RES-26-7559 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH, CALIFORNIA, ADOPTING REGULATIONS FOR CANDIDATES FOR ELECTIVE OFFICE PERTAINING TO CANDIDATE’S STATEMENTS SUBMITTED TO THE VOTERS AT AN ELECTION TO BE HELD ON TUESDAY, NOVEMBER 3, 2026 WHEREAS, California Elections Code (“Elections Code”) section 13307 authorizes the governing body of a local agency to adopt regulations pertaining to materials prepared by candidates for a municipal election, including the costs associated with candidate statements; and WHEREAS, a General Municipal Election for the City of Hermosa Beach ("City") shall be held on November 3, 2026, for the election of members of the City Council; and WHEREAS, the City Council desires to establish regulations governing candidate statements for the election and to allocate the costs associated therewith in accordance with Elections Code section 13307. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE, AND ORDER AS FOLLOWS: SECTION 1. Incorporation of Recitals. The recitals above are true and correct, and are hereby incorporated herein by reference. SECTION 2. Candidate Statements. Each candidate for elective office to be voted for at the election to be held in the City on November 3, 2026, may prepare a candidate’s statement on an appropriate form provided by the City Clerk pursuant to Elections Code section 13307. a. The statement may include the name, age, and occupation of the candidate; and a brief description of no more than two hundred (200) words of the candidate’s education and qualifications expressed by the candidate personally. The statement shall be filed in the form required by the City Clerk at the time the candidate’s nomination papers are filed. c. The statement may be withdrawn, but not changed, during the period for filing nomination papers and until 5:00 p.m. of the next working day after the close of the nomination period. SECTION 3. Foreign Language Policy. Candidate’s statements will be translated into all languages required by the County of Los Angeles (“County”) pursuant to Section 203 of the Federal Voting Rights Act of 1965 as amended (Section 10503 to Title 52 of the U.S. Code). The County will print and mail voter information guides and candidate’s statements to all voters in English. The County will mail separate voter information guides and candidate’s statements in the required languages to only those voters who are on the County voter file as having requested a voter information guide in a particular language. The County will make the voter information guides and candidate’s statements in the required languages available at all vote centers, on the County’s website, and in the Elections Official’s office. SECTION 4. Payment a. Translation Costs. The candidate [shall] [shall not] be required to pay the cost of translating the candidate’s statement into any language that is not required pursuant to federal or state law but is requested by the candidate. b. Printing Costs. The candidate shall be required to pay for the cost of printing the candidates statement the candidate’s statement in English in the main voter pamphlet. The candidate shall be required to pay for the cost of printing the candidate’s statement in a foreign language required in the (1) main voter pamphlet and (2) facsimile voter pamphlet. The City Clerk shall estimate the total cost of preparing, printing, handling, translating, and mailing candidate statements filed pursuant to this section, including costs incurred to comply with the Federal Voting Rights Act of 1965 as amended; and shall require each candidate filing a statement to pay the candidate's estimated pro rata share in advance to the City as a condition of having the candidate's statement included in the voter information guide. (1) The estimate is an approximation of actual costs and may vary depending on the number of candidates filing statements and other election- related factors. Accordingly, the City Clerk may (on a pro rata basis) bill each candidate for additional actual costs incurred or refund any excess amount paid based on the final actual cost of preparing, printing, handling, translating, and mailing candidate statements. (2) If the estimated payment is insufficient, the candidate shall pay the balance due upon notice from the City Clerk. If the estimated payment exceeds the actual cost, the City Clerk shall refund the excess amount on a pro rata basis within thirty (30) days after final actual costs have been determined. SECTION 5. Administration. All translations shall be provided by professionally certified translators. The City Clerk shall allow bold type, underlining, capitalization, indentations, bullets, and leading hyphens to the same extent and manner as allowed in previous City elections. The City Clerk shall also comply with all recommendations and standards set forth by the California Secretary of State regarding occupational designations and other matters relating to elections. SECTION 6. Additional Materials. No candidate will be permitted to include additional materials in the voter information guide. The City Clerk shall provide each candidate or the candidate's representative with a copy of this Resolution at the time nominating petitions are issued. SECTION 8. Repeal of Prior Policies. All previous resolutions establishing City Council policy on payment for candidate statements are repealed. SECTION 9. Applicability. This Resolution shall apply only to the General Municipal Election to be held on November 3, 2026. SECTION 10. Certification. The City Clerk shall certify to the passage and adoption of this Resolution; cause the same to be entered among the original resolutions of the City; and make a minute of the passage and adoption thereof in the records of the proceedings of the City Council. SECTION 11. Effective Date. This Resolution shall take effect immediately upon its adoption. PASSED, APPROVED, and ADOPTED on this 23rd day of June 2026.
