Chiu Absent: None ELECTION OF VICE-CHAIRMAN Chmn. Collis opened the nominations for Vice-chairman. Comm. Hough nominated Comm. Rosenberger, seconded by Comm. Widman. Comm. Noble nominated Comm. Chiu, seconded by Chmn. Collis. Nominations were closed. Voting was by secret ballot, and Comm. Rosenberger won by a 4-3 vote. C-74-2 Request of J. Altamura for a re -hearing of Conditional Use Permit C-71-1, pizza take- out restaurant at 1318 Strand. (new) Planning Commission Minutes January 28, 1974 Page 2 City Planner Crawford declared that the public hearing had been duly advertised to all property owners within 300 feet. The Environmental Impact Report states that the project poses no immediate significant impact as tt does not represent a change in use. Mr. Crawford said that the only differences from the first conditional use permit issued on February 17, 1971, will be in changing ownership and changing the name. Staff recommended approval subject to recommended conditions. Public hearing opened at 7:49 p.m. John Altamura, 813 Ilth Street, Manhattan Beach, stated that he wishes to operate a pizza take-out restaurant at 1318 Strand, and agrees to all conditions recommended. He said it would be very costly to have paper cups stamped, but the plates and napkins could be stamped. He said he would be willing to put in a bike rack, but it would have to be in the parking lot rather than on the Strand, and people do not usually wish to park their bicycles out of their sight. No one else wished to be heard. Public hearing closed at 7:56 p.m. Motion by Comm. Noble, seconded by Comm. Hough, to grant Conditional Use Permit C-71-1 for a take-out food business at 1318 Strand, subject to stated conditions. Ayes: Comm. Burt, Chiu, Hough, Noble, Rosenberger, Widman, and Chmn. Collis Noes: None Absent: None Motion by Comm. Noble, seconded by Comm. Rosenberger, to adopt Resolution P.C. 154-946 granting the request of John Altamura for a Conditional Use Permit for a take-out food business at 1318 Strand, subject to the following conditions: 1. Signs and exterior decor to be reviewed and approved by Improvement Commission prior to issuance of Business license. 2. Place and maintain a litter container of at least 30 gallon capacity near the window. Said container to be of the type now being purchased by the City, or equal in appearance. 3. No benches or tables to be placed on the Strand. 4. All pass -out paper goods to be stamped or engraved with identifying emblem or name. 5. No more than 20% of the window areas to be obscured by signs or writing. 6. Night light to be maintained during hours of darkness. 7. Hours of operation not to exceed 9:00 a.m. to 10:00 p.m. 8. Strand to be maintained in a clean and orderly manner. It has been determined by the Planning Commission that the business will not be detri- mental to the neighborhood and the Planning Commission does not foresee any problems. Ayes: Comm. Planning Commission Minutes January 28, 1974 Page 3 C-73-15 PD Request of Terraco for a Planned Development Permit to construct a seven -unit apart- ment condominium at 1722 Hermosa Avenue. (cont'd) Public hearing opened at 7:59 p.m. No one wished to be heard. Public hearing closed at 7:59 p.m. Comm. Rosenberger noted that no guest parking is provided as required by Section 7.5-3. Motion by Comm. Noble, seconded by Comm. Burt, to approve the request. Ayes: None Noes: Comm. Burt, Chiu, Hough, Noble, Rosenberger, Widman, and Chmn. Collis Absent: None Motion by Comm. Noble, seconded by Comm. Hough, to adopt Resolution P.C. 154-947 denying the request of Terraco to construct a seven -unit apartment condominium at 1722 Hermosa Avenue. The Commission, at a previous public hearing, found the plans as submitted not to meet required finding #2 and A, being not of a character of development that is desirable and will promote stability, and being out of harmony with its surrounding neighborhood; the applicant was requested to submit revised plans, but did not do so. It has been determined by the Planning Commission that the lack of activity and failure to appear at public hearings denotes a lack of interest, and that the proposed project does not meet conditions of the ordinance for guest parking. Ayes: Comm. Burt, Chiu, Hough, Noble, Rosenberger, Widman, and Chmn Collis Noes: None Absent: None SUBDIVISION ORDINANCE Mr. Crawford stated that this copy of the Subdivision Ordinance includes amendments previously recommended by the Planning Commission. He noted a correction on Page 4, Section 29.5-7, C., changing "A governing body of a city or county" to "The Planning Commission or City Council." He said that this ordinance follows the State Map Act fairly closely and has been adjusted to meet the Lot Split Ordinance. He said this ordinance will place authority for approving lot splits with the Planning Commission, and will keep condominium conversions with the Planning Commission. He presented a breakdown of the park fees of neighboring cities, ranging from no fee to $1000 per unit. Subsequent discussion resulted in the following changes: Section 29.5-3, A., Insert after "condominium" the words "of two or more units." l.a., insert after "property owners," the words "the subdivider,". I.e., following "public utilities" comma, "and locations of all existing ease- ments." Planning Commission Minutes January 28, 1974 Page 4 Section 29.5-4, delete "Planning Commission" and insert "Board of Zoning Adjustments." I.c., after "property owners," insert the word "subdivider,". Following l.i., insert: j. Location of existing buildings and all trees with diameter in excess of six inches, and other improvements on the property to be divided. k. Method of surface water disposal. 1. Location and depth of fill areas. Public hearing opened at 8:31 p.m. No one wished to be heard. Public hearing closed at 8:31 p.m. Motion by Comm. Burt, seconded by Comm. Hough, to approve the Subdivision Ordinance with the corrections and amendments indicated. Ayes: Comm. Burt, Chiu, Hough, Noble, Rosenberger, Widman, and Chmn. Collis Noes: None Absent: None Motion by Comm. Noble, seconded by Comm. Hough, to adopt Resolution P.C. 154-948 approving the Subdivision Ordinance as amended and recommending that the ordinance be forwarded to City Council for their recommendations and/or approval. Ayes: Comm. Burt, Chiu, Hough, Noble, Rosenberger, Widman, and Chmn. Collis Noes: None Absent: None Motion by Comm. Hough, seconded by Comm. Noble, to direct a letter from the Planning Commission to the City Council recommending that the Building Code be changed so that park fees conform to those in the Subdivision Ordinance. Ayes: Comm. Burt, Chiu, Hough, Noble, Rosenberger, Widman, and Chmn. Collis Noes: None Absent: None AMENDMENT #6 TO THE GENERAL PLAN Motion by Chmn. Collis, seconded by Comm. Noble, to continue the Circulation Element until the next Planning Commission meeting on February 11, 1974. Ayes: Comm. Burt, Chiu, Hough, Noble, Rosenberger, Widman, and Chmn. Collis Noes: None Absent: None Planning Commission Minutes January 28, 1974 Page 5 Mr. Crawford reviewed a revised map submitted by the subdivider for the proposed eleven -lot subdivision on Harper Avenue, which indicates the easement to the school property, and a dedication of an additional twenty feet to Harper Avenue. He said that condition #5 (underground all power, telephone, TV lines within the tract) will be discussed in a meeting between Redondo Beach, the subdivider, and Edison, since Hermosa Beach has control over only half the street. He said that staff recommends approval of the Tentative Tract Map subject to conditions listed in the analysis. Public hearing opened at 9:11 p.m. Jason Lane, 1413 Sepulveda, Manhattan Beach, subdivider, stated that he and his partner, John H. Norman, intend to build four -bedroom homes with two -car garages and off-street parking for camper or boat. He said they will comply with all conditions recommended by the staff. He said they are considering installing gas street lights instead of the three decorative lights required. He said they are aware of the drainage problems, will provide a thorough drainage and grading plan, and are in touch with the County Flood Control District which must also approve the plan. He stated that they would make a mailing to the residents across Harper Avenue (Redondo Beach) encouraging them to agree to undergrounding all wires. He said the walkway easement on Lot 411 is required by the school district in case unification is effected with Redondo Beach school district. Public hearing closed at 9:19 p.m. Motion by Comm. Burt, seconded by Comm. Noble, to approve Tentative Tract Map #32237 subject to the following conditions: 1. Construction of a 14' wide street pavement on Harper Avenue from the south boundary of the subdivision to the existing edge of pavement between the subdivision and 19th Street to City Standards. 2. Construction of standard curb, gutter, and five-foot wide sidewalk along west side of Harper Avenue within subdivision boundaries. 3. Physically define and improve walkway easement to future park westerly of tract. 4. Construct standard 311 sewer to City Standards. 5. Underground all power, telephone, TV lines within tract. 6. Provide three decorative street lights as shown on Exhibit A to City Standards. 7. Submit complete grading and drainage plan to City Engineer for approval prior to approval of a final map. Ayes: Comm. Burt, Chiu, Noble, Rosenberger, Widman, and Chmn. Collis Noes: None Abstain: Comm. Hough, for the reason that she was not present during previous con- siderations of the proposal. Absent: None IV Planning Commission Minutes January 28, 1974 Page 6 Mr. Lane inquired whether it is permissible to build the houses to one side of each lot, thereby leaving the ten feet of open space between houses entirely on one lot. Mr. Crawford replied that this is possible under Planned Development. DA-GLO SIGN Request for retention of "da-glo'' fluorescent letters on sign located at 809 Pacific Coast Highway. Mr. Crawford reported that the owner has requested that this item be continued to the next meeting since he cannot be present at this meeting. Chmn. Collis instructed that this item be referred to the Improvement Commission. All ayes. So ordered. LANDSCAPING - GOULD AVENUE Mr. Crawford introduced Carol Walker to describe the landscaping concept for the remainder of Gould Avenue from E1 Oeste to Ardmore Avenue, including additions to the landscaping of the hillside on the north side, and in the median strip. She proposed hydro -seeding on the slopes (a mixture of seeds, fertilizer and water forced into the slope under high pressure to permit natural selection of the plant and tree types best suited to the slope and climate. She said they were not removing any existing land- scaping, and that there will be underground irrigation. Mr. Crawford added that curbs, gutter and sidewalk are included in the plan, and that no landscaping is required on the south side. Comm. Chiu suggested that some of the trees selected be chosen to provide natural food for birds. The Planning:Commission approved the proposed design and referred it to the Improvement Commission for further review and comment. INITIATIVE Comm. Burt requested that the initiative for Basic Development Standards be brought before the City Council. It was noted that Section 4 has been deleted. Motion by Comm. Rosenberger, seconded by Comm. Burt, to approve the initiative. ' Ayes: Comm. Burt, Rosenberger, and Widman Noes: Comm. Chiu, Hough, Noble, and Chmn. Collis Absent: None The motion failed to pass. AD HOC COMMITTEE Comm. Widman presented information concerning an ad hoc group composed of interested citizens, businessmen and businesswomen, city staff, and others who have been meeting for the last three or four months to discuss the problems of the downtown area specifically, and the business community as a whole, with the intent to develop over- all improvements, both short and long-term, to improve business interests and make Hermosa Beach a pleasant place to shop. Comm. Widman requested formal recognition by the Planning Commission as well as by the City, a special subcommittee of the Planning Planning Commission Minutes January 28, 1974 Page 7 Commission to work as liaison with the group, that staff work with the group, a review of the Goodkin Plan, a meeting with staff from the Coastal Zone Commission to work out proposals for the Biltmore site, and consideration of not only the mandatory elements but the permissive elements of the General Plan. He stated that one of their goals is to assist the Planning Commission in developing a Downtown Plan. The meetings are generally held on Thursdays at 9:30 a.m. Comm. Noble expressed his wish to serve on the subcommittee. Chmn. Collis appointed Comm. Noble to officially represent the Planning Commission as liaison to the ad hoc group. (Comm. Noble left the meeting at this time.) HERMOSA CAR WASH City Planner Crawford reviewed the Site Plan of the Hermosa Car Wash. Vern Maynard, 1000 Pacific Coast Highway, explained the necessity of retaining the wider driveways in the plan to reduce traffic hazard when re-entering Aviation Boulevard after leaving the gas pumps, and similarly on entering the property from Aviation Boulevard. There was discussion of the sign, which members of the Planning Commission felt was too large for the location. Mr. Maynard shared this opinion, but indicated it was not economically feasible to raise it at this time. He felt it could be done within a year. Motion by Comm. Hough, seconded by Comm. Burt, to approve the request to retain the existing driveways, the wall along Aviation Boulevard as built, and the metal roof as presently constructed with the understanding that all metal edges will be covered. The Planning Commission stipulated, and the applicant agreed, that the sign would be raised a minimum of four feet by April, 1975. Ayes: Comm. Burt, Chiu, Hough, Rosenberger, Widman, and Chmn. Collis Noes: None Absent: Comm. Noble CONDOMINIUM CONVERSION Concerning the memorandum from City Attorney J. B. Mirassou on Condominium Conversions, Comm. Rosenberger requested that the record show that he feels this decision reflects failure on the part of the City Attorney to consider the particular Sections under which the Planning Commission action was taken. He quoted the State Code Sections to which he referred. Motion by Comm. Widman, seconded by Comm. Burt, to communicate to the City Attorney that the Planning Commission reaffirms its previous actions as expressed in P.C. 154- 919, 920, and 926-930, and request that the City Attorney reconsider his opinion of January 16, 1974. Chmn. Collis recommended that the Planning Commission direct a letter to the City Attorney requesting that he expand on his opinions and reasons for making this decision. Ayes: Comm. Burt, Chiu, Rosenberger, Widman, and Chmn. Collis Noes: None Abstain: Comm. Hough, for the reason that she was not a member of the Commission when these actions were taken. Absent: Comm. Noble Notice of the action of the Planning Commission is to be sent to the City Council before their next meeting. Planning Commission Minutes January 28, 1974 Page 8 PROJECT AREA COMMITTEE Motion by Comm. Hough, seconded by Comm. Widman, to send a letter from the Planning Commission to the Project Area Committee, with carbons to City Council and to the school district, concurring in the proposal to use Redevelopment Funds to purchase South School for the purposes of open space and recreation; and concurring with City Council that City Yard and the purchase of South School constitute proper use of the funds and should be considered top priority items for the Project Area Committee. Noble RE COASTAL ZONE COMMISSION Louis Greziadio, 414 2nd Street, described to the Planning Commission his plan for constructing a four -unit apartment building on a 4000 sq. ft. lot, which he said meets the City's criteria for development but was turned down by the Coastal Zone Commission. He said he would like the Planning Commission to take an advocate position before the Coastal Commission, not on his particular case, but in the conflict that arises between local government and the Coastal Commission. He said the Coastal Zone Commission should be apprised of the particular local problems and considerations that prevail in each local area; and that although his plan exceeds the density of the Coastal Zone Commission guidelines for within 250 yards of the beach, it does not exceed the density of the Hermosa Beach General Plan. Mr. Crawford reported that the Coastal Zone Commission has advised the County Assessor that taxes on all lands within 250 yards of the beach should be decreased by 1/3 since they intend to decrease use of the land by 1/3, and asked whether the City should support its existing General Plan and existing ordinances, or conform entirely to the Coastal Commission General Plan. Chmn. Collis requested staff to direct this information to the City Council for consideration and direction. COASTAL ZONE COMMISSION REPORT Comm. Chiu requested a report on the planning session of the commission on the nature and goals of Hermosa Beach, re paragraph u of the report. Comm. Rosenberger suggested a quarterly feedback on actions of the Planning Commission in relation to actions of the Coastal Zone Commission, for re-evaluation, since in two years the Coastal Zone Commission will have set up its final guidelines. Chmn. Collis stated the necessity of defining the steps the Planning Commission will take in regard to the Coastal Zone Commission actions to facilitate the property owners to develop their property in a way that is acceptable to both the Coastal Zone Commission and the City. He strongly recommended that any decisions made by the Planning Commission and approved by City Council should be defended by the Planning Commission. f Planning Commission Minutes January 28, 1974 Page 9 MEETING SCHEDULE Motion by Comm.
