RESOLUTION NO. RES-26-7564
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HERMOSA
BEACH, CALIFORNIA, CONFIRMING THE FISCAL YEAR 2026-2027 SEWER
SERVICE CHARGES AND AUTHORIZING THEIR COLLECTION ON THE LOS
ANGELES COUNTY PROPERTY TAX ROLL
WHEREAS, California Health and Safety Code (“HSC”) sections 5470 through
5473.11 authorize the City of Hermosa Beach (“City”) to collect sewer service
charges on the Los Angeles County (“County”) tax roll in the same manner as
property taxes; and
WHEREAS, Chapter 13.12 to Title 13 of the Hermosa Beach Municipal Code
(“HBMC”) establishes sewer service charges to fund the operation, maintenance,
servicing, improvements, and reserves of the City’s sewer collection system; and
WHEREAS, HBMC Chapter 13.12 authorizes the annual collection of sewer
service charges on the tax roll; and
WHEREAS, DTA Engineer’s Report for Fiscal Year (“FY”) 2026-2027 dated May
26, 2026 (“DTA Report”), filed with the City Clerk identifies the parcels subject to
the sewer service charge and the amount to be levied against each parcel for
FY 2026-2027; and
WHEREAS, notice of the public hearing was provided on June 4, 2026 and
June 11, 2026, in accordance with applicable law; and
WHEREAS, the City Council conducted a duly noticed public hearing on
June 23, 2026, and considered all testimony and written comments regarding the
proposed collection of sewer service charges on the tax roll.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH,
CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. Incorporation of Recitals. The foregoing recitals are true and
correct, and are incorporated herein by this reference.

SECTION 2. Findings. The City Council finds and determines as follows:
a. The sewer service charges have been established
pursuant to HBMC Chapter 13.12.
b. The revenues generated by the sewer service charges
will be used solely for the operation, maintenance, servicing, improvements, and
reserves of the City’s sewer collection system.
c. The amount levied on each parcel is determined in
accordance with the methodology established in HBMC Chapter 13.12.
d. The amount to be collected on the tax roll is less than the
estimated costs of providing sewer services during FY 2026-2027.
e. The charges identified in the DTA Report constitute sewer
service charges authorized by HSC section 5470 et seq. and HBMC Chapter 13.12.
f. The revenues generated by the sewer service charges
will not exceed the funds required to provide sewer services and related capital
improvements and reserves during FY 2026-2027.
SECTION 3. Collection. The City Council hereby elects to collect the
charges identified in the DTA Report on the property tax roll in the same manner,
by the same persons, and at the same time as (together with and not separately
from) the general taxes of the City. The adoption of this Resolution constitutes the
levy of the charges against parcels of property in the City for the fiscal year
commencing July 1, 2026, and ending June 30, 2027.
SECTION 4. Filing of DTA Report. The City Clerk is hereby authorized and
directed to file a copy of the DTA Report and the list of actual parcel charges (a
listing of the Assessor’s Parcel Numbers and the amount to be levied on each
parcel) with the County Auditor-Controller (together with a certified copy of this
Resolution upon its adoption, in addition to any additional information the County
Auditor-Controller requires to collect the charges with the County taxes) pursuant
to HSC section 5473.4 and HBMC Chapter 13.12 on or before August 10, 2026. The
City Clerk is further authorized to submit any revised parcel listing necessary to
reflect final County Assessor parcel information for FY 2026-2027.

SECTION 5. County Action. The County Auditor-Controller shall enter the
sewer service charges on the County tax roll and such charges shall be collected
in the same manner and at the same time as property taxes.
SECTION 6. Deposit of Revenues. The Finance Director shall deposit all
money representing charges collected by the County to the credit of the City’s
Sewer Fund.
SECTION 7. Certified Copy. A certified copy of this Resolution, a copy of
the DTA Report, and the actual parcel charges (a listing of the Assessor’s Parcel
Numbers and the amount to be levied on each parcel) shall be filed in the office
of the City Clerk and open to public inspection. The parcel listing may be
maintained in electronic format.
SECTION 8. California Environmental Quality Act (“CEQA”). The City
Council finds the following pursuant to the CEQA Guidelines:
a. Section 15378. Adoption of this Resolution is not a
“project” within the meaning of Section 15378 because it constitutes an
administrative and fiscal action authorizing the collection of existing sewer service
charges on the County tax roll and does not authorize or approve any specific
physical change to the environment.
b. Section 15061(b)(3) (Common Sense Exemption). The
action is exempt from CEQA pursuant to Section 15061(b)(3) because it can be
seen with certainty that there is no possibility that adoption of this Resolution may
have a significant effect on the environment.
c. Section 15301 (Class 1 – Existing Facilities). The action is
exempt from CEQA pursuant to Section 15301 because it involves the continued
maintenance, operation, and servicing of existing public facilities used to provide
sewerage services and related improvements with no expansion of existing use.
d. Section 15300.2 (Exceptions). None of the exceptions set
forth in Section 15300.2 apply.

SECTION 9. Severability. If any section or provision of this Resolution is held
invalid or unconstitutional by a court of competent jurisdiction, the remaining
provisions shall remain in full force and effect.
SECTION 10. Certification. The City Clerk shall certify to the adoption of this
Resolution and cause it to be entered into the official records of the City.
SECTION 11. Effective Date. This Resolution shall take effect immediately
upon adoption.
