Meeting called to order by Chairman Rosenberger at 7:38 p.m. ROLL CALL Present: Comm. Burt, Haller, Hough (arrived late), Peirce, and Chmn. Rosenberger Absent: Comm. Chiu and Collis APPROVAL OF MINUTES Motion by Comm. Burt, seconded by Comm. Haller, to approve the minutes of the meeting of September 23, 1974, as submitted. Ayes: Comm. Burt, Haller, Peirce, and Chmn. Rosenberger Noes: None Absent: Comm. Hough, Chiu and Collis Motion by Comm. Haller, seconded by Chmn. Rosenberger, to continue the minutes of the subcommittee meeting of September 30, 1974. So ordered. APPROVAL OF RESOLUTION Motion by Comm. Burt, seconded by Comm. Haller, to approve Resolutions P.C. 154-986 and 154-987 as submitted. Ayes: Comm. Burt, Haller, Peirce, and Chmn. Rosenberger Noes: None Absent: Comm. Chiu, Collis, and Hough DETERMINATION OF LEGAL USE 2142 Circle Drive and 2147-2142 Monterey Mr. Merl stated that on the basis of the Building Department's review and analysis of records and results of inspections, the Department was recommending approval of four units with the proviso that the driveway to the former garage on Monterey be removed and a normal curb be constructed. Comm. Hough entered at 7:44 p.m. In answer to a question by Chmn. Rosenberger, Mr. Merl stated that this was before the Commission because the property is up for sale. Public hearing opened at 7:45 P.M. Ella Goetz, representing Mrs. Verena Jesshope, stated that the property had three units and a single family dwelling and that taxes had been paid for four units since August 25, 1955. The property was owned by a Mr. Coffin 72 years prior to that and no building records were available. No one else wished to be heard. Public hearing closed at 7:48 p.m. The Chairman reviewed the proposed ordinance regarding inspection at time of sale. PLANNING COMMISSION MINUTES - October 15, 1974 Page 2 Motion by Comm. Peirce, seconded by Comm. Burt, to approve 2142 Circle Drive, 2147, 2149 and 2149z Monterey Boulevard (Lot 6, Block 63, 1st Addition to Hermosa Beach Tract) as four units and one garage, subject to the driveway to the former garage on Monterey being removed and a full height curb being installed in accordance with City Engineer's standards, and the Commission finds that this particular property was converted without a building permit. Ayes: Comm. Burt, Haller, Hough, Peirce, and Chmn. Rosenberger Noes: None Absent: Comm. Chiu and Collis 1892 Manhattan Avenue - 1838 Palm Drive Mr. Merl stated that on the basis of the Building Department's analysis, the Department is recommending approval of three legal units with nonconforming parking. Comm. Peirce asked for clarification of the first paragraph on page 2 of the Building Inspector's report. The Building Inspector, Mr. Clavell, explained that the way the building was constructed, all the owner had to do was add a door leading down to the kitchen and add the kitchen to make another unit. Public hearing opened at 8:00 p.m. Josephine Adamson stated that she had purchased the property on March 18, 1971. She submitted copies of several documents verifying that she had purchased the property as three legal units in good faith. She presented and read three letters from her neigh- bors in favor of the approval of the three units. The letters were from Mr. Browning, Jane Williams, and Dr. Gerald Hadaman. She stated the property was not for sale. Mr. Merl stated that there was a letter in opposition from Mr. Lawton. He read the letter dated October 13, 1974, addressed to the City Planning Commission. Public hearing closed at 8:19 p.m. Comm. Peirce said the two units were constructed and inspected and then were converted to three units. Later the owner applied for a business license for three units. Motion by Comm. Burt, seconded by Chmn. Rosenberger, to approve three units existing on property at present time at 1839/1839-B Manhattan Avenue and 1838 Palm Drive (Lot 17, Tract 1132) as a legal nonconforming use and that the City contact Mrs. Adamson in the near future to straighten out the latest business licence. Ayes: Comm. Burt, Haller, Hough, and Chmn. Rosenberger Noes: Comm. Peirce Absent: Comm. Chiu and Collis Comm. Hough stated that she appreciated Mrs. Adamson's cooperation. 115Z Ninth Street(re-hearing) Mr. Merl said the Commission originally heard this application for recognition of a duplex on July 8, 1974, and voted to deny it as the Commission felt there was inadequate evidence to substantiate the claim. City Attorney has recommended that the application be reheard. Mr. Merl then gave a brief resume of the application. PLANNING COMMISSION MINUTES - October 15, 1974 Page 3 In answer to a question by Comm. Haller, Mr. Merl stated that the only document being added was the document from the County Assessor's office. It is assumed that it was a physical inspection by the Assessor's office. Public hearing opened at 8:40 p.m. Tim Bauler, 20535 Oak Street, Lomita, stated he spent a lot of time trying to communi- cate with the owner. The property was bought and sold as a duplex in 1954. The present owner has had the property for 2 or 22 years. The property is before the Commission because of a potential sale. One letter was presented from James 0. McDonald, 1230 Ninth Street, stating the property had been a duplex prior to 1956. Public hearing closed at 8:45 p.m. Motion by Comm. Burt, seconded by Comm. Hough, to approve as legal nonconforming struc- ture the duplex at 1157 Ninth Street (Lots 16 and 17 and the East z of Lot 15, Block 144, Redondo Villa Tract) subject to the owner filing an appeal with the Board of Appeals concerning the substandard building height; said approval is conditioned on subsequent approval of the condition referred to. Ayes: Comm. Burt, Haller, Hough, Peirce, and Chmn. Rosenberger Noes: None Absent: Comm. Chiu and Collis 944 21ST STREET Planned Development application for four single family residences (townhouses) on Lots 39-40, 68-70 of Tract 1965, 944 21st Street. Mr. Merl pointed out the drawings of the plot plan for this development which were dis- played on the Board. Mr. Merl read the Department's analysis. Public hearing opened at 8:58 p.m. Mr. Louis Graziadio, 414 Second Street, Hermosa Beach, stated that he was the developer. In answer to a question by Chmn. Rosenberger, Mr. Graziadio stated that there would be six foot screen fences between the patios. Chmn. Rosenberger requested that the large shrubbery and tree on this vacant property be donated to the City. Mr. Graziadio had no objections provided the City would make the removal. It was determined that the City had the equipment with which to make said removal. In answer to a question by Chmn. Rosenberger, Mr. Graziadio stated that the units would have forced air gas heat. Mr. Bill Wyncock, 420 North Grand Avenue, Santa Ana, stated that he was the architect and that he would answer any questions that the Commission had. The developer and architect were commended by the Commission for their innovations in the design of the development. Mr. Wnycock advised Comm. Hough that a time table for construction was not available at this particular time. Harold Roberts, 2014 Hillcrest Drive, stated that he was not aware of this development being considered by the Improvement Commission. He suggested that the residents be notified in the same manner that they are notified of the Planning Commission meeting. Comm. Burt suggested that the residents be notified on one postcard. PLANNING COMMISSION MINUTES - October 15, 1974 Page 4 Public hearing closed at 9:10 p.m. Motion by Comm. Hough, seconded by Comm. Peirce, to approve the Planned Development for four single family residences (townhouses), subject to the recommendations of staff that the permit be issued to the applicants and not be transferrable without the Planning Commission's review and approval, and that all landscaping shown on the approved plans be accomplished before final inspection approval, and that the applicant give the Commission a reasonable construction timetable, and further that the City make every effort to salvage the existing shrubs and one tree for its own use. Ayes: Comm. Burt, Haller, Hough, Peirce, and Chmn. Rosenberger Noes: None Absent: Comm. Chiu and Collis Motion by Comm. Hough, seconded by Comm. Haller, to adopt Resolution P.C. 154-988 approving the request for Planned Development to permit the construction of four single family dwellings (townhouses) on Lots 39-40, 68-70 of Tract 1965, known as 944 21st Street, and that the Commission makes the following findings: 1. The preliminary plan conforms to the General Plan, 2. The character of the proposed development is desirable and will promote stability, 3. Sufficient driveway widths are provided, 4. The development will not impose a burden on access traffic facilities, and increased densities will not generate traffic in such amounts as to overload the street network outside the proposed development, 5. The proposed development is not out of harmony with its surrounding neighbor- hood, 6. A satisfactory time table of construction to be submitted, 7. Provision has been made to provide adequate ingress for fire fighting equipment, 8. The Environmental Impact Report is adequate, the environmental impact will not be significantly negative; and subject to the applicant donating the shrubs and one tree to the City, and pointed out that the applicant has a good design and a good use of land and the leaving of open space. Ayes: Comm. Burt, Haller, Hough, Peirce, and Chmn. Rosenberger Noes: None Absent: Comm. Chiu and Collis At 9:15 p.m. the Chairman called for a recess. The Commission reconvened at 9:25 p.m. with all members present except Comm. Chiu and Collis. 2463 PAC IF iC COAST H IGHUAY Request for Conditional Use Permit for a pottery kiln in conjunction with retail sales at 2463 Pacific Coast Highway (C-74-19). Mr. Merl presented the staff report on the request for Conditional Use Permit for a pottery kiln in conjunction with retail sales at 2463 Pacific Coast Highway and recom- mended approval subject to the approval of the Fire Department and quarterly inspections of the kiln and to limit hours of kiln operations to 10 a.m. - 6 p.m., Monday through Friday. PLANNING COMMISSION MINUTES - October 15, 1974 Page 5 Comm. Hough questioned the hours of operation for the kiln. Chmn. Rosenberger ques- tioned the parking requirements. Mr. Merl stated that it was considered manufacturing and that three spaces would be required. Public hearing opened at 9:30 p.m. Patti Scales, 2604 Walnut, Manhattan Beach, stated that she would manufacture the pottery in the back and that the kiln would be used only by her. In reply to a question by Comm. Hough, Mrs. Scales stated that she would not conduct any classes. The retail sales will be art objects and ceramics and pottery that is manufactured in the back. Sidney Croft, attorney representing Mr. and Mrs. Frater, 1611 South Pacific Coast Highway, Redondo Beach, stated that Mr. and Mrs. Frater owned the Sea View Inn and that they objected to the proposed commercial use because it would increase parking in the area. The Sea View Inn does not want the customers parking in their parking spaces. Mr. Croft pointed out that there was not enough parking for the businesses in that area now and that the area had been poorly planned; therefore, the Commission should not consider adding to the parking burden. Comm. Haller pointed out that the Sea View Inn had separate parking. Mr. Croft pointed out that there would be delivery trucks coming in and out at all hours of the day. Mrs. Scales stated that she picked up a lot of her materials rather than having them delivered, and that there would be very little delivery at the site. Once again, Comm. Hough inquired who would be using the kiln. The applicant advised that she would be using the kiln and one other person who rented the kiln on Fridays; however, it was still just one person using the kiln on Fridays. Public hearing closed at 9:41 p.m. Motion by Comm. Hough, seconded by Comm. Haller, to approve the request for Conditional Use Permit for a pottery kiln in conjunction with retail sales at 2463 Pacific Coast Highway, subject to approval of the Fire Department and quarterly inspections of the kiln; limit hours of kiln operation to 10 a.m. - 6 p.m., Monday through Friday; that there be no additional activities such as classes, no more people using the kiln, and if more people are to use the kiln that it require Planning Commission review; that no kiln time be rented out, that the applicant does not make the renting of kiln time her business; and that there be a six month review. Ayes: Comm. Burt, Haller, Hough, Peirce, and Chmn. Rosenberger Noes: None Absent: Comm. Chiu and Collis a PACIFIC COAST HIGHWAY Review of Conditional Use Permit (C-74-3) for sale of alcoholic beverages at 530 Pacific Coast Highway (Ninth Wave) . Mr. Merl presented the up -dated staff report and stated that the applicant had not done any of the items required. PLANNING COMMISSION MINUTES - October 15, 1974 Page 6 In answer to a question by Comm. Haller, Mr. Merl stated that there had been no input on the widening of the driveway. Comm. Haller stated that she had personally Inspected the property and had found the area to be quite littered with trash and that as far as she could determine, none of the requirements had been accomplished. Public hearing opened at 9:46 p.m. John Bernatt, 717 Pacific Coast Highway, stated that he was the manager of the business and that he had paid a "kid" to clean up the place right after the first hearing. Comm. Hough inquired about the two lights that were to be installed. Mr. Burnatt stated that he did not have any written notice that the lights had been installed, just that he had been told it had been done. As for the driveway, Mr. Burnatt stated that the City had never done an engineering report. In answer to a question by Comm. Peirce, Mr. Burnatt stated that the building was thirty years old and that it was not worth the cost of the curb cut. He further stated that if the curb was widened, the building would have to be widened. Mr. Burnatt stated that the building was leased from the Lease Auto Parts place. Chmn. Rosenberger pointed out that there was not only the problem of widening the driveway, but the problem of trash cleanup, lighting, and just general overall main- tenance of the building and the grounds. Mr. -Burnett stated that the back of the building was no trashier than the back of the auto parts place and Pacific Coast Highway itself. Public hearing closed at 9:56 p.m. Comm. Burt inquired if the applicant would be interested in considering a curb cut if the Commission allowed a two weeks extension. Mr. Burnatt stated he would consider it, however, the curb cut would eliminate two parking spaces on Pacific Coast Highway. Motion by Comm. Burt, seconded by Comm. Peirce, to continue the review of Conditional Use Permit for the sale of alcoholic beverages at 530 Pacific Coast Highway (Ninth Wave), in order that the applicant may consider widening the driveway, trash cleanup, and installation of the two lights. Ayes: None Noes: Comm. Burt, Haller, Hough, Peirce, and Chmn. Rosenberger Absent: Comm. Chiu and Collis Motion by Comm. Haller, seconded by Comm. Burt, that .the Conditional Use Permit for sale of alcoholic beverages at 530 Pacific Coast Highway (Ninth Wave) be revoked. Ayes: Comm. Burt, Haller, Hough, Peirce, and Chmn. Rosenberger Noes: None Absent: Comm. Chiu and Collis It was noted by the Commission that the applicant had appeared before them three times and that the reason for revoking the permit was because the applicant had failed to accomplish the installation of the lights, elimination of the trash, and widening of the driveway. Chmn. Rosenberger advised Mr. Burnatt that this matter was subject to appeal to the City Council. CITIZENS` ADVISORY COMMITTEE ON HOUSING PROPOSED ORDINANCE Comm. Hough stated that the proposed ordinance was discussed at the meeting and that the minutes will reflect that basically everyone was in agreement. In answer to a PLANNING COMMISSION MINUTES - October 15, 1974 Page 7 question by Comm. Peirce, Mrs. Ebey explained that only the property owner could get information from the County Tax Assessor. Public hearing re -opened at 10:07 p.m. Mr. Grippo stated that the County Counsel was presently reviewing the availability of property records from the County Assessor's office. He stated that the tax billing was available to the City; however, this does not clearly show the number of units. Mr. Richard Albertson, 2467 Myrtle, stated that he was the Chairman of the Housing Committee and he strongly recommended that the Planning Commission give serious con- sideration to recommending approval of the proposed ordinance to the City Council. He explained that the proposed ordinance was a step forward to the future for the City and that if the ordinance was not adopted by the Council, the bootleg apartments would con- tinue to grow and not decrease. Mr. Albertson explained that no one wants to invade his neighbor's privacy and that provision is to be eliminated from the ordinance. He stated that the proposed ordinance was a result of input from the citizens of the com- munity and that the citizens have joined together for paramount rights. Public hearing closed at 10:19 p.m. Mrs. Ebey stated that the proposed ordinance would go once more for a public hearing before the Board of Zoning Adjustments and then the City Attorney will review the entire ordinance. Comm. Hough mentioned that the letter that would go to the property owners maybe should be an addendum to the ordinance, or at least some indication of how the letter will be worded should be attached to the proposed ordinance. Mrs. Ebey stated that it was a voluntary response and that the City was asking for the property owner's cooperation. Comm. Hough stated that if the ordinance was adopted that she definitely wanted adequate and available staff to enforce the ordinance. Chairman Rosenberger stated that there were two areas of concern, i.e., the letter that is to go to the property owners and the land use survey. He further stated that there were more areas of agreement than that of disagreement and that the disagreements were not unsurmountable. Motion by Comm. Hough, seconded by Comm. Burt, to send these various proposals and comments, and suggestions and recommendations to the City Council and the City Attorney. Ayes: Comm. Burt, Haller, Hough, Peirce, and Chmn. Rosenberger Noes: None Absent: Comm. Chiu and Collis REVIEW! OF PROPOSED RECONSTRUCTION OF VALLEY VISTA SCHOOL Mr. Merl presented the staff report dated October 15, 1974, Mr. Tom Mattor, AIA, was present to represent the School Board, Comm. Haller stated that the air conditioning in the beach area seemed unnecessary and perhaps this should be reviewed. Comm. Peirce questioned the removal of all windows in the classrooms. Mr. Mattor pointed out that the School Board felt that it was more feasible to have no windows than it was to have windows and so much vandalism. Comm. Peirce stated he would like to have the matter resubmitted to the School Board to reconsider the opening of windows and to evaluate if there really was that much vandalism in that particular area. PLANNING COMMISSION MINUTES - October 15, 1974 Page 8 Comm. Haller noted that the enrollment had increased and she inquired what would happen to those children over the 350. Mr. Mattor stated the school could handle 350 and the extra students would go to Pier Avenue, Mr. Mattor stated that there was an eight month construction plan for the school building. Motion by Comm. Haller, seconded by Comm. Peirce, that the comments of the Commission be submitted by letter to the Coastal Zone Commission and the School Board. Ayes: Comm. Burt, Haller, Hough, Peirce, and Chmn. Rosenberger Noes: None Absent: Comm. Chiu and Collis REPORT FROM ZONING SUBCOMMITTEE Motion by Comm. Burt, seconded by Comm. Haller, that a public hearing be scheduled for the next meeting (October 28) for modification of Amendment #9 to the General Plan; and the rezoning to uniform C-2 the south side iof 15th Street between Hermosa Avenue and the Strand. Motion carried unanimously. (Comm. Chiu and Collis absent) TENTATIVE TRACT MAP #30694 Request for a one-year extension of Tentative Tract Map #30694, Condominium conversion at 1600 Ardmore. Motion by Comm. Peirce, seconded by Comm. Hough, to deny the request for one-year extension of Tentative Tract Map #30694 (Condominium conversion at 1600 Ardmore) as it is in conflict with the General Plan, with the current zoning ordinance, and in conflict with the current condominium ordinance. Motion carried unanimously. (Comm. Chiu and Collis absent) LETTER FROM CHAMBER OF COMMERCE ON PROPOSED SIGN ORDINANCE Chmn. Rosenberger suggested a City ordinance to set up a refundable fee of $50 or $100 which must be paid at the time of obtaining permit and the fee be refundable upon com- pletion of approval of the signs. He stated that this aright be the enforcement process to gain compliance by the local businessmen. Mr. Merl stated that the City Attorney should determine this. Comm. Hough stated that there were no regulations in the R-P zone. Motion by Chmn. Rosenberger, seconded by Comm. Peirce, that the sign ordinance with suggested staff modifications be referred to the City Council with suggested language for corrections. Motion carried unanimously. (Comm. Chiu and Collis absent) DEVELOPMENT COMMITTEE REPORT The Chairman, appointed Comm. Hough to schedule a meeting. COMMISS ONERS' NEW BUSINESS_ Chmn. Rosenberger requested that a meting be scheduled with the Board of Zoning Adjust- ments for 7 p.m, on the first Monday in November. Comm. Haller passed out the C.C.&R's. Mr. Merl reminded the Commission of the League of California Cities meeting. PLANNING COMMISSION MINUTES - October 15, 1974 Page 9 Mr. Merl mentioned that Councilman Widman invited the Commissioners to participate in a college study group meeting on Friday night in Inglewood to discuss planning. The meeting will be at 8 p.m. R-1, R-2, AND R-3 ZONING AMENDMENTS To be considered at the next meeting. AMENDMENT OF THE COMMERCIAL. PLANNED DEVELOPMENT ORDINANCE To be considered at the next meeting. LEGAL DETERMINATION Final approval of Legal Determination of 500 Manhattan Avenue/501 Bayview Drive. Motion by Chmn. Rosenberger, seconded by Comm. Hough, to reapprove the previous action on 500 Manhattan Avenue and 501 Bayview Drive. Mr. Merl stated that the City Attorney has approved this. Ayes: Comm. Burt, Haller, Hough, Peirce, and Chmn. Rosenberger Noes: None Absent: Comm.
