ORD-26-1501 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH, CALIFORNIA, AMENDING SECTION 12.30 OF TITLE 12 OF THE HERMOSA BEACH MUNICIPAL CODE TO AMEND POLICIES AND FEES RELATED TO SPECIAL EVENTS ON PUBLIC PROPERTY AND DETERMINING THE ORDINANCE IS NOT A PROJECT UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT WHEREAS, the City of Hermosa Beach (“City”) is authorized to regulate special events and establish fees for such events by resolution pursuant to the California Constitution (Section 7 to Article XI, and Section 1 to Article XIII); and WHEREAS, the City defines and regulates “special events” conducted on public property (including the beach) pursuant to Chapter 12.30 (Special Events on Public Property) to Title 12 (Street, Sidewalks and Public Places) of the Hermosa Beach Municipal Code (“HBMC”); and WHEREAS, any person organizing or conducting a special event on public property (including the beach) is required to obtain a City permit pursuant to HMBC Section 12.30.010 (Special event regulations generally). Permit application requirements are defined in HBMC Section 12.30.020 (Special event application required), and permit requirements and review procedures are further defined in HBMC Section 12.30.030 (Special event approval and permit issuance). The City’s Special Events Policy Guide provides additional guidelines and operational requirements for special events; and WHEREAS, City staff conducted a comprehensive review of the City’s Special Events Policy Guide, HBMC Chapter 12.30, and associated fee structure to identify potential policy modifications and fee updates to improve clarity, consistency, administrative efficiency, and cost recovery to support the continued delivery of high-quality community events while more effectively managing public resources; and WHEREAS, at its April 16, 2026 meeting, the Parks and Recreation Advisory Commission (“Commission”) reviewed staff’s recommended updates and Docusign Envelope ID: 24287A98-5124-8AD7-82EA-29C4BC809CF4 Page 2 of 3 ORD. 26-1501 amendments to the applicable provisions of the City’s Special Events Policy Guide, HBMC Chapter 12.30, and associated fee structure and recommended Council approval of the updates and amendments; and WHEREAS, at its May 26, 2026 meeting, the City Council (“Council”) approved the Commission’s recommendation to amend the applicable provisions of the City’s Special Events Policy Guide, HBMC Chapter 12.30, and associated fee structure, and directed staff to prepare such amendments; and WHEREAS, the Council held a duly noticed public hearing and conducted first reading of this Ordinance at a regular meeting on June 9, 2026, and received written and oral testimony regarding the proposed code amendments; and WHEREAS, the Council desires to amend HBMC Sections 12.30.010 and 12.30.030 consistent with updates to the Special Event Policy Guide and associated fees related to special event permits. THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Incorporation of Recitals. The recitals above are true and correct, and are hereby incorporated herein by this reference. SECTION 2. Amendments. HBMC Section 12.30.010 and Section 12.30.030 are amended as set forth in Exhibit “A”, attached hereto and incorporated herein by reference. SECTION 3. California Environmental Quality Act (“CEQA”). This Ordinance is not a project under the California Environmental Quality Act pursuant to CEQA Guidelines section 15378 (b)(5) as it is an organization or administrative activity of the City that will not result in direct or indirect physical changes in the environment. SECTION 4. Severability. If any provision of this Ordinance or its application to any person or circumstance is held to be invalid, such invalidity has no effect on the other provisions or applications of the Ordinance that can be given effect without the invalid provision or application; and to this extent, the provisions of this Ordinance are severable. The Council declares that it would have adopted this Ordinance irrespective of the invalidity of any portion thereof. The City Clerk is directed to certify the passage and adoption of this Ordinance; cause it to be entered into the City’s book of original ordinances; make a note of the passage and adoption in the records of this meeting; and, within fifteen (15) days after the passage and adoption of this Ordinance, cause it to be published or posted in accordance with California law. SECTION 6. Effective Date. This Ordinance shall take effect thirty (30) days following adoption by the City Council. PASSED, APPROVED, and ADOPTED on this 23rd day of June 2026. D.To balance coastal access with beach special events, the city council shall establish peak season event limits for city-wide events, the beach/Pier Plaza up to a maximum number of days used by events between the Saturday preceding Memorial Day through Labor Day. 2.Section of 12.30.030(B) (Special event approval and permit issuance) of Chapter 12.30 (Special Events on Public Property) of the Hermosa Beach Municipal Code is hereby amended to read as follows, in its entirety, with deletions shown in strikethrough and additions shown in bold italics: 12.30.030 Special event approval and permit issuance. B.Special events applications must be submitted as follows: 1.New events: If the new event is an Impact Level I or II, Applications must be submitted at least ninety (90) days in advance of the event, regardless of Impact Level. If the new event is an Impact Level III, must be submitted no later than July 30 for the following calendar year. 2.All returning events must be submitted no later than July 31 for the following calendar year. Level III events: must be submitted no later than July 30th for the following calendar year. 3.Returning Level II events: must be submitted at least ninety (90) days prior to the event. 4.Returning Level I events: must be submitted at least thirty (30) days prior to the event. 3.Section of 12.30.030(E) (Special event approval and permit issuance) of Chapter 12.30 (Special Events on Public Property) of the Hermosa Beach Municipal Code is hereby amended to read as follows, in its entirety, with deletions shown in strikethrough and additions shown in bold italics: 12.30.030 Special event approval and permit issuance.
