HELD IN THE COUNCIL CHAMBERS, CITY HALL, HERMOSA BEACH, ON
MONDAY, MAY 18, 1970, AT 7:30 P. M.
MEETING CALLED TO ORDER AT 7:45 P. M. BY CHAIRMAN NOBLE.
ROLL CALL - Present: Comm. Collis, Himmel, Mulfinger, Stabler, Toole,
Watters, and Chairman Noble.
Absent: None
Motion by Stabler, seconded by Comm. Mulfinger to approve the minutes as
amended, changing the word "conception" to "concept" and the word "residen-
tial" to "development", both located in line 6 of Committee Reports on page 3.
Request of Paul E. Williams for a Conditional Use Permit
City Planner Crawford presented a floor plan of the building located at 316 Pier
Avenue and said that Mr. Paul E. Williams had a two -fold request: to obtain
a Conditional Use Permit to serve beer in his eating establishment, and a Con-
ditional Use Permit to have entertainment in the form of silent pictures. Dur-
ing the presentation of the staff report and the required considerations, he men-
tioned that there was an existing lack of off-street parking and the possibility
of providing entertainment might overload on -street parking. The Police Chief
suggested that if the request is granted, that alcoholic beverages be sold only
with food and that the applicants be required to request a conditional beer license.
Mr. Crawford indicated that it was highly probable that this could be the start of
similar requests on this part of Pier Avenue. He also felt that the showing of
movies would not be a wise thing in that the entertainment would seem to appeal
more to a drinking crowd than an eating crowd.
Public Hearing opened: 7:53 p. m.
Mr. John Power, 1163 - 7th Place, Hermosa Beach, spoke in favor of granting
the Conditional Use Permits. He said the building had won the Mayor's beauti-
fication award, and it was only as an impetus to attract more dining customers
that the proprietor wished to add the two new features, because the lack of people
passing by and the nature of the business had made it difficult to attract customers.
Mr. Paul Williams, 2205 Voohrees, Redondo Beach, proprietor of the business,
explained the proposed operation, that there would be no bar and said that the
movies will be silent films such as Charlie Chaplin and Laurel and Hardy.
Mr. Crawford mentioned that the application indicated a closing time of 11:00
p. m. on Friday and Saturdays, while the business license had been issued for
10:00 p. m. Mr. Williams indicated that he would abide by the business license,
but felt that some late dining might be desirable.

Comm. Stabler questioned whether the light intensity would not be too high to
show films and Mr. Williams assured him it was not, that only a few lights would
have to be turned off.
Comm. Watters asked what proportion was take-out business and Mr. Williams
estimated 32 to 50% in the evenings, none in the day time. More questions were
directed to Mr. Williams concerning promotion of the movies, the duration of the
film, how often they will be changed, total seating capacity of the restaurant,
the type of customer his business attracts, and how many people were served in
the peak period of the day.
Chairman Noble said that he would abstain from voting because he owned the
building, but that he felt serving beer with the dispensing of food in this case
would be satisfactory, although he was generally opposed to beer bars.
Public Hearing closed: 8:16 p. m.
Motion by Comm. Toole to grant the Conditional Use Permits to serve beer with
food and show movies subject to conditions as reflected in the following Resolu-
tion.
AYES: Comm. Collis, Himmel, Stabler, Toole, Watters.
NOES: Comm. Mulfinger
ABSTAIN: Chairman Noble.

Resolution No. 154-772
Resolution to grant a Conditional Use Permit to Paul E. Williams as lessee
for Captain Jim's Cafe, 316 Pier Avenue, allowing the sale of beer and the
showing of movies based upon the following factors:
That the request as subject to the below conditions meets the requirements of
Section 1404 of the City Zoning Ordinance in that by the granting of this Condi-
tional Use Permit no special disservice is done to the surrounding properties; no
one objected to the proposal during the public hearing or by written testimony;
the requested uses will allow the applicant additional sources of income to stab-
ilize the business.
The permit shall be subject to the following conditions:

1. That no bar is established.
2. That alcoholic beverages be sold only with food.
3. That the alcoholic beverage license reflect that the condition 2, above
is part of that license.
4. That the hours of operation be limited to those as shown in the business
license except that this may be increased to 11:00 P. M. on Fridays and
Saturdays if the same allowances are made in the business permit.
5. That there be no obscuring of the front windows.
6. That the Conditional Use Permit be for a period of six months, at the
end of which time, it shall be reviewed by the Commission.

ABSENT: None
Comm. Collis expressed concern that the Commission was establishing a prece-
dent by allowing the Conditional Use Permits for beer and entertainment, and
City Planner Crawford suggested that he make an analysis of all previous Condi-
tional Use Permits for liquor to compare requests and decisions and then the Com-
mission could design a policy for future decisions.
Report of Zoning Committee
(a) Comm. Stabler reported on their study of the planned development ordinance
to date and said they had had a general discussion of the land use intensity
concept regarding its application to zoning and planned unit development
specifications. He suggested that some members of the City Council meet
with the Zoning Committee at their next meeting, which will be held on May
26, 1970 at 7:30 a. m.
(b) No consideration had been given to the "effectuation" changes until the
Committee had had an opportunity to meet jointly with the City Council.
Report of Development Committee
(a) Comm. Watters said that although they had not met recently, he and Comm.
Toole did meet with Redondo Beach and Manhattan Beach Tri-city Committee
and also planned a meeting for May 28, 1970 at 7:30 p. m.
City Planner Crawford informed the Commission that he had talked with a repre-
sentative of Coldwell-Banker about the downtown development and they are still
actively interested, although they have not as yet found a backer for the anchor
store. He said Mayor Thelen is working on a project of beautifying Pier Avenue,
replacing sidewalk, widening it and landscaping.
There is also progress on Parking Lot A, which will proceed this year with land-
scaping.
The Commissioners discussed the improvement of Pacific Coast Highway,
saying that they hoped the Improvement Commission would find some means to
initiate this much -needed upgrading, as had been explored at the last joint meet-
ing of the two Commissions. The City Planner was directed to prepare a letter to
the Improvement Commission thanking them for their cooperation and suggesting
that the greatest area of impact would be Pacific Coast Highway.
City Planner's Report
(a) S . C .A. G. Meeting - The City Planner announced that S . C . A. G. appears
to be moving toward becoming a regional government. The Council of Plan-
ning is also trying to move from a reviewing agency for Federal grants to an
advisory agency to S.C.A.G. Executive Council.
(b) S.W.A.P.C. Meeting - The County Planning Department presented its Gen-
eral Plan showing, among other things, the "Coast Parkway" back through
Manhattan and Hermosa. Detailed reports are to be made available. to all
South Bay cities.
(c) Beach Committee - Representatives of the three South Bay cities met at the
Copper Penny on May 14th and made very good progress. The Redondo Beach
representative offered to take aerial photographs of the beaches and make a
population map. At their next meeting on May 28 they planned to consider
the scope of the committee, and what it should do. Comm. Toole suggested
that Dick Fitzgerald come to talk to the Committee, and also invite the rest
of the Planning Commission, or possibly invite the Beach Committee and Mr.
Fitzgerald to the Planning Commission meeting. It was agreed to program
such a meeting for August.
Capital Improvement Program
City Planner Crawford presented a list of capital improvements that had been pre-
pared by the city staff for the next two years, to the Commission for their review,
indicating that work was continuing and more material would be brought to them.
