MEETING CALLED TO ORDER AT 7:35 P. M. BY CHAIRMAN NOBLE. ROLL CALL - Present: Comm. Collis, Himmel, Mulfinger, Stabler, Toole, Watters, and Chairman Noble. Absent: None Motion by Collis, seconded by Himmel to approve the minutes as amended, changing the word July to August on Page 4, paragraph 5. Unanimous. Resolution P. C. 154-772 Motion was made by Comm. Watters, seconded by Himmel to approve P. C. 154-772 as submitted. AYES: Comm. Collis, Himmel, Mulfinger, Stabler, Toole, Watters. NOES: None ABSTAIN: Chairman Noble ABSENT: None C-70-6 Public hearing opened: 7:42 p. m. City Planner Crawford explained the nature of the request by the Pizza Hut of Los Angeles, Inc. , for a Conditional Use Permit to serve beer with meals in a restaurant to be located at 429 Pacific Coast Highway. He said that it would be a new structure, and presented a plot plan showing the necessary corrections to the parking layout to conform with zoning ordinance. He said he had not as yet received the Police Chief's report. The staff recommenda- tion, therefore, was to approve the request, assuming no negative evidence arises in the public hearing. Mr. Joe Hurst, 2465 S. Ola Vista, San Clemente, spoke in favor of his request and explained that the Pizza Hut of Los Angeles, Inc. , is a national franchise chain; the largest in operation, with six hundred stores. He said that in relation to the sale of beer the national average is 20% of the total sales. No one spoke in opposition. Public hearing closed: 7:50 p. m. The Commission discussed the request, and asked questions concerning the location of some of the new stores and their appearance. -2- Mr. Hurst asked if the closing time on Friday and Saturday evenings could be extended to 1:30 a. m. Mr. Hurst's answers to questions by the Commis- sioners concerning franchise, advertising, parking arrangements, landscaping, signing and color scheme, and the use of a metal roof were all satisfactory to the Commission. The Commission suggested landscaping the 5th Street frontage. Mr. Hurst indicated that the plot plan would be revised to reflect the City Planner's sketch and will provide landscaping on 5th. It was suggested by Comm. Collis that a Resolution of Record be drawn up to cover all such requests on metal roofs to be used by the Building Director in the future. Motion by Collis, seconded by Mulfinger to grant a Conditional Use Permit, subject to conditions, to the Pizza Hut of Los Angeles, Inc. Motion by Collis, seconded by Watters to adopt P. C. 154-773 granting a Conditional Use Permit to the applicant, Pizza Hut of Los Angeles, Inc. , to serve beer with meals at a restaurant to be constructed at a location at 429 Pacific Coast Highway, subject to the following conditions: 1. That no sit-down bar be established. 2. That beer be sold only with food. 3. That the alcoholic beverage license reflect that Condition 2, above, is part of the license. 4. That hours of operation (sales of beer) be limited to 6:00 a. m. and 12:00 p. m. , except Friday and Saturday, beer may be served until 1: 3 0 a. m. S. This Conditional Use Permit is subject to a favorable report from the Chief of Police. 6. Parking and landscaping shall be revised to the satisfaction of the City Planner. 7. That the Conditional Use Permit be for a period of one year, at the end of which time, it shall be reviewed by the Planning Commission. AYES: Comm. Collis, Himmel, Mulfinger, Stabler, Toole, Watters and Chairman Noble. NOES: None ABSENT: None Motion was made by Comm. Watters, seconded by Comm. Toole to direct a letter to the Building Director approving a metal roof on the subject building similar to that on the Artesia -Redondo Beach Boulevard store. AYES: Comm. Collis, Himmel, Mulfinger, Stabler, Toole, Watters and Chairman Noble. NOES: None ABSENT: None -3- Z-70-1 City Planner Crawford stated that this request for zone change of James Fucile had gone to the City Council and they had referred it back to the Planning Commission with the request that it be studied in detail and returned to the City Council within ninety days. Mr. Crawford suggested that a committee within the Planning Commission be formed to complete the study and recom- mend action which the Planning Commission could then submit to the City Council. He indicated that confusion over the actual zone classification of Pacific Coast Highway lots (C-1 instead of C-3) led the City Council to believe that reconsideration might change the recommendation. Chairman Noble felt that an expert should be employed to study the matter and report back to the Planning Commission, but Comm. Watters said he would rather see such money spent on other areas such as the Herondo development. Mr. Joe Mundy, 740 - 24th Street, quoted the General Plan in saying that the view lots in that area were to be protected and the new apartment build- ing would destroy the view if it were erected. He presented maps to the Com- mission outlining a total of 382 cars now using 21st Street as an access to Pacific Coast Highway from the surrounding residential streets. He said in the very near future the impact of an additional 142 cars will be felt from the new apartment complex on Ardmore. Comm. Collis asked Mr. Mundy what he felt was the best use for the area, and Mr. Mundy said single residential and that he would like to see alleyways separating the commercial area from residential area. Mr. Besant, 2207 Pacific Coast Highway said he would like to wait until other development occurs along the highway, before a change is made in the area, although he favored eventual commercial development. Comm. Collis suggested that the Commission return the matter to the City Council with a recommendation to uphold the denial and say that this is not the time for a change. Comm. Himmel indicated that he felt the Commission had too many other more valuable matters right now to be able to give time to such a study. Comm. Mulfinger said that he felt something needs to be done with this property. Comm. Noble indicated that he had personally taken a good hard look at the area and felt that the request would be piercing the established R-1 neighborhood with R-3 uses. Comm. Watters said that he felt it was necessary to have better information; traffic counts; the actual results of the completion of the Ardmore units; and the 1970 census information, before a sound decision could be made. Motion by Comm. Watters, seconded by Comm. Himmel to send back a recommendation for denial with the additional comment that the Planning Commission will form a study committee, consider traffic flow and police problems in the area, utilize the 1970 census and the planned development district, and initiate any zone change that proves to be wise. AYES: Comm. Collis, Himmel, Stabler, Toole, Watters and Chairman Noble. NOES: Comm. Mulfinger ABSENT: None Chanae of Name of Pier Avenue east to Aviation. Referral by City Council of letters requesting a change of name of Pier -- Real Avenue to Aviation Boulevard. The City Planner reviewed the Commission's previous action recommending that the street name be changed. The Commission discussed the 1968 action and subsequent actions. Motion was made by Comm. Watters, seconded by Comm. Toole that the City Council be informed that the Planning Commission still agrees with their recommendation to the City Council, dated September 11, 1968. AYES: Comm. Collis, Himmel, Mulfinger, Stabler, Toole, Watters and Chairman Noble. NOES: None ABSENT: None Review of "Uncommitted City Properties" The City Planner presented the "Uncommitted City Property" report prepared by the City Manager and referred by the City Council for review and recom- mendation. Chairman Noble noted that this matter deserved considerable in-depth analy- sis by the Planning Commission. Motion was made by Comm. Collis, seconded by Comm. Toole to meet at 7:00 p. m. on June 15, 1970 in order to review the first five properties listed by the City Manager. AYES: Comm. Collis, Himmel, Mulfinger, Stabler, Toole, Watters and Chairman Noble. -5- NOES: None ABSENT: None Committee Reports a. Zoning Committee - Comm. Stabler reported that the committee met on May 25th and discussed land use intensity concept, and looked at Manhattan Beach city's planned unit development plan. They will be meeting again at 7:30 a. m. , June 9, at the Surfboarder Restaurant. b. Development Committee - Postponed until Thursday evening, June 4. Chairman Watters reported that they were to consider the discussion with the Board of Appeals and presented the draft of the memorandum to the City Council reporting on that meeting. The Commission reviewed the memorandum and Comm. Stabler suggested that the term "roll back" be changed to "decrease" to indicate a general lowering of density. The Commission unanimously agreed that the memo be forwarded to the City Council as revised during the discussion and that the City Council be informed that through the discussion between the Board of Appeals and the Plan- ning Commission it appeared to be the general consensus of opinion that it would be feasible to upgrade some development standards and to increase the existing height limit in some areas under the precise plan procedures. Comm. Collis asked if the Development Committee would consider the idea of increasing the parking ration from 1--1/2 to 2 at their next meeting and bring their conclusions back to the Commission. c. Beach Plan Committee - Comm. Watters said that at their May 21st meeting they were briefed by the city staff on bills before the State Legislature, and if the bills were passed, they would preempt the City's zoning powers. He said that there appeared to be serious disagreement in philosophy among Committee mem- bers. One group felt that the beach plan should develop the beach just enough to satisfy State demands. The other felt that easy access and availability should be created for all people living outside the city. He said that a walk would be conducted along the beach on Saturday morning, June 13, accompanied by the Captain of the Lifeguards to explore the lifeguard problems. The City Manager and City Planner plan to conduct a sampling of persons on the beach to see where they come from. Mr. Craw- ford said that aerial photographs of the beach were taken on Sunday, May 31, to determine where the crowds collect. The Commission agreed to invite Mr. Dick Fitzgerald to meet with the committee on August 20. Planning Commission Information Pamphlet. City Planner Crawford presented the proposed pamphlet and described it as being designed to inform citizens on what the Planning Commission is and does. City Planner Reports Review of Conditional Use Permit. City Planner reviewed the location at 246 Pacific Coast Highway, the Pottery Shop, and said they are not yet ready for review as they just obtained their building permit for the kiln. He suggested giving them a two -month extension so that the Planning Commission could observe that problems might be created. Comm. Stabler moved, seconded by Comm. Toole to continue the Conditional Use Permit for two months. AYES: Comm. Collis, Himmel, Mulfinger, Stabler, Toole, Watters , and Chairman Noble. NOES: None ABSENT: None Comm. Stabler mentioned a variance granted by the Board of Appeals for an increased mezzanine area. Mr. Crawford said that it was a structural mat- ter in the Building Code wherein mezzanines may be no more than 1/3 the total floor area of a dwelling unit without becoming a new story. A building could in effect have a partial fourth story if the bedroom area was left open in a mezzanine arrangement. Otherwise, there is a three story limitation in the zoning ordinance. Comm. Watters mentioned a variance granted by the Board of Zoning Adjustments granting an additional open parking space each on two lots on Herondo. The City Planner reminded the Commission that these lots were double frontage lots. The Zoning Ordinance allows one open space on the front of a lot. These lots have two fronts, and the Board of Zoning Adjustments apparently felt that this justifies one open space on each. -7 - Resignation Comm. Himmel submitted his resignation from the Commission. Chairman Noble praised him for his valuable contribution to the Commission and ex- pressed regret at his loss. The Commission unanimously concurred with this expression. Adjournment at 10:00 p. m. until 7:00 p. m. , Monday, June 15, 1970.
