McJing called to order by Acting Chairman Hough at 7:35 p.m. RgLL CALL Present: Comm. Burt, Learned, Loosli, Rosenberger, Acting Chairman Hough Absent: Chmn. Collis Also present was Rod Merl, Planning Director. APPROVAL OF MINUTES Motion by Comm. Rosenberger, seconded by Comm. Burt, to approve the minutes of September 8, �1975, as submitted. Ayes: Comm. Burt, Learned, Loosli, Rosenberger Abstain: Chmn. Hough APPROVAL OF REDOLUTIONS Motion by Comm. Burt, seconded by Comm. Rosenberger, to approve Resolution P.C. 154-1063 as submitted. Hough LEGAL DETERMINATION 3,7 30TH STREET Mr. Merl said the materisls relating to a request by Kenneth & Lillian Mackay for legal determination for three nonconforming legal units include an analysis by the Building Dept., various records, and a statement issued by the Building Director. Mr. Merl read the statement for the benefit of the audience. Regarding Size, he said the original building of 1927 qas 26' x 421; the three-room addition of 1938, 9' x 30'; and the third unit, permit #3388, 1945, appears to be a 6' x 8' sleeping room. Public hearing opened 7:47 p.m. Mrs. Lilliam Mackay, 345 30thStreet, asid the third unit is not a sleeping room; the third unit is a bachelor unit behind the garage, done in 1938, and having a living -sleeping room, kitchen and bath, as shown in the tax assessor's sketch. She said the 1945 addition has nothing to do with the third unit; it was for enclosure of a front porch, She said the city records, as early as 1958, showed this as an apartment house, not as a two -unit place. PLANNING COMMISSION MINUTES , SEPTEM3ER 22, 1975 page 2 Comm. Rosenberger asked the size of the third unit, which the 1945 permit seems to indicate 48 sq. ft. Mr Mackay said it is 10' x 25' or 30'. Pudic hearing closed 7:52 p.m. Motion by Comm. Rosenberger, seconded by Comm. Burt, to approve with conditions as follows: 1. That the City Attorney review this particular case with respect to the potential of spot zoning within a residential zone. 2. That this recommendation shall be based on the assumption that the existing third unit in question under Building Permit #3388 shall comply with any and all local and State housing codes. 3. That the Sanborn Map be corrected to reflect the decision of the Planning Commission and City Attorney. Ayes: Comm. Burt, Learned, Loosli, Rosenberger, Chmn. Hough Noes: None Absent: Chmn. Collis Motion by Comm. Rosenberger, seconded by Chmn. Hough to adopt Resolution P.C. 154-1067 establishing legal usage at 357 30th Street for three units, withihe three conditions stated in the motion above. The Commission has found that the conversions, made in some cases without adequate permits, took place before the existing code restrictions in regard to parking, square footage and area per dwelling unit, prior to 1959• The commission has determingd that, subject to City Attorney review, the units appear to be of habitable size. Ayes: Comm. Burt, Learned, Loosli, Roeenberger, Chmn. Hough Noes: None Absent: Chmn. Collis SAFETY ELEMENT Mr. Merl said the element is being retyped, incorporating the changes made by Comm. Rosenbergi and the typing and grammatical errors noted by Comm. Loosli. Public hearing opened 7:55 p.m. No one wished to be heard. Closed 7:56 p.m. Motion by Comm. Loosli, seconded by Comm. Rosenberger, to approve, subject to recommended editorial changes of the various commissioners. Ayes: Comm. Burt, Learned, Loosli, Rosenberger Noes: None Abstain: Chmn. Bough Absent: Chmn. Collis Resolution P.0 154-1068, Safety Element, will be delayed until the corrected element is available. POLICY STATEMENT Mr. Merl reviewed the letter sent to the City Attorney concerning public hearing procedure. He said after considerable discussion, the City Attorney still feels that the present procedure might be in order, however, the Planning Commission may adopt the policy that if a Commissioner is not present for a public hearing item that is continued, before that Commissioner may participate or vote at subsequent meetings he must PLANNING COMI1ISSION MINUTES, SEPTEMBER 22, 1975 page 3 familiarize himself with all the minutes and information available. He should then call that out at the meeting to inform those present, and the record, of his dfforts to read the record and all pertinent materials from the meetings when he was absent. Mr. Merl said this would aid the City Attorney greatly if this were established as a policy of the Commission. Comm. Loosli requested that Comm. Burt, Haller and Hough make their positions known to the City Council in regard to R-2, as they have been deeply involved in this, rather than just noting in the minutes that they are absent or abstaining. Motion by Comm. Rosenberger, seconded by Comm. Burt, to make a policy statement for public hearing procedure that any Commissioner who is absent from a public hearing will review the minutes and all pertinent materials presented at that meeting, will talk to staff about the item, and so state for the record at the time of voting. Ayes: Comm. Burt, Learned, Loosli, Rosenberger, Chmn. Hough Noes: None Absent: Chmn. Collis R-3 PROPOSED AMEVDMENTS Mr. Merl read his September 4th memorandum. He said he has received no comments from the Building Dept., but the City Attorney was concerned that the application of Conditional Use Permit requirements may be a problem under equal protection, most specifically if the number of units will be regulated by discretion. Public hearing opened 8:19 p.m. No one wished,to be heard. Closed 8:19 p.m. Corrections were made to the amendment as follows: Section 600. #2. Multiple dwellings (3units or more) subject to approval of a Conditional Use Permit by the City Planning Commission in regard to the interior exterior design layout. Section 605. The minimum required lot area for new lots shall be four thousand (4000) sq. ft. and a minimum of 40' of street frontage. Section 607. (Last sentence) Twenty-five is to be landscaped and irrigated, subject Commission. \. (25%) percent of the usable open space to the approval of the Hermosa Improvement Section 608. (Add) Losts must be at least 30 feet wide for multiple usage. Section 609. Storage Areas (delete word "trash") Adequate enclosed trash storage area and a minimum of 100 cu. ft. of enclosed personal storage ares shall be provided fore each dwelling unit. Section 612. Section 503 of the R-2 amendments shall be added to the R-3 amendments as Section 612. Motion by Comm. Burt, seconded by Comm. Rosenberger, to approve as corrected and forward to Board of Zoning Adjustment. Ayes: Comm. Burt, Loosli, Rosenberger Chmn. Hough Noes: Comm. Learned Absent: Comm. Collis PLANNING COMMISSION MINUTES, SEPTEMBER 22, 1975 page 4 The Resolution is to be postponed until the amendment is returned from the Board of Zoning Adjustment for final review. OPEN SPACE MODIFICATION Mr. Merl said the City Council has modified the proposals for open -space zoning in regard to school property and parking district land. He pointed out the following modifications on maps: North School: The property that would be excluded are the existing buildings on 25th Street, to remain unzoned, which is R-1. The School Dept. concurred in leaving the new brick building, which could go to.the city in the future; also the area that is the new kindergarten. Everything easterly of a point 10'east of the northern edge of lot 12 and 13, to Balley, would become open space. Hermosa View: The building and parking areas are excluded. Prospect Heights: The line is drawn at the buildings. South School: The line would be drawn along the slope, with the fornt lots excluded. Valley View: All open space. Parking Districts: The parking behind the theater and Bank of America is excluded from the open space zone; they feel that the parking district land is not at this time open space; and they do not ,know how it will be developed. Chinn. Hough said this would reduce potential park land from about 45 to 35 acres, when according to national standards there should be approximately 100 acres in this community. She said the beach is a specialized regional use and cannot be counted in the city's open space. Comm. Loosli questioned the proposed modification at North School, which is currently a playground and would represent the loss of an irretrievable resource. Chmn. Hough stated for the record I that she understands that the City Council and School Dept. are working very hard to come up with the best possibel package for open space and parks; -and that the school must consider financial and educational aspects as wall as preservation of open space. She said she would encourage and support their efforts, however, as a professional in the area of parks and recreation, she is aware of the need for parks, the community's needs, and the established national standards which are 5 acre per 1000 people. She said this is an outdoor community, needing as much open space as possible, and for these reasons she will vote no on this item and cannot concur with the modifications of the City Council. Motion by Comm. Loosli, seconded by Comm. Rosenberger, to support theCity Council modifications of these disignated open space areas with the exception of the play- ground area bordering 26th Street, Lots 9-13 and portions of Lots 6-8 of Block 111, Shakespeare Tract. Ayes: Comm. Burt, Loosli Noes: Comm. Learned, Rosenberger, Chmn. Hough Absent: Chmn. Collis The motion failed. Substitute motion by Comm. Burt, seconded by Comm. Rosenberger, to concur with the City Council. , PLANNING COMMISSION MINUTES, SEPTEMBER 22, 1975 page 5 Ayes: Comm. Burt, Learned, Rosenberger Noes: Comm. Loosli, Chmn. Hough Absent: Chmn. Collis Motion by Comm. Burt, seconded by Comm. Rosenberger, to adopt Resolution P.C. 154-1069. While the Planning Commission would prefer to see additional school lands remain in open space, they realize the intricacies of the school financial situation and their discussions with the City Council, and therefore go along with their recommendations. Ayes: Comm. Burt, Learned, Rosenberger Noes: Comm. Loosli, Chmn. Hough Chmn. Haugh directed that a memo be attached containing the comments of the Commissioners. 26 22ND STREET One year review, Bottle Inn. Mr. Merl said Mr. King has checked and found no problems; the Police Dept. has had no problems. Motion by Comm. Rosenberger, seconded by Comm. Learned,,to approve, with review in one year. Ayes: Comm. Burt, Learned, Loosli, Rosenberger, Chmn. Hough Noes: None Absent: Chmn. Collis 00 PACIFIC COAST HIG3-1AY Six month review, Import House. Mr. Merl said Import House has a Conditional Use Permit for sale of automobiles; no problems have been reported by Mr. King in his review, or by the Police Dept. Motion by Comm. Rosenberger, seconded by Comm. Learned, to approve, with review in one year. Ayes: Comm. Burt, Learned, Loosli, Rosenberger Noes: None Abstain: Chmn. Hough Absent: Chmn. Collis 22 PIER AVENUE Six month review, The Flagship. Mr Merl said there has been a person to person transfer in August; Mr. King found no problems except for electronic games; apparently no hot meals; and it does not represent a serious police problem according to the chief. The applicant said the transfer was from father to son. He said they serve hot sandwiches, and specials on Mon., Tues.? and Thursday; they have a kitchen; they have a radar oven; the customers are not interested in elaborate food, and they sell only about 15 sandwiches a day. Motion by Comm. Loosli, seconded by Comm. Learned, to approve with one year review. Ayes: Comm. Burt, Learned, Loosli, Rosenberger, Chmn. Hough Noes: None Absent: Chmn. Collis PLANNING COMMISSION MINUTES, SEPTEMBER 22, 1975 PARKING DISCUSSION page 6 Mr. Merl reviewed the memorandum of May 29, 1975 stating the need for a parking study: and the parking questionnaire summary dated Jan. 23, 1975• Comm. Rosenberger said the City cannot refuse to sell parking stickers to nonresidents, but suggested discounting the stickers to residents to increase the use of the stickers. He said the City could further encourage use of stickers by allowing parking in the city. lots after an established hour in the evening. He also suggested shortening the existing parking spaces. Chmn. Hough said residents should not have to pay to park in the city, and asked staff to check into the possibility of having parking spaces where residents shall not pay and nonresidents should pay. She suggested that signs forbidding parking between 2 a.m. and 6 a.m. be eliminated except for the street -sweeper hours; the city does not have problems with hippies and flower children now. She recommended that the City continue an effort to make fore parking spaces along the railroad. Comm. Burt said The Biltmore site should be blacktopped for parking; that is what it was bought for. Comm. Loosli disagreed; he said he felt they should find a better use for =-beach property. Comm. Loosli felt that a recommendation should be made to City Council to enforce the ordinance prohibiting the use of garages as storage areas. Suggestions to expand the parking meters, and to construct parking structures, did not receive general approval. Chmn. Hough directed staff to send a memorandum to City Council incorporating these suggestions, with copies for the Commissioners in the next packet. GOALS AND PRIORITIES Motion by Chmn. Hough, seconded by Comm. Learned, to continue to the next regular meeting. So ordered. COMNMRCIAL ELEMENT Mr. Merl distributed a part of the element and requested comments and suggestions from the Commissioners to aid in preparing a draft, which should be ready by the second meeting of October. Chmn. Hough requested that the draft be presented at the first meeting in Nov. and she and Chmn. Collis will both be absent from the second meeting of Ootober. STAFF REPORTS Mr. Merl reminded the Planning Commission of the joint meeting with the Hermosa Improvement Commission on Thursday, Sept. 25 at 6'30 p.m. which will be a supper meeting. COMMISSIONERS' ITEMS Comm. Rosenberger referred to an item in Council minutes concerning upgrading and revision of various zoning sections that the Building Dept. finds inconsistent; and requested a list of those inconsistencies. Chmn. Hough requested a list of areas r PLANNING CODMSSION MINUTES, SEPTEMEER 22, 1975 page 7 where zoning is in conflict with the General Plan. Comm. Loosli noted that the Council minutes just received were from their meeting of August 26th,, and requested that the minutes, or an action list, be delivered within a week of each meeting. Chmn. Hough requested that City Council authorize additional funding for zeroxing copies of the zoning code for the Commissioners. So ordered. Meeting adjourned 10:17 P.M.
