Meeting called to order by Chairman Collis at 7:33 P.m — ROLL CALL Present: Comm. Boone (arrived late), Comm. Burt, Learned Loosli, Rosenberger, Chmn. Collis. Abs e;nt : None. Also present was Rod Merl, Planning Director. APPROVAL OF MINUTES Motion by Comm. Burt, seconded by Comm. Rosenberger, to approve tl-f: minutes of September 22, 1975, as submitted. Ayes: Comm. Burt, Learned, Loosli, Rosenberger Noes: None Abstain: Chmn. Collis, as he was not at that meeting, Absent: None Comm. Rosenberger requested copies for the Commission of the memorandum to City Council concerning the Parking Discussion (page 6 of the minutes). APPROVAL OF RESOLUTIONS Motion by Comm. Burt, seconded by Comm. Rosenberger, to approve Resolution P.C. 154 - 1066 as submitted. Ayes: Comm. Burt, Learned, Loosli, Rosenberger, Chmn. Collis Noes: None Absent: None Motion by Comm. Collis Absent: None PUBLIC HEARINGS Loosli, Rosenberger Chmn. Collis reviewed public hearing procedure and explained the right to appear in writing to City Council within ten days of the date the action is taked. 612 PCH Request by Trend .Imports & Service for a Conditional Use Permit in order to operate a used car parts, exporter, and importer business. 13 MINUTES OF THE PLANNING COMMISSION MEETING, OCTOBER 13, 1975 Page 2 Mr. Merl said the reason a Conditional Use Permit is required is because they propose to conduct a business outside, for auto sales & repairs as well as storage of auto parts. He said there will be a grade differential and 6' bloxk wall with some landscaping so that it will not be visible from Pacific Coast Highway. Residents within 300' were notified. Public hearing opened 7:40 p.m. Albert Mardikan, Trend Imports & Service,said he is the sole owner of both properties; there will be a block wall with two gates; he will add shelves in the open area to store used parts; and they both import and export automobile parts. Public hearing closed Motion by Comm. Boone, seconded by Comm. Learned, to approve subjedt to the rollowing conditions: 1. Provision and maintenance of an adequate trash storage area. 2. All exterior modificatioAis and signs be approved by the Hermosa Improvement Commission. 3. There be a close monitoring of noise levels which should not exceed 60 dba. 4. Hours of operation and conditions to be as presented unless a change is approved by the Planning Commission. 5. Six- month review by the tPlanning Commission, with a report on dba level. 6. There be a solid block wall surrounding auto parts area with landscaping. 7. Subject to the review and approval of the City Attorney. 8. Subject to all other applicable state of local laws, ordinances, or regulations. Ayes: Comm. Boone, Bert, Learned, Loosli, Rosenberger, Chmn. Collis Noes: None Absent: None Motion by Comm. Rosenberger, seconded by Comm. Burt, to adopt Resolution P.C. 154 - 1070 approving the request for Conditional Use Permit for use of an outside storage area. The Planning Commission found after public hearing that since there was no spoken or written opposition to the proposed development and since the applicant agreed to all conditions listed in the city analysis, as follows: (1-8, as stated above) that the Planning Commission hereby approves the request for exterior storage at 612 PCH. The use is similar to other types of businesses within the same zone and under similar conditions as -recommended by staff, and it is an extension of an existing business. Ayes: Comm. Boone, Burt, Learned, Loosli, Rosenberger, Chmn. Collis. Noes: None Absent: None 239 - 24- 28TH STREET Request for legal determination. Mr. MLarl reviewed the analysis of the Building Director, showing no definite time established for garage construction; the area was zoned for multiple dwelling MINUTES OF THE PLANNING COMMISSION MEETING, OCTOBER 13, 1975 Page 3 during the 1930's and 1940's; however it does not comply with codes of the time especially in the fire -resistive category. Mr. Merl quoted items 6, 7, & 8 of the Building Director.'s report. Public hearing opened 8:00 p.m. Mr. Moran F. Lavender, 55438 Onage Trail, Yucca Valley, CA. 92284, said he has owned the property for approximately nine years, which was represented as a three unit property; he has obtained records showing that the meters were reworked or placed in the 40's but records prior to that were not complete; the tax assessor's work sheet of 1937 shows three units in substantially the same relation and size, and also shows kitchens and plumbing. He said he is willing to bring the units up to code within reason; he cannot increase the square footage, but can fix up for fire resistance, vented plumbing, and electrical. He said he will argue the point about the tub vent but if he loses, he will fix it; and will put shielding around the furance. Public hearing closed 8:04 p.m. Motion by Comm. Rosenberger, seconded by Comm. Burt, to approve as legal nonconforming subject to -the following conditions: 1. That detailed plans of the ares in question be submitted to this office for plan check, 2. That any and all housing code substandard conditions be corrected immediately or within six months, 3. That the above be subject to review and concurrence of the City Attorney. and subject to final write-off by the Building Dept. of all conditions having been met within six months. Ayes: Comm. Boone, Burt, Learned, Loosli, Rosenberger, Chmn. Collis .Noes: None Absent: None Motion by Comm. Learned, seconded by Comm. Rosenberger, to adopt Resolution P. C. 154-1071 granting legal nonconforming use of three units at 239 - 241 28th Street, subject to staff and Building Dept. recommendations: (as stated above) The Planning Commission has considered that this construction very possibly took place dux'ing or prior to the 1940's when the zoning allowed construction of multiple dwellings; city records are incomplete as to the construction of the garage; however the Building code requires one -hour construction. Ayes: Comm. Boone, Burt, Learned, Loosli, Rosenberger, Chmn. Collis Noes: None Absent: Noone 16 - 14TH STREET Request for modification in existing Conditional Use Permit. Mr.. Merl said the request is for a change of hours from 11 a.m. - 7 p.m. daily, to 8 a.m. - 9 p.m. daily. Sternberg, 6 Voyage Street, Mar4a Sel Rey, CA, said the reason for the request is that his customers would like•him to open earlier for breakfast, especially on Saturday and Sunday; he is requesting the outside range of hours to give him some flexibility. Jerry Freese, 22 - 44th Street, said he lives within 20' of the restaurant and is very much opposed to the extension of hours as it would affect his life and be a noise factor in his dwelling; he believes the Conditional Use Perm it conditions have been violated, and that some employees at the restaurant are antagonistic to him. He said he has called the Health Dept. once, and has called the Police Dept. once but they said they do not have jurisdiction. He said he will appeal if the hours are granted. Chmn. Collis requested that staff find out whether any reports have been made against the restaurant. Comm. Rosenberger read the conditions of the Res. 154-1001 of January 27, 1975; and said in the terms of the conditions and permit granted, everything appears to be in order. Public hearing closed 8:38 p.m. Motion by Comm. Fosenberger, seconded by Comm. Boone, to approve change of hours to 8 a.m.- 9 p.m. daily, subject to the following conditions: 1. Sale of beer and wine with hot food available at all times. 2. No alteration in approved hours of service without Planning Commission approval and subsequent notification of the Dept. of Alcoholic Beverage Control of all changes. 3. Permit is granted to applicant only and a transfer of said permit is subject to Planning Commission review and approval. 4. Approval by Hermosa Imgroval Commission of all exterior improvements and signing. 5. Six-month review by the Planning Commission. I 6. No pass -through window for service of food to the exterior. 7. Subject to review and approval of City Attorney. 8. Subject to all applicable state or local laws, ordinances,or regulations. The first review of Res. 154-1001 and Res. 1072 to be held concurrently during the first Planning Commission meeting of January 1976. Ayes: Comm. Boone, Burt, Learned, Loosli, Rosenberger, Chmn. Collis Noes: None Absent: None Motion by Comm. Boone, seconded by Comm. Burt, to adopt Resolution P.C. 154-1072 approving the extension of hours from 11 a.m. - 7 p.m. to 8 a.m. - 9 p.m. for Bon Appetite Restaurant at 16 - 14th Street (Lot 7, Block 14, Hermosa Beach Tract). The Planning Commission has found that the intent of the conditions of Resolution P.C. 154-1001 have been met, that the restaurant is a credit to the area, and that the hours are comparable business hours within the area; and with similar businesses; subject to conditions: (1-8 as above) MINUTES OF THE PLANNING COMMISSION MEETING, OCTOBER 13, 1975 Page 5 Ayes: Comm. Collis Noes: None Absent: None AMENDMENT TO ZONING ORDINANCE (SECTION 1301 Review of the language of Section 1301 regarding nonconforming uses of nonconformint buildings. Mr. Merl reviewed the three elements of Section 1301, recommending deletion of the second requirement, and suggesting definition of "ninety days" in the third element. Public hearing opened 8:55 p.m. No one wished to be heard. Closed 8:56 p.m. Motion by Comm. Rosenberger, seconded by Comm. Boone, to delete the protion of Section 1301 which states: "and provided further, that all nonconforming uses of a conforming building in any of the "R" zones shall be discontinued not later than three years from the .'effective date of this ordinance" and correcting the third portion to read "ninety consecutive days" for purposes of clarification, due to guidance of the City Council and following staff recommendations. Ayes: Comm. Boone, Burt, Learned, Loosli, Rosenberger, Chmn. Collis Noes: None Absent: None Motion by Comm. Rosenberger, seconded by Comm. Boone, to adopt Resolution P. C. 154-1073 stating that the Planninc Commission findings are that this ordinance shall be revised because that portion relating to the three-year abatement period is past, making that portion obsolete. The additional wording in the third portion will serve to clarify the provisions, and enhance and ease the enforcement problems for the Building Dept. Ayes: Comm. Boone, Burt, Learned, Loosli, Rosenberger, Chmn. Collis Noe: None Absent: None Comm. Loosli left the meeting. SAFETY ELEMENT RESOLUTION P.C. 154 -1068 Comm. Rosenberger noted that a portion of the text is missing on page 36 of the new issue (from page 16 of the prior draft); and that the map on street widths has not been updated as to the width of First Street. Motion by Comm. Rosenberger, seconded by Comm. Boone, to adopt Resolution P.C. 154 -1068 approving the Safety Element as mandated by the State. The findings are that Hermosa Beach is not immune to potential major hazards to life and property; that this element provides information and strategies to minimize these hazards and their impact; this seismic and safety element should make safety a prominent aspect of future planning and zoning, and help reduce potential injuries, loss of life and property, as well as minimize the economic and social dislocation inherent in major hazards such as earthquake and fire; and provides a rational basis for allocation of -service planning. Loosli GOALS AND PRIORITIES Chmn. Collis said in his opinion the Capital Works Improvement program should have top priority, and requested that staff prepare such an improvement program for Planning Commission review. Comm. Boone said she feels that goals of the Social Element should be considered, as acquisition and renovation of buildings, etc., should be a pertinent part of the 5-year plan. She said the City should adopt a policy that would be more effective in obtaining grant funding, for planning and operation of programs as well as capital improvements. STAFF REPORTS Mr. Merl called attention to the memorandum from Planning Asst. Estelle Feinstein in regard to policy development for the Social Element. Mr. Merl reproted that he has received approval and equipment for slide projection, and expects to have slides of all Conditional Use Permits and Planned Unit Development areas to present with discussion of those areas. CONWSSIONERSI ITEMS Comm. Boone requested copies of the zoning ordinance, and a list of zoning conflicts. She said that she will not be present at the October 27th meeting.
