RESOLUTION NO. RES-26-7565
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HERMOSA
BEACH, CALIFORNIA, AMENDING THE CITY’S PARKING VIOLATION BAIL
SCHEDULE
WHEREAS, California Vehicle Code (“CVC”) section 40203.5 authorizes the
City of Hermosa Beach (“City”) to establish parking penalties for parking violations
and late payment penalties; and
WHEREAS, the City has adopted a Parking Violation Bail Schedule pursuant
to CVC section 40203.5; and
WHEREAS, the City Council adopted Resolution No. RES-25-7520 dated
September 9, 2025, which updated the Parking Violation Bail Schedule as required
by Senate Bill 857; and
WHEREAS, the City Council now desires to update the Parking Violation Bail
Schedule to reflect market rate parking citation penalties, consistent with
surrounding local jurisdictions and coastal cities; and
WHEREAS, the parking penalties for parking violations and late payment
penalties established by this Resolution comply in all respects with the
requirements of California Vehicle Code Sections 40200 to 40230 inclusive, and
other applicable law and are necessary for the protection of the public health,
safety, interest, and general welfare of the City’s residents and visitors; and
WHEREAS, the City Council has reviewed parking citation penalties in
comparable Southern California jurisdictions and finds that the citation amounts
adopted herein remain generally consistent with regional parking enforcement
practices; and
WHEREAS, the City Council finds that parking citation penalties and
delinquency penalties serve important public purposes by promoting compliance
with parking regulations, ensuring public safety, encouraging turnover of limited
parking resources, preserving emergency access, protecting pedestrians, and

assisting in recovery of administrative and enforcement costs associated with the
City's parking enforcement program.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH,
CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. Incorporation of Recitals. The recitals above are true and
correct, and are hereby incorporated herein by reference.
SECTION 2. Findings. The City Council hereby finds as follows:
a. Public Purpose. The Parking Violation Bail Schedule
serves a valid public purpose by encouraging compliance with parking
regulations, protecting public safety, promoting turnover of public parking
spaces, preserving access for residents, visitors, businesses, emergency
responders, and persons with disabilities, and supporting the orderly use of public
rights-of-way and parking facilities.
b. Reasonableness of Penalties. The penalties established
by the Parking Violation Bail Schedule are reasonable, proportionate, and
consistent with CVC section 40203.5; and reflect consideration of comparable
citation amounts imposed by neighboring jurisdictions and coastal cities.
c. Fiscal and Administrative Considerations. The penalties
established herein assist the City in recovering a portion of the costs associated
with parking enforcement, citation processing, administrative review, collection
efforts, and related municipal services, while promoting timely compliance with
applicable parking regulations.
d. Legal Compliance. The Parking Violation Bail Schedule
complies with California Vehicle Code Sections 40200 through 40230, inclusive,
and all other applicable provisions of law.
SECTION 3. Adoption. The City Council adopts the Parking Violation Bail
Schedule as set forth in Exhibit A, attached hereto and incorporated herein by
this reference.

SECTION 4. Adjustment. The Parking Violation Bail Schedule includes
surcharges imposed by the Federal, state, and county governments. The City
Manager is hereby authorized to adjust future parking citation rates (on a one-to-
one basis) to reflect increases in any dollar or percentage surcharge imposed on
parking citations by Federal, state or county government.
SECTION 5. California Environmental Quality Act (“CEQA”). The City
Council finds that adoption of this Resolution is exempt from CEQA pursuant to
CEQA Guidelines section 15061(b)(3) because it can be seen with certainty that
adoption of the Parking Violation Bail Schedule will not result in a direct or
reasonably foreseeable indirect physical change in the environment.
SECTION 6. Severability. If any section or provision of this Resolution is for
any reason held to be invalid or unconstitutional by any court of competent
jurisdiction, or contravened by reason of any preemptive legislation, the
remaining sections and/or provisions of this Resolution shall remain valid. The City
Council declares that it would have adopted this Resolution, and each section or
provision thereof, regardless of the fact that any one or more section(s) or
provision(s) may be declared invalid or unconstitutional or contravened via
legislation.
SECTION 7. Certification. The City Clerk shall certify to the passage and
adoption of this Resolution; cause the same to be entered among the original
resolutions of the City; and make a minute of the passage and adoption thereof
in the records of the proceedings of the City Council in the minutes of the meeting
at which time same is passed and adopted.
SECTION 8. Effective Date. This Resolution is effective immediately upon
adoption.
