Request of Fat Howies, Inc. for a Conditional Use Permit to have beer and wine and
entertainment with a cafe at 1200 Hermosa Avenue.
Rod Merl reviewed this item, noting previous concern about the proposed use of pool
tables. He said the applicants have made modifications; the modified project having
been presented before the Chamber of Commerce, and having received the approval of
the Downtown Committee. The game room will be another dining area; the combined table,
booth and counter areas seating 108 persons.

Bernie Friedman, 452 20th Street, Santa Monica, presented renderings to show detail
of the exterior, to be sand -blasted, with etched glass windows, awning over door, and
planter boxes; and detail of the interior with the counter in a raised floor area,
booths along the wall, carpeting throughout, and the game room now shown as a dining
area with sofa, tables and chairs. He said the only games will be two or three
electronic games, probably in the waiting, area to provide recreation while waiting for
seating, their prime purpose being revenue.

Mr. Friedman displayed an etched glass window and a highly polished inlaid table;
and distributed copies of a revised menu to the Commissioners. In answer to ques-
tions from the Commissioners, he said the counter would seat ten people, there will
be no entertainment except the games at this point, there will be background music,
beer or wine may be served separately, but it is expected to be served with food.
He said the windows will be enlarged as much as possible, depending upon the struc-
ture of the wall. He said the changes from the original proposal were well received
by the Chamber of Commerce and the Businessmen's meeting.
Ben Wasserman, 1112 Hermosa Avenue, said that Mr. Friedman and Mrs. Russell made a
presentation to the Board meeting last Wednesday, and they are very much in favor of
the proposal. They were informed that the investment is about $50,000.

Chmn. Collis said the presentation was an extremely fine one. He reminded the Com-
mission that they will be voting on the use for the particular piece of property,
and the manner in which it is decorated is not at issue. He directed that the
recommendations of staff be given to the applicants and noted to staff that every
applicant should have received the findings of the staff prior to the meetings. Mr.
Merl read the recommendations of staff.

Mr. Friedman objected to #6 of the recommendation: "That Conditional Use Permit be
for a six-month period, subject to review at the end of that time, when it may be
either cancelled or continued at the sole option,of the Planning Commission." Chmn.
Collis explained that this is a standard procedure and no Conditional Use Permit has
been denied when the recommendations have been lived up to. He said that it is
possible to allow extra time at the six-month review if necessary.

Motion by Comm. Rosenberger, seconded by Comm. Burt, to adopt Resolution P.C. 154-963
approving the request of Fat Howies, Inc., 452 20th Street, Santa Monica, for a
Conditional Use Permit to have beer and wine and entertainment with a cafe at 1200
Hermosa Avenue, subject to the following conditions:
I'. That the service of beer and wine be permitted with meals only.
2, That no separate beer and wine service area be permitted.
3. That external advertising not include mention of alcoholic beverages.
4, That exterior facade treatment be subject to review and approval of the Hermosa
Improvement Commission.
5. That all signs be subject to review and approval of the Hermosa Improvement
Commission.
6, That Conditional Use Permit be for a six-month period, subject to review at the
end of that time, when it may be either cancelled or continued at the sole option
of the Planning Commission.

7. That full menu, not less than represented to the Commission, be maintained at
all times.
8. That dining areas be similar to that shown on "Exhibit All attached.
The revised menu is to be attached as "Exhibit B." The serving of beer and wine is
incidental; the serving of food is the main service.
Chmn. Collis stated that on the advice of the City Attorney, the Planning Commission
should not take any action concerning the game room and the games will not be per-
mitted at this time.

DETERMINATION OF LEGAL USE
Request to determine whether or not existing duplex at 1159 Ninth Street is a legally
permitted use of the property.
Mr. Merl called attention to a letter from a resident concerning the use of the
property as a duplex prior to 1956, and a note from the City Planner that the Housing
Code violation is separate and must be resolved outside the Planning Commission.

Tim Bauler, representing The Marina Realty and Paul Lupo, said he obtained the signa-
ture of the neighbor who said that the property was used as a duplex, and that the
neighbor's daughter who babysat there would also be able to give a signature. He
said that Byron Smith, the owner at the time, could not be located, but the current
owner had no knowledge of this situation when he bought it as a duplex.

Chmn. Collis reviewed the history shown by Building Department records, and pointed
out that the property was constructed as a single family dwelling, that the construc-
tion of the second.unit was illegal, and that it is an unsafe structure. He said the
question is whether the Planning Commission wants to make what is possibly a bootleg
into a legal dwelling.
Comm. Hough suggested that the owner present records showing that the structure was
indeed a duplex prior to 1956 as per the list compiled by Ralph C. Grippo, Building
Director.
Motion by Comm. Hough, seconded by Comm. Rosenberger, to continue this item with
instructions to the applicant to furnish records to the Planning Commission at the
next regular meeting, June 10, 1974.

Request of Terraco Investments for a Planned Development permit in order to develop
a two -unit townhouse condominium at 331 Manhattan Avenue.
Mr. Merl presented blueprints of the proposed structure having three-story frontage
on Manhattan Avenue and backing on Palm Drive. He said this item is related to Item
#9, Tentative Tract Map #32494.
Public hearing opened 8:34 p.m.
Patrick Higashi, 6310 blest 89th Street, Los Angeles, said they are presenting a two -
unit condominium as they feel it would be approved by the Coastal Commission; that
the design will enhance the area; will look like two stories although it is three;
and that they are building a two -unit condominium on 25th Street.
Comm. Burt referred to the recommendation to increase driveways to eighteen feet or
reduce to ten feet and provide automatic garage door openers, and asked which they
would prefer to do. In reference to the inadequate livability space and recreation
space, Comm. Rosenberger asked if balconies and roof would be shown as recreation space.
Mr. Higashi said they prefer to reduce the driveway length and intend to provide
garage door openers anyway. He said that moving the garages toward the street would
alleviate structural problems, change the size of the lanais and the open space out-
side the lanais. Roof area is not used for recreation space; there are balconies.
Mr. Merl said the Zoning Code defines as livability space open area at ground level
and readily available, therefore, balconies and lanais do not serve as livability
space.
Chmn. Collis said this is one of the areas that concerns the creativity of the designer
and should be flexible. He said if the design meets the criteria basically, he does
not feel bound by the exact square footage.
Mr. Higashi said one of the problems in designing is that the Coastal Commission has
a specific requirement as to how much space one can have in the building, called the
1.5 Code which is requiring the buildings to be made smaller. Inclusion of the garages
in this ruling discourages any additional parking space other than the minimum.
Comm. Chiu asked the estimated resale price of the units (high $50,000 or low $60,000)
and said that all the projects the Planning Commission is approving are in that price
area or more.
Mr. Higashi replied that everything the Coastal Commission has done is leading to the
Coastal area's being only for the rich.

Chmn. Collis said the development falls within the General Plan, meets the intent of
the ordinances, and final plans would be subject to review and final approval. He
said the question is whether the Planning Commission wants a two -unit apartment for
rental or a development for two separate families.
Motion by Comm. Hough, seconded by Comm. Burt, to approve the request subject to the
conditions that the driveways are reduced to eight -ten feet consequently increasing
the size of the lanais, and that the project go before the Hermosa Improvement Commission.

Comm. Hough approved the fact that there will be no limitation on age or number of
children.

Motion by Comm. Rosenberger, seconded by Comm. Burt, to adopt Resolution P.C.
154-964 approving the construction of a two -unit townhouse condominium as a Planned
Development by Terraco Investments located at 331 Manhattan Avenue, the considerations
for approval in agreement with staff analyis: waive the requirement for livability,
reduce the driveway t❑ eight -ten feet which will increase the size of the lanais, and
design subject to approval by the Hermosa Improvement Commission.

TENTATIVE TRACT MAP 1i'324
Mr. Merl presented the tentative tract map with a request by staff that the applicant
indicate on the map the individually owned areas and the commonly owned areas.
Chmn. Collis asked if any street improvements or sidewalks were indicated; and if any
improvements on the alley side were indicated.
Mr. Merl replied that the sidewalks are in; and that no requirements were made by the
City Engineer for improvement on the alley side, but could be added. He said that
underground wiring is required.
Chmn. Collis inquired whether the Planning Commission can make additional requirements
of the applicant once he has met the initial conditions. Mr. Merl replied that the
final map requires the approval of the City Engineer, and is normally handled as an
administrative item. Mr. Higashi added that the City Engineer normally makes his
requests on the tentative tract map, and if there are no requests then they assume
there will be none in the future.
Chmn. Collis said he had no objections to the approval, but would like to have the
City Engineer make his findings, and if there are none, to so state. He said the
City Engineer's report or requirements should be worked out between the applicant and
staff, but the Planning Commission would not be doing its job property if it did not
have some overview of the results.
Motion by Comm. Rosenberger, seconded by Comm. Burt, to approve the Tentative Tract
Map #32494 contingent on a report from the City Engineer. A positive approval by the
City Engineer would require no further action by the Planning Commission. If the
report is negative, it will be taken up at the next meeting, May 28, 1974. The
Planning Commission should have a report directly to the Planning Commission from the
City Engineer by the meeting on May 28, 1974.

Motion by Comm. Rosenberger, seconded by Comm. Hough, to adopt Resolution P.C.
154-965 approving Tentative Tract Map #32494, proposed tentative map for a two -unit
condominium subdivision at 331 Manhattan Avenue, subject to the following conditions:
1. That the tentative map be approved subject to conditions of showing the three
parcels on the final map;
2. That the City Engineer make his report to the Planning Commission by the next
regular meeting, on May 28, 1974; and
3. That the C.C.&R's be amended to conform with the changes in the tentative map
listed above.

Request of L. Scott for a Conditional Use Permit in order to have a beer bar_.wi:th cold
sandwiches at 22 Pier Avenue.
Mr. Merl called attention to -the note from the City Planner stating that this item was
misadvertised as it was in.fact a request for a cocktail lounge.
Chmn. Collis said that any testimony taken would be a part of the minutes and con-
sidered in the final determination.
Public hearing opened 9:20 p.m.
Lloyd W. Scott, 916 Esplanade, Redondo Beach, said they are trying to open a bar that
has been closed, and would like to have a decision tonight. He said it represented a
$60,000 investment, they want to be open by Memorial Day, and the liquor license is
dependent upon Planning Commission action.
Art Spl-awg,no address given, presented a plan of the interior. The floor will be
carpeted, decor is nautical flag display, and walls cedar -paneling.
Comm. Hough asked why they have chosen to have no live entertainment.
Mr. Scott replied that they do not want it, as it causes too many problems and is too
expensive; they will have a pool table, shuffleboard and darts.
Chmn. Collis questioned the preparation to open prior to obtaining approval.
Mr. Scott said he did not understand the procedure, and Mr. Sp -lawn said the need for
a Conditional Use Permit came to their attention after they had started. They did not
know it was required after the bar had been closed for ninety days.

Comm. Rosenberger suggested the possibility of granting a Conditional Use Permit for a
cocktail lounge subject to the condition that until the public hearing is held on the
liquor license they could serve only beer and wine, and asked what results might be if
the Planning Commission later had to deny the establishment of a cocktail lounge due
to results of a public hearing.

Mr. Merl doubted that the Alcoholic Beverage Control would respond to a temporary
approval.
Comm. Peirce asked whether they would have the right to continue the beer bar if the
Planning Commission had to deny the establishment of the cocktail lounge after the
next public hearing.
Mr. Merl said it should be made part of the approval that it does not presume the
right to continue as a beer and wine bar.
Comm. Rosenberger, based on public testimony, moved to approve on a temporary basis
a request to use the premises at 22 Pier Avenue for beer and wine use only, subject
to the readvertising of the request for a cocktail lounge and the results of the
public hearing to be held in June, and subject to the stipulation that the applicant
has been made aware of the potential risk that he is undertaking since the next
public hearing could result in reversal of this action. The approval would also be
subject to conditions:
1. That all noise and music be confined to the premises:
2. That no live entertainment or dancing be permitted.
3. •That hours of operation be 12:00 noon to 2:00 a.m. with no occupancy of the
premises after 2:30 a.m.
4. That exterior and all signs be subject to review and approval of the Hermosa
Improvement Commission.
5. No electronic or mechanical coin -operated games permitted.
Comm. Chiu stated that the intent is clear that if this is approved, all the risks
be borne by the applicants and no expenses incur upon the City due to our action
tonight. Comm. Chiu seconded the above motion.
Comm. Hough expressed her feeling that this proposal sounds like an adult game palace,
she does not feel comfortable voting approval for beer and wine without full testimony,
and does not feel that this will upgrade the downtown area.
Comm. Burt concurred, but for the reason that there are enough liquor outlets in the
City already.
The vote on the above motion was as follows:

Noes: Comm. Burt, Hough, and Chmn. Collis

Chmn. Collis announced that the motion failed to pass, and that the applicants have
the right of appeal within ten days.

Request of D. Weber for a Conditional Use Permit to have manufacturing in conjunction
with a retail business at 860 Pacific Coast Highway (Surfboard).
Mr. Merl presented copies of a petition circulated by the applicant and colored
drawings of the project, a commercial building at the intersection of Ninth and Pacific
Coast Highway involving two lots and planned for retail sale of sporting equipment
plus a shop for repair and construction of surfboards.

Public hearing opened 9:54 p.m.
Dewey Weber, 542 23rd Street, Hermosa Beach, said he has lived in Hermosa Beach for
fifteen years and has been in business here for thirteen years. He said he wishes to
obtain a Conditional Use Permit to build a sporting goods center and believes it will
be good for the citizens of Hermosa Beach. He said the fenced yard area is for main-
tenance and repair of small sailing boats and small power boats.
Comm. Chiu asked what the noise level is now in the area, and how much is two db above
that noise level. Mr. Merl replied that the City.has an instrument to measure the
noise level, and that it can be made part of the recommendation to establish the noise
level prior to construction and then monitor on a regular basis.
Comm. Peirce asked if the parking spaces were on the leased lot. Mr. Weber stated
that the leased land is on a ten-year lease with first right of purchase. He indicated
that the leased land included five parking spaces and the boat repair area, a 29' x 25,
fenced area.
Comm. Chiu asked if the manufacturing operations would start at 7:00 a.m. Mr. Weber
said probably between 7 and 8 a.m., dealing with a lot of fiberglass construction, but
the noise level should not increase due to the four-hour walls and, if necessary,
soundproofing.
Comm. Chiu asked if the Air Resources Board will have to approve the application since
you have a dust collection system. Mr. Weber said that is the State Board of Safety
and Welfare; the Air Resources Board will be involved.
Robert Boyce, 49 7th Street, said the surfboard people have gone through many trials
and tribulations, and find it is impossible unless the wholesale, retail, and repairs
are under one roof. He said this establishment will fall under OSHA safety laws, and
is the only attempt to give Hermosa Beach a complete sporting goods store. He thinks
it is much needed in the community.

Motion by Comm. Burt, seconded by Comm. Rosenberger, to approve subject to conditions:
a. Adequate ventilation according to State standards.
b. Four-hour exterior walls with insulated openings.
C. A sprinkler system affording one hundred per cent (100%) protection.
d. Adequate provision for material and trash storage within the building.
e. Adequate noise suppression systems to keep any noise emission to within two (2)
db of the ambient noise level.
f. A dust collection system totally enclosed within the building.
and subject to conditions established in Section 801 (A) (2) (c); approval of signs
and building exterior by the Hermosa Improvement Commission; and maintenance of ten
off-street parking spaces, five on premises and five within 300 feet of the subject
property.
Chmn. Collis asked the applicant if he would be willing to make a copy of the signed
lease a part of the findings to satisfy the requirement for parking. Mr. Weber agreed.

Motion by Comm. Rosenberger, seconded by Comm. Chiu, to adopt Resolution P.C. 154-966
approving the request of D. Weber for a Conditional Use Permit in order to provide
manufacturing in conjunction with a retail business, subject to the conditions listed
in the motion above. The use is consistent with the zoning and it is determined that
this has a highly favorable recommendation from the Planning Commission as it is the
kind of business we would like to encourage in the City.

AMENDMENT #6
Mr. Berl gave a brief review of Amendment #16. Comm. Rosenberger and Hough suggested
adding parklncj to the amendment and resolution as noted in the minutes of the April
22 meeting. ("The sentence on page 2, 'the pending bikeway and transit elements will
supplement the proposed system' should be expanded to include parking, and that similar
wording should be added to the resolution.")

Richard Foxx, 621 Gould Terrace, asked if Gould is a collector street with one lane
east and one lane west from Ardmore to Pacific Coast Highway. Chmn. Collis replied
that it is, as enacted when the homeowners came in and changed the concept of Gould
from arterial to collector.
Joan Bertossi, 629 Gould Terrace, said that a number of residents of Gould had left
their addresses and telephone numbers and requested to be notified of further hearings
so that they would be able to look at the plan. Comm. Rosenberger believed this to
refer to the design plan, which is not being considered at this time.
Chmn. Collis requested a report from staff as to the intentions of the state in
installing signals; whether they will have a left turn arrow both north and south from
Gould; and would like to have this by the next meeting.

Motion by Comm. Hough, seconded by Comm. Chiu, to approve with the reference to parking
added to page two. Comm. Rosenberger added a correction on page two, inserting the
words "per day" after the figure 17,000.

Motion by Comm. Hough, seconded by Comm. Burt, to adopt Resolution P.C. 154-967
recommending adoption of Amendment #6 to the General Plan of Hermosa Beach. Numerous
hearings have been held and the proposed changes reflect the concerns of the citizens,
and represent lengthy discussions and hearings on the part of the Planning Commission.
Add two corrections stated above.

PROPERTY EXCHANGE
Request of J. Wise to exchange Lot 23 for Lot 24 in Block 13, Hermosa Beach Tract.
Mr. Merl said this project involves a trade of land of comparable size along the
north side of Pier Avenue. Currently the walkway is owned by the City and is vacant.
Adjacent to it are two 30' lots. Mr. Wise wants the walkway to go between the two
lots to facilitate design of a plaza with approximately fifteen stores. A drawing of
the proposed plaza was shown. The walkway would be landscaped and provided with a
bell tower with clock affixed, and dedicated to the City. The Board of Zoning Adjust-
ments has approved, and the City Council has conceptually approved with provision
that it is to be subject to approval of the Planning Commission.

Jack Wise, 542 Strand, said the project will be named Loreto Plaza, based on the
Sister City program. The bell tower will be a replica of the one in the mission of
Loreto, the first capitol of California. This idea was presented to the Chamber of
Commerce and the Downtown Businessmen who recommended the lot exchange as it will
create use of the downtown parking lot. The plaza will have small shops with Mexican
motif similar to Olvera Street.
Comm. Rosenberger asked if the 64' coverage of the middle lot mentioned in the Environ-
mental Impact Report refers to the bell tower. Mr. Wise said there are two bridges
involved and marquee banisters. He said he hopes to have the project started by late
September and would like to have it completed by Christmas, but that would be difficult.
Chmn. Collis asked whether it is necessary for the City to grant air space rights to
connect the two buildings overhead. He said the project is worthy of approval and a
way in which the City can work with private citizens to augment and improve the public
area.
Comm, Chiu asked whether there have been any appraisals of land value, whether the
conveyances include the underlying mineral rights, and what rights the City holds on
the walkway. Mr. Wise said there have been no appraisals, that it would be an even
exchange except for the fact that the lot he receives will have an unsupported wall
that will reduce the lot size from 30' to about 281-1011, and that the City would
receive title -free property.

Motion by Comm. Burt, seconded by Comm. Hough, to approve the request for lot exchange,
subject to the favorable opinion of the City Attorney regarding the exchange, and
subject to the applicant absorbing all costs involved in.the exchange and delivering
title to Lot 23, Block 13, Hermosa Beach Tract to the City free and clear of all con-
ditiions and encumbrances.

Motion by Chmn. Collis, seconded by Comm. Rosenberger, to adopt Resolution P.C. 154-968
granting the request of Jack 0. Wise to exchange Lot 23, Block 13, Hermosa Beach Tract
for Lot 24, Block 13, Hermosa Beach Tract (city walkway between Pier Avenue and parking
lot C), subject to conditions as stipulated in the above motion.

REVISED SIGN REGULATIONS
Proposed revisions to the sign regulations of the City, setting out as separate regu-
lations, and revising requirements.
Comm. Rosenberger noted that recommendations made in the workshop meeting, April 22,
have not been included. Discussion resulted in the following recommended changes:
1. page 3, under Improvement Commission, (c) The sign is in harmony with the pro-
posed development (within) the general area. (delet.-_ within and substitute "and").
2. Add to addendum: Restrict signing to no more than 20% of the window area. Add
to Item G .
3. 7-44 D. Add "limit total number of ground signs per business regardless of the
lineal footage to two." Second paragraph: change "four (4)" to "two (2)" square
feet of sign area for each foot above the nearest adjacent public sidewalk with
a maximum of 125 square feet.
Chmn. Collis requested that Comm. Rosenberger work with staff to have revisions included
in the proposed sign ordinance.
Comm. Hough recommended that the Planning Commission obtain information on speed cri-
teria pertaining to signs, and requested that the proposed revised Sign Ordinance be
retyped with corrections and additions. She also suggested that the sign footage as
related to height above the sidewalk should be related to height above grade.
It was suggested that the necessary changes be made in the subcommittee meeting
Monday, 3:30 at City Hall.
Motion by Chmn. Collis to continue to next regularly scheduled public hearing, and
that the subcommittee include Comm. Chiu's recommendations for requirement of a bond
to insure that temporary signs would be removed after use.

Review of Conditional Use Permit C-71-1 (Zeppy's) issued to 1318 Strand subject to
conditions, to determine whether failure to meet conditions warrants re -hearing.
Comm. Hough referred to Condition 1. of the Resolution P.C. 154-798 and asked why
the business license was issued before the conditions was met. She recommended
revocation of the Conditional Use Permit at least temporarily. Chmn. Collis recom-
mended revocation. He said there was no reason to grant a continuance since Mr.
Altamura did not come before the Commission at this meeting.
Mr. Merl said he would,direct an immediate notice to the Business License Commission
regarding issuance of the business license before the conditions were met as approved
by the Planning Commission.
Motion by Comm. Hough, seconded by Comm. Chiu, to revoke the license immediately, to
terminate the business and to request a complete, detailed chronological report as to
why the business license was issued before the conditions were met.

NOTE
Noise level of the Hermosa Car Wash was discussed. Mr. Merl suggested a review of
the Resolution to determine whether the noise level was a condition, and research as
to the actual noise level.
Chmn. Collis asked that this be on record as a concern to the. -Planning Commission, and
if no db rating was required, something should be done to correct this oversight.
REQUEST
The Downtown Merchants request Planning Commission to set a public hearing for change
of zone on the Biltmore Site from C-1 to C-2 at the next public hearing meeting on
June 10, 1974. Information will be presented at the workshop meeting May 28. C-2
would allow a restaurant or hotel -motel. They do not want an apartment, which is
allowable under C-1. Chmn. Collis directed that it be scheduled for workshop on May
28, and public hearing on June 10.
City Clerk Barbara Fleming directed a letter to the League of California Cities en-
dorsing the Resolution P.C. 154-957 requesting their seminar as an annual event.
Comm. Rosenberger reported on the Saturday walk in the area north of Valley Park and
noted that there were many homes on the court streets that were up for sale. Mr. Merl
offered to obtain a map of the turnover of property to show the pattern of sales in the
City.

Comm. Rosenberger suggested the possibility of making 27th Court one-way and bar off
at the top to make it a parking street to reduce the traffic hazard at the five
corners. Mr. Merl said the City Engineer will propose this at the next Council
meeting. Comm. Hough suggested leaving a section open -for bicycles.
