ROLL CJ\LL: Present: PETI1'ION OF E. C. CRAY Absent: Comm. Black, Haneman, Viault; Chairman Dennie, and M~.yor Edwards Comm. Fisher and Miller Petition ot E. c. Cray, covering Lot 7, BLock 5, Hermosa Beach Tract, situated at the corner of 5th ~treet and Strand, requesting permission to construct a garage to extend 21 into the 3' 5ideyard on the 5th Street side of the property, in an R-4 zone. Mr. Robert Ziccaro, the contractor, was present and eJCplained that the requested l I set-_baak would sti.1.1 be .further back f'rom the pro-perty line than most of the existing structure~ on 5th street. Gomm. ViauJ.t mentioned that there were several points on the plans that needed checking before this proposed building could be erected. Building Inspector~ Bud Trott explained that the plana would be checked after the variance ~aa acted upon, and that these points would then be considered and dealt with. R. P. Ha5k1ns, 502 Strand, mentioned a balcony whtch is proposed to overhang into the sideyard set-back. Re was not in ravor of this construction~ but Chairman Dennie informed him that the ConLmi5sion was acting only upon the request in the variance. Mr. Haskins was not opposed to that request. Mayor Edwards moved the granting 0£ this petition, because it will conform with existing structures on 5th Street. The motion was secon-ded by Comm. Wilson ts now requesting a renewal o:f the variance granted the former owner of the property, which ts 10', and in addition is reque~ting s 11 ~ideyard set-back on 28th Street. There was a written prote~t received from John and lulthryn Steel. ovnera or Lot 46, Blook 1, Shakespeare Beach Tract. Other prote.1te were rec et ved orally .from Seymour Wagner., 120-2bth Street, and Mrs. L. H. Staples, 1401 Hermosa Avenue. CoDDT,. Black moved that the request ror a lO' front yard set-back on Hemosa Avenue be g~anted, and that the l' side yard set-back on 28th St~eet be denied. The reasons are that the 101 front 3ard is in conformity with the proposed front-yard requirements map being con81dered at the presentp but the l' stdeyard set-back wo'Wi not conform to existing structures in the block or area. Fisher e.nd Mlller PETITION 011 Z .. D. HERMAN Petition of Z. D. Herman, covering Lot 17j, Waiter Ransom Co1a Redondo Home Tract, requesting permission to con~truct a garage within 1• of the 19th Street side of the propeI"ty, and requesting an 18" eave extension into the stdeyard. Thi~ property is situated at the corner of Prospect and 19th S~reet in an R-2 zone. A letter or protest was received from Mrs. Eisie B. Snow, owner or Lot 17 and N ¼ of ~ot 18, Tract No. 1965; A letter or prote~t also was received lrom Mr~. Gertrude Miller. owner or LOt 178, Walter R~nsom Co's Redondo Home Tract. Other protests were received from some.who thought the garage might be intended for commercial uaage, but when Chairman Dennie inf'ormed them that no garage could be built without being built along with a residenoe, those protests were withdrawn. Comm. V!ault moved that the request for the l' ~ideyard set-back be g~anted, provided that no portion or the garage or garage door extend pRst the 19th Street property line, the reason being that this would permit the petittoner to enjoy the use of a 2-car garage opening oft 19th Street. He also moved that the 1&11 eave on the community pro-perty side next to Lot 178 be reduced to 6° eaveB, but that the Planning Commission grant the 1811 eave exteneion on the 19th Street side of the property. The :r•eason f'or refu1:,ing the 1811 eave on the community property aide is because it vouJ.d obstruct light, air and ventilation for the adjoining property ouner. Fisher and Miller Petition of John and Sara ~nited, covering Lot 15, Tract ffo. 16~15, situated a~ 2550 Ardmore Avenue, requesting permis~ton to divide this large, triangularly-shaped lot into two lots, each having 4,000 square reet. The lot is zoned R-2 at present. Mr. Whited waa present and informed the Commission that the ~ize or this lot made 1t unsuitable ror the R-1 zoning which is proposed, and that he wlshed to divide it now into 2 lots, either for tuture butldtng or selling.' Oral p~otests were recetved fr011l the following property owners: Frank Russ, 628 Gould Avenue Florence McMutnn. 2530 Ardmore Mr. Stover All or the above property owner& protested on the grounds that they did not t'eel this point was eu1table f'or a re.sidence, and that it woUld ma~e a blind corner at Ardmore and Gould. Comm. Black moved the denial of this petition, for the reason that the zoning ordinance calls for a m!n!mum of 5,000 square feet per lot. The mo~1on was seconded by Comm. Viaul.t, and Resolution No. PC 67 vaa adopted by the following vote: AYES: BOES: ASSEN~: PETITION OF MARIE MORSE Comm. Black, Haneman, Viault and Chairman Dennie Ma.yoi-Edwards Comm. Fisher and Miller Petition of Marie Morse, covering Lot l, B~ock 25, Hermosa Beach Tract. situated at 2400 Strand, requesting permission to reconstruct or remodel existing guest quarters above a double garage. extenaing new structure to lot line on 24th Street s1d6, and constructing an open stairwa~ to sideline~ also. Mrs. Morse was present and as1d that she felt most of the neighbors we:re in favor or the proposed improvements. A letter o~ protest was received rrom Mr. Wolfort, owner or Lot 5, Block 29, Hermosa Beach Tract. Comm. Haneman asked whether or not the unit was to be a complete dwelling unit or guest quarters, only. Chairman Dennie informed him that the Ordinance controls the number of units a1lowed in a zone, and that the Commission could not say whether or not it should be guest quarters onl7 or a comp1ete unit. Mayor Edwards moved the granting of this petition, for the reasons that it will resUl.t in the addition of a garange and will be an im-provement to the surrounding neighborhood. Fisher and Miller PE'l'ITtON OF F.AROLD WtLSON Petition of Harold Wilaon, covering Lots J.47 and ll!-8, Walter Ransom Co's Redondo Home Tract, situated atl228-20th Street, requesting permission to build to within 101 or his rront yard property line on 20th Street. After brief discussion, Comm. Haneman moved the granting of this petition, ror the reason that the proposed Front Yard Requirements map allows a 101 front yard set-back on this block, and this 8et-back would conform to the surrounding block. The motion wa~ seconded by Comm. Black, and Resolution No. PC 69 t-1as adopted by the f'ollow1ng vote, AYES: Comm. Black, Hsneman, ViauJ.t, Chairman Dennie and Ma yor Edwards NOES: None ABSENT: Comm. Fisher and Miller PETITION OF pET'l'Y BAI.:I:MUJ Petition or BeZty Baldwin, covering Lot 5., Block 105,, Shaket:.peare Tract, ~1 tuated at 3002 Hermosa Avenue, requesting pe.rm1osio11 to extend the fireplace 1211 into Biideyard., instead of 611 allowed by Ordinance. Both the contractor and M1ss Baldwin were pre5ent, and they informed the Commission that, by an error or the mason contractor, the fire-place had been so erected., and that it would be most costly to tea!' 1t down and rebuild it. They both said they had absolutely no knowledge or the error until it was already done. After fuFther discussion., Comm. Black moved the granting of this variance., because he .t'el•i:; 1t was an honest mistake, and wou.ld work a hardship on the petitioner if' lt had to be torn down and rebuilt. Mrs. Farmer was present and 1n.fo~med the Commission that the owner ot the propert7 to the north other property was in the Army and not available tor a signature, but the south property owner had a1gned the petition. After brief diacusaion, Comm. Viau.lt moved the dental of this petition; on the grounds that he did not feel this was a hardship. He suggested the garage could be built on the rear of the lot. Mrs. Fa1"iller stated that they were planning an addition to their home., and this ~ould not leave room enough .for a garage in the rear. The motion wa~ seconded by Comm. Mr. Chav1z was present and explained that there just waa not enough room to build on the 5th Street side of the property, and he needed all the ava1lble space in which to build. Comm. Vis.ult moved the denial of ·this petltion on the gi,ounds that.r it does not involve a hardship and that the Commission would be granting a pri v1.lege to one property ot,mer not be1ng granted to othe1· in the immediate neighborhood, 1.f this were granted. The present a·truccure extend8 across the common lot line, the~eby lllElking one lot: zoned R-2. After brief discussion, Comm. Viault suggested to Mr. Ulrich that he valt 6ntil the proposed zoning ol'dinance and land use map are acted upon, because the said property ls proposed as R-3 at tlllit time, and 'he will not need a va:<>ian.ce. Comm. V1au.J.t al1:>o moved the denial or this petition, because the Commission cannot approve ot spot zoning, and this should be handled as a zone change. Coni.m. Pet1t1one~ requests permiseion to construct or remodel existing ~tructure to the property line on the 34th Plaae side or his propert1, the lot being zoned R-l. Mr. Miles was present and explained that his plans are either to conver~ an old unit into a double garage and build above it or to tear the old structure down and erect a new garage and unit above. There gas some question conoern1ng the amount of space being lert between garage and house. Mr. Miles indicated in a note attached to the petition that be wi~hed approval of the plan the Commission felt was most eu1 table, there.fore., this part1cula.r point had. to be acted upon at tbia time. Comm. Planning Commission Page Seven April 9, 1956 Petition of Frederick McCaull, Jr., covering Lot 4, Block 64# First -Addition to Hermosa Beach, situated at 2240 Monterey Blvd., reque5ting permission to construct 2 unit~, in addition to the existing dwelling. There weiae 2 letters received, both in favor or the granting or thl~ petition. ?he letters were from: L. c. Hewitt, Louise T. Ra1fe. Mr. and Mrs. McCaull vere present; and Mr. McCaull explained that because or the large size or this lot., he would J.ike to be able to erect 2 units~ He said most of the surrou..nding property owners had extra units on their property, also. M~. Phil Blackford and Mra. Blaaktord both objected to the granting ot this petition, saying they felt there should be no more than 2 units per lot in this area. Comm. Black moved the denial of thiB petition because this ls con~ s1de?'ed spot zoning and the Commission has no au.b,hority to grant this petition. It should be handled has a zone change.
