of next year. He said they intend to completely
renovate the house and make it a showplace. He said the 611 sideyard encroachment
can be remedied, and that the excessive lot coverage can be remedied by making the
building one: foot shorter where there is new construction. Mr. Brown said the
existing structure is approximately 27 1 and two stories; they will add the garages
making it three levels, but the garages will be recessed as much as is permitted
by the ramp angle, giving an estimated height from the sidewalk of about 28 1

said the · Coastal Conmission will consider the project on a conceptual basis only.
He said he had asked Mr. Bosnak to be present at this meeting.
Mr. Brown review the summary of Mr. Bosnak 1 s memorandum of 8-2-77, page 2, as
follows:
a) he said they intend to completely rehabilitate and renovate the entire structure,
bring it up to, or surpassing, the code;
b) He said the wood lath will be replaced, and that there is more fire blocking
in that building than in newer buildings;
c) He said the rewiring will surpass minimum requirements;
d) He said louvered windows do meet code under certain conditions;
e) He said they will meet the required setbacks;
f) He said the engineering will be done;
g) he said the stairway will be to code;

Conm. Loosli asked if they would be willing to have a deed restriction stating that
it will be used only for single family residence. Mr. Brown agreed to a deed
restruction.
Comm. Schubert said he feels it should be approved as it w·ill fit in if the zone
is changed and since it will be brought up to code in all . respects. Comm. Isgreen
said he is in favor of preserving the older architecture but is concerned about
having an engineering report before it is moved to the lot. Mr. Brown replied
that any state-licensed civil or structural engineer can certify. Chmn. Fritz
said he concurs with Comm. Isgreen in regard to preserving older structures, but
is concerned about feasibility, about the size of the lot in relationship to the
house, the aesthetic factor of its relationship to the two adjacent structures, and
the time factor in rezoning.
Motion by Comm. Schubert, seconded by Comm. Loosli, to reconmend that the City
Council allow the moving of the house to 140 Hennosa Avenue, effective only if
there is a zone change to a residential zone, and subject to the following
conditions:
1. That any approval be contingent on the site having the proper zoning (residential).
The Commission, in approving the move-on conditioned on proper zoning, is in no
way making a commitment or judgement as to the future zoning of the area;
2. That all current Hennosa Beach building codes, plumbing codes, electrical codes,
and housing codes shall be met.
3. That if the property does become residential in zoning, that all requirements
of that zone be met.

4. That a deed restriction on the property will restrict occupancy to that of
a single family dwelling.
This recommendation in no way corrmits the city to a zone change, and the applicant
has agreed to a deed restriction on the house that it will be used only for a
single family residence.

may nevern be accomplished because the zoning may never be changed.

77-41. After holding public hearing, it is felt that the home is an attractive
older home that should be preserved, that it will be brought up to all codes which
exist now or at the time it is moved onto the lot, and that it in no way prejudices
the city in deciding what the zoning should be. The city has a waiver signed by
the owner and applicant signifying their understanding of the obstacles that they
face with this project (to be attached to resolution)~
Comm. Rosenberger said he feels that efforts should be made to limit the amount of
curb cut that will be required, in order to preserve existing spaces as much as
possible, and that costs of parking re-alignment should not be borne totally by
the city.

CONDITIONAL USE PERMIT REVIEWS
1318 Strand --Perry's Pizza --take out food window
Mr. Merl said there have been problems with trash pick-up and with a ground sign;
the owner of the building has now agreed to switch to three pick-ups per week.
Paul Schlapper, 3001 Palm Avenue, Manhattan Beach, said when he realized he could
not use the ground sign, he removed it from the standard and framed it; an employee
put it out front; and it will not be done again.
Mr. Merl rescinded staff recommendation for one month continuation.
Motion by Comm. Rosenberger, seconded by Comm. Schubert, to approve the conditional
use permit for one year . So ordered.

1138 Strand -Juicy Lucy's --take-out food window
Mr. Merl said staff recommends not approving as there are three unapproved signs;
he askef for continuance for one month and if sign application is not made or the
signs removed, staff will request that the Planning Commission set for public
hearing.
With the concurrence of the Planning Commission, Chmn. Fritz continued the item
for two weeks; and if the applicant has not acted by that time, the item will be
scheduled for public hearing. So ordered.
1138 Strand --Louise's Food Cart --outside business
Louise Mariana said she operates on weekends and sometimes during the week. She
said she cleans up the trash every day but there are not enough trash barrels on
the Taco Bill property and the trash spills over into other areas; the cans are
emptied only once per week. Mr. Merl verified that there has been a considerable
problem with trash in that area; that several businesses do not have conditional
use permits; and that some businesses do not increase their trash pick-up during
the summer months.
Motion by Comm. Schubert, seconded by Comm. Rosenberger, to approve the conditional
use permit for one year. So ordered.
2-4 Pier Avenue --Taco Bill's --take-out food window and beer & wine
Mr. Merl said Mr. Grill operates the wi dow only on occasions such as holidays and
weekends; there is also a veer and wine pennit under this review but he serves only
beer.
Motion by Comm. Isgreen, seconded by Comm. Rosenberger, to approve the conditional
use permit for one year. So ordered.
53 Pier Avenue --Casablanca --outside service and beer & wine
Mr. Merl said it is in operation; the new canopy is required by the Health Dept.
Motion by Comm. Rosenberger, seconded by Comm. Schubert, to approve the conditional
use permit for one year. Comm. Loosli said there is a new sign on the bridge.
The second and motion were withdrawn.
Comm. Rosenberger said he is concerned with this development since the walkway is
city property.
With the concurrence of the Planning Commission, Chmn. Fritz continued the item
for two weeks so that staff can check on the sign. So ordered.
316 Pier Avenue -Tsukiji --service of alcoholic beverages
Motion by Comm. Rosenberger, seco ded by Comm. Isgreen, to approve the conditional
use permit for one year. So ordered.
16 -14th Street --La Playita --service of beer & wine
Mr. Merl said Mr. King noted today that there is a sandwich sign; he changed staff's
recorrmendation to continuance for two weeks to have the sign problem corrected.
Motion by Comm. Rosenberger to continue for two weeks. So ordered.

200 Longfellow --Shrimp Pot --outside service
Mr. Merl said there is a trash bin, however the required complete screening usually
is not there; staff requested continuance for two weeks and authorization to write
a letter saying that the screen must be used.
Chmn. Fritz continued the item for two weeks, with authorization to direct a letter
as described. So ordered.
45 -Pacific Coast Highway --Carwell --outside business
Conm. Loosli noted that one condition was that specific parking spaces be designated
for customer parking and signed.
Motion by Comm. Rosenberger to continue for two weeks in order to check the file
and talk to the owner, and then if necessary, request his appearance at the review.
So ordered.
1332 Strand --Everything Yogurt & Salads Too!--take-out food window
Joel Grossfeld, 224 -35th Place, Manhattan Beach, said he is sharing the cost of
a dumpster with two other places of business; the pick-up has recently been increased
to three times per week. He said he has been using a removable projecting sign, and
will apply for sign approval. Mr. Merl said screening is required for the dumpster.
Chmn. Fritz continued for one month so the applicant could confer with the other two
businessmen and with staff about screening the dumpster as required in the conditional
use permit; and apply for sign approval, and see that a trash barrel is placed
on the strand. So ordered.
Chmn. Rosenberger left the meeting.

Motion by Comm. Isgreen, seconded by Conm. Schubert, to approve for one year.

2701 Pacific Coast Highway --Cafe Courtney --outside service and beer & wine
Motion by Conm. Isgreen, seconded by Comm. Schubert, to approve for one year.

22 -Pier Avenue --Flagship --alcoholic beverages
Mr. Merl said no complaints have been received; there has been a trash problem in
this area but it does not appear to be due to this business.
Motion by Comm. Schubert, seconded by Comm. Isgreen, to approve for six months.
So ordered.
Terry Schoo, Flagship, said he has called the city about the trash problem; he
pays for three pick-ups per week; and has requested that the city place the bins
in the alley behind each business that is paying. Chmn. Fritz suggested that
the businesses involved, staff, and BFU meet to try to effect a solution to the
trash problem.

PROPOSED COMBINED LOT ORDINANCE
Mr. Merl said this has been through the Board of Zoning Adjustments. He said the
new state legislation overrules the city ordinance in one important way, i.e.,
that the city no longer has to allow a certain number of units, but rather that
the builder must meet the standards. He said the city may reinstate the provision
concerning the number of units if it chose to.
Chmn. Fritz noted that on page 2, section 4, it states that it is to be published
in the Hermosa Beach Review. Mr. Merl said it should cite the Easy Reader.
Motion by Comm. Loosli, seconded by Comm. Schubert, to recommend to the City
Council the proposed Combined Lot Ordinance.

• Motion by Comm. Loosli, seconded by Comm. Schubert, to adopt Resolution P.C. 77-42,
recommending to the City Council the proposed Combined Lot Ordinance. Public hearing
was held on the new Combined Lot Ordinance to bring city code into conformance with
the new state law. It was felt by the Planning Commission that this new law
calrifies in a positive way the combined lot ordinance, which helps to reduce the
number of substandard lots and end environmental problems caused by small substandard
lots such as air, light, and traffic problems.

CODE REVISION --DEFINITION OF A 11 MAJOR 11 STREET
The Commission discussed the alternatives of using the terms in the circulation
element (arterials and/or collectors); or designating specific streets.
Motion by Comm. Loosli, seconded by Comm. Isgreen, to define major streets for the
purpose of clarification of Article 11.5 of the parking ordinance only as arterial
and collector streets as shown in the Circulation Element of the General Plan.

The Commission then requested that staff prepare an alternatr presentation for the
Parking Ordinance, to appear on the agenda in September, stipulating that there
will be no backing in or out on streets in or adjacent to a Commercial zone.
R-2 REZONING
Motion by Comm. Loosli, seconded by Comm. Schubert, to adopt a Resolution of Intention
No. P.C. 77-43 to hold a public hearing concerning a rezoning from R-2 to R-1,
taking into account the current uses of the property and an apparent conflict
between current zoning and the General Plan designation.

CONDITIONAL USE PERMIT ORDINANCE

Intention No. P.C. 77-44 to send the proposed conditional use permit ordinance
for preparation of the environmental impact report.

ZONING CODE INTERPRETATION
Mr. Merl said the Building Department has requested that the Planning Conmission
clarify the definitions of lot coverage and ground decks, and has made recommenda-
tions per the memorandum of July 21, 1977. They further noted that the sideyard
setback definition is deficient.
The Conmission, after discussion, concurred with the staff recommendations #1 and
#2, but not with #3.

#2. Ground decks versus balconies and regular (or elevated) decks. There has
has been an assumed policy for years that ground decks are flat surfaces
of no more than 12 11 in height above the ground. This relates generally
to the increasing popular practice of putting a low, flat wood or brick
deck area in back or front yards. The one foot limit is assumed to be
based on a height that would not constitute an obstruction for regular
or emergency access. Anything over 1 ft. in height would be considered
an envroachment in any required yard and count as lot coverage.
#3. (The commission did not concur with this recorrmendation)
The Building Dept. has noted that our current sideyard definition is
deficient and unlike those of other cities in that it states that the
required sideyard only extends from the front setback to the rear of
the main building. There is no sideyard requirement beyond that. The
normal definition is that a required sideyard runs from the front setback
to the rear setback.

ENVIRONMENTAL IMPACT ON STREETS
Request for neighboring cities to consider environmental impact of projects in
regard to Prospect Avenue traffic.
Comm. Isgreen said neighboring cities show no interest in the impact of their
developments on Hermosa Beach traffic and streets; he would like the prepared recom-
mendation to go to the City Council and if they concur, to the Coastal Zone Com-
mission. He agreed that Manhattan Beach should be added on page 2.
Motion by Conm. Isgreen to reconmend that the Planning Commission adopt a Resolution
of Intention No. P.C. 77-45 as stated herein, requesting reciprocity from neighboring
cities, to be sent to the City Council and requesting them to sent it or a very
siminar document to the people suggested on page 2, and to the Coastal Zone Com-
mission. So ordered.
STAFF REPORTS
Mr. Merl said the Improvement Commission has requested a joint meeting to discuss
a provision in the R-3 Amendment concerning layout and design to be considered by
the Planning Conmission . It was agreed that Cornn. Loosli, Rosenberger, and
Schubert would form a corrrnittee to meet with the Improvement Commission to discuss
the responsibilities of the Planning Commission in layout and design; e .g.,
interior plans, function, and potential bootlegs.
Mr. Merl will commun i cate with the Improvement Conmission concerning a possible
joint meeting on the i r next regularly scheduled night.
COMMISSIONERS' ITEMS
Comm. Loosli reported that a roller-skate rental business on the Strand has two
hi-fi speakers that broadcast on the beach. Mr. Merl said staff with check.
The Zoning Subcommitee (Comm. Loosli, Peirce, Schubert) will meet at 4:00 p.m.
on August 22nd.
The Development Subconmittee (Conm. Bishop, Isgreen, Rosenberger) will met at
6:30 p.m. on August 22nd.
Cornn. Schubert said he will not be present at the August 22nd meeting.
