Burt Abstain: Comm. Loosli Comm. Burt arrived 1330-1332 STRAND - GAME ARCADE CONDITIONAL USE PERMIT Request by Gerald Mausure for conditional use permit for establishment of game arcade. Mr. Merl said the site has been used as an arcade previously; the Board of Zoning Adjustments approved the Environmental Impact Report on June 2, 1975; and he called attention to a letter from Gerald Mausure dated May 28, 1975. Public hearing opened 7:46 P.M. Mr. Gerald Mausure, 9733 S. Cicero Avenue, Oak Lawn, Illinois 60453, presented pictures of his arcade in Oak Lawn. He said he would allow no loitering, boisterous games, or food, drink or smoking on the premises. James Chilton, 424 Prospect, Newport Beach, said he has known Mr. Mausure for about 10 years, has seen his operation on the south side of Chicago, and believes he will do well in the community. Chmn. Rosenberger read a letter dated June 6, 1975, from Ray and Ann Gubser, who oppose the reopening of a game center on the Strand. Close public hearing 7:54 p.m. Comm. Haller said she feels it is not in the best interest of Hermosa Beach especially with the recommendations against it of the Downtown Committee, the comments of the Police Chief, and in line with the goals of upgrading the area. She said she would like to see a quality proposal, not a game center or bar. Planning Commission Minutes - Monday, June 9, 1975 page 3 Comm. Hough agreed, adding that she does not think the applicant is familiar with Hermosa Beach and the atmosphere on the Strand; and cannot vote yes on this project. Comm. Collis said he agrees, but for the reason that the structure was built with no particular intended use, is very limited in nature and due to inappropriate planning on the part of the property owner he is not able to get the highest and best use of that type of property. He said he would not support it in that location or in any location on the beach. Motion by Comm. Hough, seconded by Comm. Haller, to approve with the conditions listed by staff in their recommendations. Ayes: None Noes; Comm. Burt, Collis, Haller, Hough, and Chmn. Rosenberger Absent: None Abstain: Comm. Loosli Chmn. Rosenberger advised that the applicant will have ten days upon receipt of notice by the city to appeal to City Council if he desires. Motion by Comm. Hough, seconded by Comm. Haller, to adopt Resolution P.C. 154- 1033 denying the application for granting a conditional use permit for a game arcade center at 1330-32 Strand because of previous experience with police and drug problems, and neighborhood disturbances. It does not reflect the highest and best use of that location on the beach, nor fit in with the overall planning and upgrading of the down- town and Strand area. Ayes: Comm. Loosli 711 PROSPECT - PLANNED UNIT DEVELOPMENT Request by Earl Mason for Planned Unit Development for the construction of two single family dwellings on one lot. (continued) Mr. Merl said this was continued because the Board of Zoning Adjustments had not heard the Environmental Impact Report due to lack of a quorum; it has since been approved by the Board of Zoning Adjustments on June 2, 1975, and has also received approval of the Improvement Commission. He said an earlier proposal of the Eisgreens was turned down because it involved a lot split; the Commission suggested utilizing Planned Unit Development at that time. (A correction to the analysis was made to show "vehicular access off Prospect and 7th.) Public hearing opened 8:06 p.m. Mr. Earl Mason, 1826 S. Elena Avenue, Redondo Beach, said he would like to build two detached units as condominiums although this was not the primary consideration. He said an advantage to having the units separated is that there would be fewer Planning Commission Minutes - Monday, June 9, 1975 page 4 problems in common, perhaps only landscaping; however, he would set up a committee of the two owners and a third disinterested party who would probably be an attorney. He said landscaping would be a part of the completed project; and would be quite dense because of the traffic noise. He said his present intention is to live in one of the units. Public hearing closed 8:17 p.m. Motion by Comm. Burt, seconded by Comm. Hough, to approve subject to conditions enumerated: 1) submit proposed budget and fiscal projection as to cost of maintenance at time of tentative tract map 2) detailed landscaping plan with species and size of plants, all fences, walls and screening plants 3) CC &R's shall show establishment of a committee with disinterested third voting member listed, and legal procedure for designation of a new third member if necessary Ayes: Comm. Haller, to adopt Resolution P.C. 154-1034 approving the request for two -unit Planned Unit Development at 711 Prospect and that it is reasonably consistent with the General Plan; and in keeping with the neighborhood which is predominately single family dwelling, therefore, it is more in conformance than a standard duplex. Rosenberger advised that appeals may be submitted to the City Council within ten days of this action. 160-168-176 HILL STREET - PLANNED UNIT DEVELOPMENT Request by George F. Rickert for three -unit Planned Unit Development. (continued) Mr. Merl said this proposed development at the intersection of Hill Street and 2nd St. was continued due to lack of quorum in the Board of Zoning Adjustments, and has since been approved on June 2, 1975. He said this is a different area than that of the pre- viously discussed vacation on Hill Street. It has also been approved by the Improve- ment Commission. Public hearing opened 8:37 p.m. Planning Commission Minutes - Monday, June 9, 1975 page 5 George Rickert, Jr. , representing his father, George F. Rickert, said they want to upgrade the area; the units will face Hill Street and all access will be from Hill Street to 2nd Street; the seven -foot recreation area could have a community bar-b-que. He said the Improvement Commission wanted the units all alike; the Rickerts were in favor of giving them different roof colors or fabrics. Comm. Haller commented that the 26 dwelling units/acre exceeds the maximum of 14-25 dwelling units/acre; the plans show 3' side yards, 10-15 feet between units, and all three identical; she felt that three might be too many. Comm. Collis asked why the kitchen is on the second floor; Mr. Rickert replied that they are thinking of swapping floors. Chmn. Rosenberger said the packets are lacking in-depth analysis such as height, and asked when the rendering was received since the Commission received copies only tonight. Mr. Merl said it was received Friday. Cecil Wade, 1538 Golden Avenue, said in his opinion this is a move in the right direc- tion to eliminate manufacturing and restore residential use. Public hearing closed 8:49 p.m. Comm. Hough said this does not serve the intent of Planned Unit Development which is to encourage better design and better use of the land. She said this project will increase density, no landscaping is indicated, and the three units on two lots result in three-story houses on 50 x 33' lots. She said she would like to see better use of recreation and open space. Comm. Haller asked if the applicant would be willing to:revise to obtain some diversity in the three buildings, and more open space. Comm. Collis recommended increasing the 3 ft. front setback for better appearance and to give more usable area for land- scaping. Chmn. Rosenberger requested a detailed landscaping plan, or one approved by the Improvement Commission. -Mr. Rickert requested a continuance, seconded by Comm. Collis. So ordered. 628 STRAND - PLANNED UNIT DEVELOPMENT Request by Norman Newman for Planned Unit Development for a four -unit condominium. Mr. Merl said this was previously processed as an apartment house, and is now a four -unit condominium. Correct analysis to show 8 parking spaces required and 8 provided. He said the open space is on the ground; the recreation space is mostly in balconies and decks. Open public hearing 8:58 p.m. Norman Newman, 23321 S. Avalon, Carson, owner; and Richard Cooling, 205 Avenue I, Redondo Beach, architect. Mr. Cooling said they are three -bedroom units with laundry facilities enclosed. He said there is an elevator from the garage to both floors fnd tho tpe upper,dpck (roof); the height of the unit is 27-1/2' (two stories above garage wit e eva or rising 13' above the roof. He said the roof forms the railing of Planning Commission Minutes - Monday, June 9, 1975 page 6 42 ; the balconies are 11' x 19'; it has been approved by the Coastal Zone Commission; and was approved by the city as a five -unit apartment. He said they will have land- scaping and a sprinkler system but do not have detailed plans at this time. Public hearing closed 9:13 p.m. Comm. Collis said he thinks it is unnecessary to provide recreation space on the roof and the added cost unjustified as they are on the Strand, and the balconies, 4' above grade, provide privacy. He said the subterranean garage should have two sump pumps rather than one. Motion by Comm. Collis, seconded by Comm. Burt, to approve four units with the following conditions: 1) detailed landscaping plan indicating irrigation system, species and size, to be submitted at the time of the tentative map. 2) open space shown on the roof should not be required 3) elimination of elevator to the roof 4) CC&R's shall show establishment of a committee with disinterested fifth voting member listed, and legal procedure for designation of a new fifth member if neces sary 5) the Commissioners feel that 4800 sq. ft. is reasonably in conformance with the intent of the required site acreage. Chmn. Rosenberger said he would like a statement showing that consideration has been given concerning energy conservation. Mr. Cooling said they have insulated exterior walls, ceilings and floors, and interior walls; they will have gas heating. Ayes: Comm. Burt, Collis, Hough Noes: Comm. Haller, and Chmn. Burt, to adopt Resolution P.C. 154-1035 approving the request for Planned Unit Development for four units on property located at 628 Strand as the proposed development conforms to the General Plan, meets park- ing and open space requirements, and the Commission feels that the land area of 4800 sq. ft. is substantially in conformance with the intent. Two sump pumps shall be provided in the subterranean parking area; detailed landscaping plan as noted in motion above; and CC&R's shall show establishment of a committee with disinterested fifth voting member listed, and legal procedure for designation of a new fifth member if necessary. Loosli Planning Commission Minutes - Monday, June 9, 1975 page 7 837 HERMOSA AVENUE - REQUEST FOR MODIFICATION OF CONDITIONAL USE PERMIT Request by Keith & Wendy Fenner for modification of conditional use permit for beer and wine service without food, change of hours, and outside service. Mr. Merl called attention to the letter from Mr. Fenner (May 20), and the original letter from himself to the Fenners (May 14) . He summarized the request for changes as: change of hours to 11 a.m. - 2 a.m, daily, service of beer and wine without food, and service in the patio area (which is public property) requiring approval of City Council. He said a letter from Pat Brown, Building and Safety Director') dated June 6 indicated the following conditions: table and chairs on city property; living quarters located on second floor used as a dwelling unit, not as storage area; and storage area blocking second exit. Public hearing opened 9:45 p.m. Keith Fenner, 833 Hermosa Avenue, said he lives upstaira over the restaurant and has asked for the changes due to requests of his patrons. He said they have never had disturbances or fights, the sidewalk service was planned from the beginning but that they determined to wait until summer, and the Business License Committee had approved hours of operation to 1:30 a'.m. on Friday, Saturday, and Sunday. Regarding staff recommendations, he agreed with items #1, 2, 5, 7, 10, 11, 12, and 13. On item #3, he said they have always had the juke box and have signed a contract with the owner; he will keep noise level down to city requirement. On item #4, he would like extension of hours to 2 a.m, rather than to midnight, 7 days a week; many other businesses within several blocks stay open to 2 a.m. He agreed to item #6 although he said it is not consistent with his license from the state. Item #8, prefers outside service hours to read "11 a.m, until dusk" which would give them until 8:30 or 9:00 p.m. in the summer. #9 was indicated in the letter to the City Manager, Mr. Fenner said, and the menu includes hamburgers, salad bar and a few other specialties which are always available when they are open. He said he has not formally requested patio service from the Alcoholic Beverage Control or City Council, however the Alcoholic Beverage Control has indicated they would approve if the city does. Regarding live entertainment, Mr. Fenner said they have allowed guitar and singing on occasion, but do not allow it now. Dave Donahoe, 546 Monterey, spoke in favor of the business and said he finds it clean and interesting. William Spanos, manager of Fenners, said he has received a letter from a customer, Thomas Selk, attorney, of San Francisco, who spoke favorably of their business. Mr. Perrino, 67 9th Court, said the previous business, Linden's Pizza House, was closed from June to December. He said their problems with Fenners include garbage, loud juke bax, remodeling of an upstairs room without building permit, closing off of air conditioner without permit, breaking bottles in the trash bin after closing, and no parking space provided. He opposes outside service, and said if it is approved it will complicate the enforcement of no drinking on the beach. He requested that the hours not be changed, and that all owners should be listed on the business license. Hilda Shupp, 70-8th Street, said she has 5 units about a block away, has lost two tenants and has received notice from a third, due to noise. Planning Commission Minutes - Monday, June 9, 1975 page 8 Ted Allen, 52-1/2 9th Court, commented on the severe parking problem, said the saloon has offered patrons a parking place across the street but they do not use it, and agreed with Mr. Perrino's statement on trash can noise. Mrs. Linden, of the former Linden's Pizza House, said they operated the place until August 9th, and never had a police report when they were operating the business. She said there is space for three cars in the back. Mr. Spanos, manager, said it will be easier to effect closing hours at 2 a.m, than at 11:30 p.m.; the police visits were concerned with closing hours and never with rowdiness, noise, or fights. He said they take the trash out after closing due to a Fire Department requirement, but will take it outside in plastic bags. Public hearing closed 10:24 p.m. Comm. Hough asked if it is legal for them to be living upstairs and if they have a license for games. Mr. Merl said living quarters are not within this jurisdiction and the question has been referred to the Building Department. He is not aware of a license for the games, however, the applicant says they have a license. (Licenses are revenue pro- ducing only, not regulatory.) Comm. Haller pointed out the conflicting reports on how long the business was closed. Mr. Merl said that is being checked, but is a separate issue. Motion by Comm. Collis, seconded by Comm. Haller, to maintain all present conditions including hours of operation; not to approve the service of alcoholic beverages and food outside the building; and to request review at the July 28th Planning Commission meeting. Chmn. Rosenberger said he would not object to service of food outside, excluding service of alcoholic beverages. Comm. Burt said he would agree if it were not city property. Comm. Hough said she opposed it because it is city property and because of congestion. Ayes: Comm. Burt, Collis, Haller, Hough, and Chmn. Rosenberger Noes: None Absent: None Abstain: Comm. Loosli Chmn. Rosenberger explained the decision to maintain existing conditions and have a review at the second meeting in July. He advised the applicant of the right of appeal within ten days to City Council. Motion by Comm. Collis, seconded by Comm. Burt, to adopt Resolution P.C. 154-1036 allowing the continuation of the business under the existing conditional use permit, not extending the hours of operation due to incompatibility of use with surrounding resi- dential neighborhood creating problems of noise for the neighbors within the immediate area, and to deny outside service of alcoholic beverages and food. There apprears to have been some problems created by patrons of the business and police reports indi- cate there have been such problems. Loosli LEGAL DETERMINATIONS 1636 Hermosa Avenue Request by Gladys Blaine for recognition of two legal units. Mr. Merl reviewed the history and staff recommendation of approval. Public hearing opened 10:43 p.m. Bob Blaine, 17 5th Street, said they purchased this property from the Larkins, inspected it and believe it was and always had been a duplex; he located all the records now available except for the Sanborn map. Madeleine Endequist, 1635 Palm, said there is no garage for that house and the area is very congested. Comm. Collis explained the procedure of legal determination. Public hearing closed 10:49 p.m. Motion by Comm. Hough, seconded by Comm. Collis, to approve subject to correction of any housing or building codes to the Building Director's satisfaction or approval by appropriate appeals board. Ayes: Comm. Mr. Merl said the building has very early records, dating from 1913, which do not show number of units; however, the Sanborn map and county assessor's reports since 1925 show two (2) two - bedroom units. Open public hearing 10:50 p.m. Planning Commission Minutes - Monday, June 9, 1975 page 10 Caroline Porter, 745 Monterey Blvd. , said they have owned the property six years, and it is now in escrow; they have brought it up to minimum city codes, including electricity and plumbing. Loosli OPEN SPACE ZONING Mr. Merl said that following the creation of an Open Space Zone it is necessary to designate properties within that zone as open space to bring zoning into conformance with the General Plan. He said letters were sent to the school district; Atchison, Topeka and Santa Fe Railroad; parking districts; and the city; with the Commission's concurrence he wou ld like to delete the Biltmore site as advertised in the legals, Lots 1-9, 19-20, and 32 of Block 15, Hermosa Beach Tract, which have been rezoned C-2; also the action should exclude two maintenance lots which the school district may sell, and a portion at the end of 17th Street. Public hearing opened 10:58 p.m. No one wished to be heard. Closed 10:58 p.m. Motion by Comm. Hough, seconded by Comm. Collis, to approve as Open Space the properties as described in the June 4 memorandum with corrections as stated above. Ayes: Comm. Burt, Haller, Hough, Collis, and Chmn. Also request an opinion from the City Attorney. So ordered. 2447 PACIFIC COAST HIGHWAY - INTERPRETATION OF CONDITIONS Mr. Merl reviewed the memorandum from the City Engineer, in view of which staff recommended amendment of the original conditional use permit to eliminate the require- ment for curbs, gutters or sidewalks unless -there are future modifications that would increase floor space by more than 400 sq. ft. Motion by Comm. Hough, seconded by Comm. Haller, to eliminate the requirement for curbs, gutters, or sidewalks, unless there are future modifications that would increase floor space by more than 400 sq. ft. Ayes: Comm. Motion by Comm. Haller, seconded by Comm. Hough, to request that the Building Director issue an affidavit that the structure is built for single family usage only and that the affidavit is attached to the property. Ayes: Comm. FINAL TRACT MAP #31889 The City Engineer finds that the Final Map #31889 is in substantial conformance with the tentative map, approved by City Council January 14, 1975, for a six -unit condo- minium conversion at 236 Manhattan Avenue.
