Planning Commission Minutes - January 14, 1974 Page 2 C-73-15 PD Request of Terraco for a PD permit to construct a seven -unit apartment condominium at 1722 Hermosa Avenue (cont'd from 12-10-73). City Planner Crawford explained that this item was continued from December 10, 1973 to give the applicant an opportunity to submit a revised request. The applicant had indicated intent to appear before the commission to describe the plan in detail and to find what changes the Planning Commission might approve. Chmn. Collis moved to continue Item ##5 until the applicants arrived. C-73-19 PD Request of J. Cariker for a PD permit to construct a four -unit apartment condominium at 1035 Manhattan Avenue (cont'd from 12-10-73). Mr. Crawford reviewed this item and said it was continued to allow Mr. Cariker to submit a revised request. He said Mr. Cariker has abandoned that effort and has no further interest in the planned development. Since the applicant had failed to submit a request in writing to withdraw the request, Mr. Crawford suggested that the Commission deny the request without prejudice. Public hearing opened at 7:48 p.m. No one wished to be heard. Public hearing closed at 7:49 p.m. Motion by Comm. Rosenberger, seconded by Comm. Burt, to approve the request. Ayes: None Noes: Comm. Burt, Hough, Rosenberger, and Chmn. Collis Absent: Comm. Chiu, Noble, and Widman Motion by Comm. Rosenberger to adopt Resolution P.C. 154-943 denying the request of J. Cariker to construct a four -unit apartment condominium at 1035 Manhattan Avenue on the basis of inaction on his part and failure to meet the requirements of the ordinance. Comm. Hough amended the motion to include "without prejudice." Seconded by Comm. Burt as amended. Ayes: Comm. Burt, Hough, Rosenberger, and Chmn. Collis Noes: None Absent: Comm. Chiu, Noble, and Widman Comm. Widman arrived. C-73-21 Request of R.J. Plastino and P.J. Lupo for a permit to construct a six -unit townhouse condominium at 930 First Street. Planning Commission Minutes - January 14, 1974 Page 3 City Planner Crawford presented the staff analysis and preliminary E I R on the request for a conditional use permit to build a condominium under planned development procedures at the address indicated, and displayed an illustration of the proposed structure. He explained that the proposal is non -conforming in six areas: Unit size, parking, liva- bility space, recreation space, density, and usable open space. Public hearing opened 7:57 p.m. No one wished to be heard. Public hearing closed 7:57 p.m. Chmn. Collis noted that very few PD requirements seemed to be met. Motion by Comm. Burt, seconded by Comm. Rosenberger, to approve the request. Ayes: None Noes: Comm. Burt, Hough, Rosenberger, Widman, and Chmn. Collis Absent: Comm. Chiu and Noble Motion by Comm. Burt, seconded by Comm. Rosenberger, to adopt Resolution P.C. 154-944 denying the request of R. J. Plastino and P. J. Lupo for a permit to construct a six - unit townhouse condominium at 930 First Street, on the basis that it does not meet minimum dwelling size, does not have twelve covered parking spaces, does not have required livability space, does not have required recreation space, and is not consistent with General Plan density. Ayes: Comm. Burt, Hough, Rosenberger, Widman, and Chmn. Collis Noes: None Absent: Comm. Chiu and Noble Chmn. Collis advised the applicants that the denial may be appealed to the City Council within ten days. TE14TAT I_VE_ MAP #31914 Request of J. Gerlach for approval of Tentative Tract Map #31914 for apartment condo- minium at 614 - 620 Monterey Boulevard. Mr. Crawford said the tentative tract map contains the information required by state law, and is consistent with the Planned Development permit granted in December. He said the Coastal Zone Commission rules require both the PD permit and the Tentative Map before they will consider approval of the project. If the Coastal Zone Commission approves the project, the applicant will return with the Final Development Plan, at which time the Planning Commission may make additional changes. Public hearing opened at 8:06 p.m. No one wished to be heard. Public hearing closed at 8:06 p.m. Comm. Hough observed that the plan does not provide guest parking as required. It was established that circulation and parking were valid subdivision considerations. Planning Commission Minutes - January 14, 1974 Page 4 Motion by Comm. Burt, seconded by Comm. Hough, to approve Tentative Tract Map 931914 with the understanding that the applicant will be required to provide at least one guest parking space in addition to the twelve regular parking spaces for six units, and that this space will not be tandem. Ayes: Comm. Burt, Hough, Rosenberger, Widman, and Chmn. Collis Noes: None Absent: Comm. Chiu and Noble Motion by Comm. Burt, seconded by Comm. Rosenberger, to adopt Resolution P.C. 154-945 approving the Tentative Tract Map #31914 for a six -unit apartment condominium at 614 - 620 Monterey Blvd., subject to the condition above stated, and subject to the approval of Final Development Plan and Final Map. Ayes: Comm. Burt, Hough, Rosenberger, Widman, and Chmn. Collis Noes: None Absent: Comm. Chiu and Noble LEGAL USE Final determination of legal use at 237 29th Street. Mr. Crawford recalled testimony concerning the request by Mr. Wes Oldaker, and said that after a lengthy hearing, it was determined to be an unjustified use of the property, having converted originally existing two -car garage to a bedroom and one -car garage. He said the City Attorney, J. B. Mirassou, has reviewed all materials, including the letters, the minutes and finding of the Planning Commission, and has approved the action of the Commission as being legal and within its rights. Comm. Rosenberger asked whether the City has any way of ensuring that this garage will not be converted again to an additional room. Mr. Crawford replied that the City will ensure that the construction is halted, the garage door opened, and the room reconverted to a garage. Motion by Comm. Rosenberger, seconded by Comm. Widman, to reaffirm the Planning Commis- sion's previous action as verified by the City Attorney. Ayes: Comm. Burt, Hough, Rosenberger, Widman, and Chmn. Collis Noes: None Absent: Comm. Chiu and Noble Chmn. Collis announced that the Planning Commission has found the use of the property at 239 29th Street to be not a legal use. The applicant has the right to appeal to the City Council within ten days from the date he is officially notified by registered letter. LEGAL USE Final determination of legal use at 2009 - 2011 Manhattan Avenue. Planning Commission Minutes - January 14, 1974 Page 5 City Planner Crawford reviewed the status of the determination of legal use, and the conditions set forth by the Planning Commission. City Attorney J. B. Mirassou has approved the action of the Planning Commission, "on the basis, among others, that the representative of the owner agrees that the fifth unit should be removed and used for storage." Motion by Comm. Rosenberger, seconded by Comm. Widman, to reaffirm the Planning Commis- sion's previous action as verified by the City Attorney. Ayes: Comm. Burt, Hough, Rosenberger, Widman, and Chmn. Collis Noes: None Absent: Comm. Chiu and Noble SUBDIVISION ORDINANCE Mr. Crawford explained that the Subdivision Ordinance is being retyped in accordance with the changes made by the Planning Commission. He presented a formula devised by the City of Manhattan Beach to determine the fees for dedication for park purposes, for the information of the Planning Commission. Chmn. Collis moved to continue this item. AMENDMENT #9 TO THE GENERAL PLAN Mr. Crawford explained that this copy of Amendment #9 shows changes in the Amendment previously effected by the Planning Commission. Comm. Widman corrected I B., line three, to replace the word "corridor" so that it now reads "The Commercial corridor along Pier Avenue....." In answer to several questions, Mr. Crawford said that zone changes must be consistent with the General Plan, and as far as the Coastal Zoning Commission is concerned, every project must be consistent with the General Plan. Motion by Comm. Widman, seconded by Comm. Rosenberger, to close the public hearings on Amendment #9, and to take under advisement and to have staff prepare additional changes and revisions as advisable to deal with remaining problem areas. Ayes: Comm. Burt, Hough, Rosenberger, Widman, and Chmn. Collis Noes: None Absent: Comm. Chiu and Noble AMENDMENT #6 TO THE GENERAL PLAN The copy of the amendment submitted shows 16th Street eliminated as a Collector Street. Comm. Widman suggested including bike trails in the revision of the amendment. Mr. Crawford said the matter of bike trails along the Santa Fe right of way has been dis- cussed and, officially, absolutely rejected. He said the City would bear the costs for creation of any bike trails. The Bicycle Commission is still in existence, but inactive. He said that several interested groups (Automobile & Bicycling Associations) have advised against designating streets as bike trails unless changes are made in traffic routing and parking regulations to increase the safety of the route. Comm. Widman remarked that gas tax funds can be used for bike trails. Comm. Rosenberger noted that the limits of 8th Street as a Collector street should be defined in the Amendment as being from Hermosa Avenue to Pacific Coast Highway. Burt, Hough, Rosenberger, Widman, and Chmn. Collis Noes: None Absent: Comm. Chiu and Noble PROPOSED O-S ZONE Mr. Crawford explained that under state law, cities are required to have an Open Space zone in conjunction with their open space plan. He presented a synthesis by Comm. Widman of some of the provisions in Open Space Ordinance from other cities, with the intent of including our needs for an Open Space Zone. He said the resolution would have to be advertised for public hearing when the Planning Commission is satisfied with the provisions. Comm. Widman pointed out that the proposed ordinance considers possible problems of seismic hazards, soil instability, erosion and flooding. Motion by Comm. Rosenberger, seconded by Comm. Hough, to continue this item to the next workshop. Ayes: Comm. Burt, Hough, Rosenberger, Widman, and Chmn. Collis Noes: None Absent: Comm. Chiu and Noble SUBDIVISION TRACT #32237 Mr. Crawford reviewed the history of the parcel proposed for subdivision, created by the Hermosa Beach School District with the approval of the Planning Commission and City Council. He explained the need to negotiate with Redondo Beach to see if they will cooperate in underground wiring when the street is widened. Comm. Burt corrected the EIR, II, to read "Hermosa View" rather than Prospect Heights. Comm. Rosenberger corrected the EIR, VI, to read "exactly" rather than greater than. Staff recommended continuing the item to obtain information as suggested by the proposed Subdivision Ordinance. Chmn. Collis believed the Planning Commission should determine whether the proposed subdivision meets existing basic requirements. Mr. Crawford said the information submitted meets the City requirements. He added that since they do not have all of the utility plans, particularly from Edison, the applicant has concurred with the continuance. Motion by Comm. Widman, seconded by Comm. Rosenberger, to continue the item to the next meeting. Ayes: Comm. Burt, Hough, Rosenberger, Widman, and Chmn. Collis Noes: None Absent: Comm. Chiu and Noble ZONING Comm. Widman submitted a chart of the requirements of the various zones that might be used for informational purposes. tit Planning Commission Minutes - January 14, 1974 Page 7 DEFINITION OF HOTEL Mr. Crawford presented the following information: The City Council has before it an appeal from an action of the Board of Zoning Adjustments wherein the Board of Zoning Adjustments granted to a hotel the privilege of converting a sleeping room to a kitchen that would be a communal kitchen. The Council had difficulty deciding what a hotel or a motel is; what a boarding house or a lodging house is. They have asked the Planning Commission to advise them in this matter. Would the action of the Board of Zoning Adjustments change the hotel into a boarding house, for if so, it will require a conditional use permit. The City Health Code, adopted from the County Health Code, has a very strict enforcement against cooking in a hotel or motel room. There is no restriction against having a separate kitchen with a two-hour separation from the sleeping rooms. Coralie Ebey suggested that addition of a kitchen would encourage longer tenancy and therefore extra parking spaces should be provided. Chmn. Collis moved to continue this item to the workshop session. BOOTLEG PROBLEM Comm. Rosenberger suggested a joint meeting of the Development Committee and the Committee on Illegal Housing to discuss recommendations regarding the Land Use Survey. The joint meeting was scheduled for Wednesday, January 16, 1974. C-73-15 _P_D This item was continued earlier in this meeting. Public hearing opened at 10:3'9 p.m. No one wished to be heard. Public hearing closed at 10:39 p.m. Motion by Chmn. Collis, seconded by Comm. Hough, to continue until next regular meeting of the Planning Commission, with the stipulation that action will be taken at that time regardless of whether the applicant appears. Ayes: Comm. Burt, Hough, Rosenberger, Widman, and Chmn. Collis Noes: None Absent: Comm. Chiu and Noble NON -AGENDA ITEMS 1. Copy of by-laws presented for new Commission members. Suggestion was made by Mr. Crawford that the Planning Commission consider a return to the practice of one meeting per month for public hearings, to be placed on the agenda for the next regular meeting. 2. The Project Area Committee minutes were presented by specific request of Project Area Committee, concerning the use of redevelopment funds to purchase Pier Avenue and/or South School for permanent public open space. I Planning Commission Minutes - January 14, 1974 Page 8 3. City Council request that the Council be provided with a list of recommendations by the Planning Commission regarding a Land Use Survey. 4. Information presented on a League of California Cities Planning Seminar in Palm Springs in February, 1974. The City will help defray expenses if members of the Planning Commission wish to attend. 5. An outline of the Work Program of 1973 was presented in order to review the progress during the past year. Meeting adjourned at 11:00 p.m. to workshop meeting on Monday, January 21, 1974.
