HomeMy WebLinkAboutRES-26-7562 (DELINQUENT REFUSE CHARGES) Page 1 of 4 RES-26-7562 CITY OF HERMOSA BEACH RESOLUTION NO.RES-26-7562 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH, CALIFORNIA, CONFIRMING DELINQUENT REFUSE COLLECTION CHARGES AND AUTHORIZING THE COUNTY ASSESSOR TO COLLECT SUCH CHARGES AS SPECIAL ASSESSMENTS ON THE LOS ANGELES COUNTY PROPERTY TAX ROLL WHEREAS, the City of Hermosa Beach (“City”) possesses the authority to provide for the collection and disposal of solid waste and to establish procedures for the collection of charges associated with such services pursuant to its police powers under the California Constitution (Section 7 of Article XI), California Government Code section 38790.1, and Hermosa Beach Municipal Code (“HBMC”); and WHEREAS, Government Code section 38790.1 authorizes cities to collect delinquent refuse collection charges by placing such charges on the property tax roll as special assessments to be collected at the same time and in the same manner as County of Los Angeles (“County”) taxes; and WHEREAS, the City Council adopted Ordinance No. 86-840 on June 24, 1986, establishing procedures for the collection of delinquent refuse collection charges and authorizing the placement of unpaid refuse charges, penalties, and collection costs on the property tax roll as special assessments; and WHEREAS, the City entered into an exclusive franchise agreement with Arakelian Enterprises, Inc., dba Athens Services (“Athens”) effective July 1, 2013, for the collection and disposal of solid waste within the City; and WHEREAS, Athens provided City a list of properties containing delinquent refuse collection charges that remained unpaid as of March 31, 2026, as set forth in Exhibit A (attached hereto and incorporated herein by reference); and WHEREAS, notices were mailed on April 19, 2026 and May 28, 2026 to affected property owners advising them of the delinquent charges, and providing an opportunity to appear before the Administrative Appeals Board (“AAB”) pursuant to HBMC section 8.12.360(A)(5); and Docusign Envelope ID: C8AA9A03-DE38-8F7E-81D8-C247A8A6F6B1 Page 2 of 4 RES-26-7562 WHEREAS, AAB conducted a hearing on June 10, 2026, reviewed the delinquent charges, considered any objections presented, and recommended that the remaining unpaid charges be submitted to the City Council for consideration as special assessments; and WHEREAS, the City Council conducted a duly noticed public hearing on June 23, 2026, at which all interested persons were provided an opportunity to be heard regarding the proposed assessments; and WHEREAS, the City Council has determined that the delinquent refuse collection charges identified in Exhibit A remain valid and unpaid and should be collected as special assessments in accordance with applicable law. NOW, THEREFORE, THE CITY COUNCIL DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. Incorporation of Recitals. The recitals above are true and correct, and are hereby incorporated herein by reference. SECTION 2. Findings. The City Council hereby finds and declares as follows: a. The City has complied with the procedures set forth in Government Code section 38790.1, Ordinance No. 86-840, and HBMC section 8.12.360 regarding notice, hearing, and review of delinquent refuse collection charges. b. Property owners were provided notice of the delinquent charges and afforded an opportunity to appear before both the AAB and the City Council. c. The delinquent refuse collection charges identified in Exhibit A are valid charges lawfully incurred for refuse collection services provided to the affected properties. d. Collection of such charges through the property tax roll is authorized by Government Code section 38790.1, Ordinance No. 86-840, and the HBMC. SECTION 3. Confirmation of Delinquent Charges. The City Council hereby confirms the delinquent refuse collection charges identified in Exhibit A following consideration of the recommendation of the AAB and testimony received during the public hearing. Each delinquent refuse bill shall be increased by an amount not to exceed the actual costs incurred by the County and charged to the City for placing the delinquent refuse charges on the property tax roll as a special assessment. SECTION 5. Administrative Costs. Each delinquent refuse bill shall be increased by fourteen dollars ($14) to compensate the City for administrative costs incurred in collecting delinquent refuse charges through the special assessment process. SECTION 6. Transmittal to County Assessor. The City Manager, or designee, is authorized and directed to transmit Exhibit A to the County Assessor for placement on the property tax roll as a special assessment to be collected at the same time and in the same manner as county taxes. SECTION 7. Modification of Exhibit A. Exhibit A may be modified by the City Manager or designee to remove any parcel for which all delinquent refuse collection charges, penalties, and applicable costs are paid within ten (10) days following the City Council hearing consistent with Ordinance No. 86-840 and HBMC section 8.12.360. SECTION 8. California Environmental Quality Act (“CEQA”). The City Council finds that this action is not a project pursuant to CEQA Guidelines sections 15378(b)(4) and (5) because it constitutes a governmental fiscal and administrative activity that will not result in a direct or indirect physical change in the environment. SECTION 9. Severability. If any section or provision of this Resolution is for any reason held to be invalid or unconstitutional by any court of competent jurisdiction, or contravened by reason of any preemptive legislation, the remaining sections and/or provisions of this Resolution shall remain valid. The City Council hereby declares that it would have adopted this Resolution, and each section or provision thereof, regardless of the fact that any one or more section(s) or provision(s) may be declared invalid or unconstitutional or contravened via legislation. SECTION 10. Certification. The City Clerk shall certify to the passage and adoption of this Resolution; cause the same to be entered among the original resolutions of the City Council; and make a minute of the passage and adoption thereof in the records of the proceedings of the City Council in the minutes of the meeting at which time same is passed and adopted.
