To conduct take-out food business from counter and/or through
Interior windaw, at 201 Hermosa Avenue.
The property has been through a nLniber of "restaurants" inclklding
take-out foW establist'viients. The building I:as been painted a flars-
boyant orange. 'Iffie tables and benches removed. The iacation has been
a teenage gathering place in the past.

The Commission is required to consider the following:
1. Hours of operation: 6:00 a.m. to 12:00 midnight.
,Cho operation past 10:00 p.m. could encourage teenage gangs
to congregate past curfew with the cafe &s an excuse.
2. Distance from residential uses: Adjacent thereto. Noise
and public gatherings at this location have been a problem
to residents in the paste
3. Damage or nuisance from noise, sue, odor, dust, vibration,
unsightliness, etc.:
Nuisance from noise, unsightliness has occurred in the past.
Odor problems are at present unknown.
4. Off-street parking:
Parking available to rear, on -site.
5. Hazard from congregation of large nurbers of people and cars
during hours of operation and closing hours.
6. Precautions taken to assure cm*atability with surrounding areas:
Benches and tables to be remved. No outside eating facilities.
7. Site In relation to size of streets, etc. Adequate.

Other considerations:
a. The over -sized parking area could encourage eating In
cars.
b. Last year. juveniles sat on curbs to eat take-out foods.
c. Color of building Implies Intention to attract youthful
cl ientel .
d. This location is and has been very sensitive In regard to
teenage congregations.
BECONMENDATM.
Denial as submitted.
Basis: This location has proved to be a problem for take-out
foods after dark.. A severe Imposition would be placed on adjoining
residences.
The design, color of the building, and the proposed mstbod of
distribution of food (either over counter or through window) indicates r
that more study is needed by the applicant before a carte -blanche
conditional use permit could be safely assured.
That take-out business be permitted under the following conditions:
Hours: between 10:00 a.m. and 10:00 p.m.
Service: counter only - no window pass -through to exterior.
Consumption: no tables or benches on property; no eating in
vehicles - let to be so posted.
Building: change color to one More In keeping with commercial
a tsphere .
Parking: off-street parking spares be striped in accordance with
City standards.
