R-1 FINAL APPROVAL OF ZONING AMENDMENTS
Mr. Merl said the Board of Zoning Adjustments has approved the Environmental Impact
Report, so the proposed amendment is before the Planning Commission for final approval
before being sent to City Council.
Motion by Comm. Hough, seconded by Comm. Burt, to approve Resolution P.C. 154-1000 and
to send to City Council for final action.

Mr. Merl said this is a six-month review of Conditional Use Permit for alcoholic beverages
as required by the Commission. He passed out to the Planning Commission a review of the

conditions. He said the City Manager has received complaints concerning maintenance of
the trash bin to the rear of the establishment and wishes it to be maintained in a more
orderly manner in the future.
Mr. Art Splawn said four businesses use the trash bin, which is emptied twice a week; he
and his partner have cleaned it up several times.
Comm. Hough asked if they are serving hot meals, since one condition was to phase in hot
meal service within six months. Mr. Scott said they are serving hot sandwiches; they have
the kitchen put in but have yet to put in the hot meal.
Chmn. Rosenberger said a staff report shows that games which were discussed and games that
they had not intended to install have been installed. Mr. Scott said they were under the
impression that they had a six-month probation period; after that they contacted the bus-
iness license department and were told that they could install them, that the state said
they were legal machines, and that other places have them.
Mr. Merl said the City Attorney agreed that the Conditional Use Permit is basically a
contract and the state does not pre-empt in the case of a contract. He said that when he
talked with the City Attorney they were not aware of the involvement of the Licensing Dept.
Comm. Hough requested a reply to the following questions: "Can it be construed as a
violation of the Conditional Use Permit if an applicant initiates getting a license for
something that would allow them to act in violation of a condition of the Conditional Use
Permit? Who is responsible? What is the applicant's responsibility?"
Chmn. Rosenberger requested that a member of the Business License Bureau come to the
Commission. Mr. Scott said he told the Bureau that they were on a Conditional Use Permit.
Chmn. Rosenberger said he would like to have a statement from the Business License Dept.
as to their policy, and a statement from the City Attorney as to their administerial
responsibility.
Mr. Splawn asked whether they could request permission to retain the games since the state
has ruled that they are legal. Comm. Chiu said the request should be made in written form
with a description of the games, to the Planning Commission.
Motion by Comm. Burt, seconded by Comm. Chiu, to continue to the next meeting, March 24th,
to obtain the opinion of the City Attorney and the policy and procedures of the Business
License Dept.

Motion by Comm. Collis, seconded by Comm. Burt, that the existing machines currently in use
be discontinued until such time as final action is taken by the Planning Commission; and
that the applicant submit to the Planning Commission a formal request for the use, and
specification of the hypes, of game machines to be used: effective immediately.

Noes: Comm. Peirce, as he does not feel it is fair to punish the applicants for
the city's dereliction of duty.

Six month review of Conditional Use Permit for take-out food. Comm. Haller said the large
Pepsi sign painted on the side of the building is still there. Chmn. Rosenberger suggested
sending a memo to the Imp rovenie n t Commission asking them to meet with the applicant. COMM.
Hough recommended sending the letter first sent to the City Council August 26, 19Y44%
requesting that the City Council look into the matter that the neighboring businesses are
not complying with the sign ordinance nor cleaning up the Strand, adding that this matter
has again come to the attention of the Planning Commission because of the review of Perry's
Pizza. Mr. Merl said this raises the question as to who is responsible for signs left by
a previous business.
The Commissioners discussed the possibility of a routing slip to accompany every application
made to the city departments, on which every department vo uld sign that the property or
business was in compliance with existing codes and ordinances, to be completed before the
Licensing Department can grant a business license. Comm. Hough requested that staff inquire
of the City Attorney whether this can be done.
John Altamura, 813 llth Street, Manhattan Beach, said all his signs have been taken down
in front of the store, and one sign in the front has been repainted; the sign painted on
the building is still there. He said the Improvement Commission is in unanimous agreement
that his is the only beach concession stand from 13th to Pier that does not have a sign
displaying his product, and they said they would try to do something to have the other store:
take their down also. He said he cannot afford to paint the building and cannot be held
responsible for a sign put up before he was there. He said when the City filled in the
open spaces in the Strand wall„ the landlord of his building +,vas not notified, but the
third owner back. He said he wrote in December to the city asking for the opening in front
of his building be restored. Mr. Merl said he has reported this to Ed Putz, City Engineer
and the Planning Department has no objections. ,
Motion by Comm. Hough, seconded by Comm. Burt, to continue the Conditional Use Permit in
effect with review scheduled for the second meeting in July or the first meeting in August.

Mr. Altamura suggested that all Strand businesses on Conditional Use Permit be asked to
attend the same meeting.
Chmn. Rosenberger ordered that the letter be sent to the City Council as outlined above.

Six-month review of Conditional Use Permit for surfboard manufacturing. Trash bin in the
rear has not been enclosed.
Ed Talbot, 916 Aviation Blvd., said the Fire Chief told him to get a lid on the trash bin;
there is an enclosure which is not being used because it is inconvenient for pick-ups, how-
ever, he said he would use it. Mr. Talbot has a letter, dated February 25, from the
sprinkler company, is in the process of obtaining a sprinkler system although the contract
has not been signed yet, and has had the plan for the system approved by Chief Fowler. He
asked if he should come before the Planning Commission again for approval when the sprinkler
is in and he is ready to glass.
Mr. Merl said he has already been approved for this type of manufacturing, and needs only

the approval of the Fire Department; but if he rents storage space it must have the
approval of the Planning Commission. Mr. Talbot said he will be using that space.
Motion by Comm. Hough, seconded by Comm. Collis, to continue Conditional Use Permit
for one year.

INTERPRETATION OF ZONING CODE
Mr. Merl said the applicant, Mr. Berggren, has three lots 30 x 80 in an R-3 zone and is
requesting permission to build to R-26 standards.
Comm. Collis said R-213 was established for Strand property from 15th to 22nd Streets with
no requirement for open space because there is 100 yards of open beach, in order to
encourage single family dwellings. He said they were expected to be basically single-
family with supplemental rental units•in order to help defray expenses, and required two
lots or agreement of the neighbor.
Mr. Merl said R-2B allows larger units, zero lot line, and requires no open space; setbacks
are 5' as opposed to 0' in R-3. Comm. Peirce noted that no building can exceed a height
equal to the width of the lot, therefore the buildings could not exceed 30'.
Comm. Chiu asked if the Planning Commission follows the same standards every time this
matter arises; or if there are no standards, should there be. Comm. Burt said the
Zoning Subcommittee is considering a standard allowing building to a lower zone requirement
if they meet the specifications of that zone.
Motion by Comm. Haller, seconded by Comm. Hough, to continue to get testimony from Mr.
Berggren, until first meeting in April.

Mr. Merl said this is a continued public hearing; the Board of Zoning Adjustments has
declared the item environmentally significant and the City Attorney has required findings.
Ile said.the reasons given have to be investigated for a full Environmental Impact Report
and set for public hearing; and they have to be related to the Environmental Quality Act.
Staff recommends continuance to await information from the Board of Zoning Adjustments.

with a chart.
page 22. Add words "ACTUAL DEMOLITIONS" and change to Figure 3.
page 23. Add words "Based on actual building permits. (i.e., completed)" and
change to Figure 4. Comm. Peirce suggested respacing of the graphs
or use dividing lines for clarity.
page 24. Tract 6211. Correct to 3,552.
Chmn. Rosenberger asked if the building units completed were to be
based on 1960-1970 figures, as on page 21, or on 1965-1970. Mr.
ODell said he would check.
page 27. Eliminate paragraph 2 (two lines above, and four• -lines below, Table 7.)
page 39. Mr. ODell said he rewrote paragraph 2: The Hermosa Beach vacancy rate
in 1960 was 7.1%. The Hermosa Beach vacancy rate for 1970 was 5.3%.
Decrease in Hermosa Beach vacancy rate of 1.3%, 1960 to 1970, moving Hermosa
Beach closer to the 4% balance figure. However, with a 5.3% vacancy
rate, or 50 out of every 1,000 dwellings vacant, that could mean that
on any given day, Hermosa Beach would have approximately 400 vacant units.
page 44. Mr. ODell suggested that they strike the last line of paragraph 2.
page 45. Comm. Haller suggested eliminating the last sentence commencing "The
higher value should allow...."
page 45a. 2. Correct to: "Average % of increase in cost of renting"

Comm. Peirce said he would like to see a more detailed survey, not of the use, but the
conditions of smaller areas rather than by census tracts. Chmn. Rosenberger said the
document should contain a work program spelling out goals and actions indicated by the
statistics and directed toward specific areas of the town to meet specific prevailing
conditions. Comm. Hough said none of the elements show any statistics or reports on the
type of people who live in Hermosa Beach and their living patterns; what they expect of
their community is related to housing and the other elements. Mr. Merl said the Social
Services Element will require a needs assessment to find out what services are needed,
and which of them are available.

Mr. ODell suggested that they first come into compliance with the law, get the compulsory
things done and then immediately start on the General Plan again. He said the bank of
information being accumulated will be a springboard for programs, but perhaps a total
specific program should not be developed at one time with only the information presently
available.
Motion by Comm. Peirce to adopt the Housing Element with changes made on this date and
pass along to the City Council. The motion did not receive a second.
Comm. Chiu said he does not believe the document is ready to go the City Council based
upon the Commissioners' statements this evening. He said the land use element is a
culmination of Housing, Circulation, and Noise elements; they should be completed and
then return to the land use with the new input that has been learned. He suggested com-
pleting the Housing element in two parts: 1) basic data, and 2) specific uses, in
which they would need more specific wording on the types of programs being considered;
mention of the Coastal Zone Commission preliminary report and its implications for the
housing element; and mention of inclusionary ordinances utilizing density bonuses.
Chmn. Rosenberger directed that the item be continued to the next meeting which will be
scheduled to begin at 7:00 p.m. So ordered.
Comm. Hough announced that Chuck Johnson and Associates are buying the bowling alley and
lots behind it for a spa, with tennis courts, restaurant, etc. There will be a press
party on Friday, March 21 upstairs at the Lobster House between 1 and 5 p.m. There will
be a model on display. Mr. Merl advised the Commissioners that this will be an item before
them and they must avoid any pre -judgement.
SEISMIC ELEMENT (continued)
Mr. Merl presented a list of minor changes to be made to the Seismic Element, the most
important being the recommendation that the county of Los Angeles, as a part of its seismic
monitoring and research, establish and service a seismograph in an appropriate location for
the South Bay Beach Cities which share similar geologic characteristics.
Motion by Comm. Haller, seconded by Comm. Peirce, to adopt the Seismic Element with the
amendments as submitted, and forward to City Council.

Mr. Merl will write the Resolution P.C. 154-1011, which will then be sent to the Board
of Zoning Adjustments.
MISCELLANEOUS
Mr. Merl distributed a list of R-2 amendments. Comm. Haller wished to add the 30' height
limit as item #7. She also suggested, re item #4, having an average of 200 sq. ft. of
usable open space per unit but not necessarily directly accessible, with 25% on the ground
level. Comm. Peirce suggested omitting "for an upper unit".
Motion by Comm. Haller, seconded by Comm. Peirce, to adopt the proposed amendments with
addition of item #7, and correction to item #4 by omitting "for an upper unit", and set
for public hearing April 14th. So ordered.

illegal Housing Ordinance
Chmn. Rosenberger said the ordinance will be rewritten to incorporate certain procedures
and designations of substandard that include zoning as well as housing and building codes.
Second street Barricade
Mr. Merl said, in reference to the memoranda from Planning Commission to City Council, and
from the City Manager to the Planning Commission, that .the City Attorney has asked the
City Engineer to file an Environmental Impact Report. Mr. Merl has requested that the
Planning Commission have an opportunity to review the plans involved; the plans have not
been entered, so the location is not known at this time. Chmn. Rosenberger requested that
copies, when available, be sent to the people who submitted the petition.
Land Use Element
In reference to the memorandum to Planning Commission from the City Clerk on the Land Use
Element, Comm. Haller asked when this item would again be scheduled for consideration.
Comm. Peirce asked if the condominium on Second Street had been checked. Mr. Merl said he
has talked to the City Attorney, and found that the condition is not illegal; there has
been no change of ownership.
Comm. Chiu requested that staff reports follow a definite format:
1. identify the issue and why it is coming before the Planning Commission
2. facts of the issue
3. staff recommendations
Chmn. Rosenberger asked for a reminder call to Commissioners regarding the 7:00 P.M.
meeting time on March 24th.
