Meeting called to order by Chairman Collis at 7:39 p.m. ROLL CALL Present: Comm. Burt, Loosli, Rosenberger, Chmn. Collis Absent: Comm. Boone, Learned Also present was Rod Merl, Planning Director APPROVAL OF MINUTES Motion by Comm. Rosenberger, seconded by Comm. Burt, to approve the minutes of October 13, 1975, as submitted. Boone, Learned PLANNING COMMISSION MINUTES - OCTOBER 27, 1975 PAGE 2 Resolution P.C. 154-1070. Mr. Merl said the applicant has asked to be heard tonight concerning the language of the resolution. Albert Mardikan, Trend Imports & Service, said he would like to change Condition #6 of the Resolution to incor- porate a different plan of fencing than that originally approved. Chmn. Collis said this is out of the jurisdiction of the Planning Commission at this point; the decisions made in a public hearing cannot be changed without another public hearing, which would have to be advertised. Mr. Merl concurred. Motion by Comm. Rosenberger, seconded by Comm. Burt, to approve Resolution P.C. 154-1070 as submitted. Ayes: Comm. Burt, Loosli, Rosenberger, Chmn. Collis Noes: None Absent: Comm. Boone, Learned 614-620 MONTEREY BLVD. Final development plans and rehearing for tentative tract map for 4-unit condominium. Mr. Merl said the project was approved in 1974, the project was not processed all the way to the Council at that time and the language of the Resolution was such that it causes a conflict between "condominium" and "planned unit development", using the old language which has since been changed; also the original action did not specify the tract map by number. He said the item is before the Planning Commission to reaffirm the action, clarifying the language and approving the final tract map; it originally received unanimous approval, and there have been no changes. Public hearing opened 8:00 p.m. No one wished to be heard. Closed 8:00 p.m. Motion by Comm. Rosenberger, seconded by Comm. Burt, to approve. Ayes: Comm. Burt, Loosli, Rosenberger, Chmn. Collis Noes: None Absent: Comm. Boone, Learned Motion by Comm. Rosenberger, seconded by Comm. Burt, to adopt Resolution P.C. 154-1074, incorporating all aspects of Resolution P.C. 154-994 (11-25-74); findings #1, 2,3 4, 5, 6, 8, & 9 being applicable (exclude #7) and part of the resolution; specifically citing Tract Map #27960; and that further, this is a four -unit condo-. minium conforming to the requirements of a planned unit development as defined by the City of Hermosa Beach. 701-715 FOURTH STREET Conditional Use Permit and tentative tract map for 8-unit condominium. PLANNING COMMISSION MINUTES - OCTOBER 27, 1975 PAGE 3 Mr. Merl reviewed the request for 8 units in three structures; two having three units each, and one having two units. He said each will be three story in appearance although they will actually be two stories by definition, since the top floor is a loft. Two existing structures at that location will be removed, and grading will be required. He corrected Item #6 in the Development Criteria to read: "Floor area - 125% max. and said that including the garages, the area provided will be 113%, and without garages, 90%. Public hearing opened at 8:14 p.m. As the applicant was not yet present, the hearing was reopened at 8:42 P.M. Katherine Smith, 519 25th Street, Hermosa Beach, said the 16 parking spaces will be assigned by deed to the individual units; guest parking will not be deeded. Chmn. Collis said he is concerned with the treatment of the metal fireplace stacks, and recommended that they appear as a masonry element; also the plans do not show how the garage doors are to be treated. Comm. Rosenberger recommended that more thought be given to the easti elevation to make it consistent with the sough and west sides. Motion by Chmn. Collis, seconded by Comm. Burt, to approve the proposed 8-unit development at 701-715 4th Street, Tentative Tract Map #26438. The proposed development meets all the criteria as established for the type of land use development. It is in keeping with the General Plan designation. Development Criteria P. U.D. Requirements 1. Utilities, easements, lighting, curbs, gutters and sidewalks, street improvements be subject to review and approval of the City Engineer 2. That a complete utility plan be submitted and approved by the City Engineer prior to the filing of the final map 3. That all utilities will be underground 4. That any public dedications be subject to acceptance by the City Council 5. That all grading be subject to approval of the City Engineer and Building Director and a grading plan be filed and approved prior to filing the final map 6. That all major landscaping and exterior design and improvements of structures be subject to review and approval of the Hermosa Improvement Commission 7. That the map be approved by the City Council, and that it conforms to the requirements of the State Subdivision Map Act 8. That the City Engineer may require reasonable bonds to insure completion of required improvements 9. That this approval is subject to the review and approval of the City Attorney 10. Subject to all other applicable state and local laws, ordinances, and regu- lations The above motion to. include proposed changes to fireplace flues, garage doors consistent with overall design, and east windows consistent with total theme. Boone, Learned Resolution P.C. 154-1075 to include data above and to be voted on at next regular meeting. 1314 HERMOSA AVENUE Six month review. Mr. Merl said Mr. King reviewed this item, a restaurant (The Sentimental Chef) with license for beer and wine sales; conditions 1,3,4,6,7 have been complied with; PLANNING COMMISSION MINUTES - OCTOBER 27, 1975 PAGE 5 condition 2, food is available with the service of beer and wine (per license from ABC); condition 5, actual hours are Tues. - Sat. 10 a.m. - 9 p.m. and Sunday 9 a.m. - 4 p.m. They have no police problems and no complaints have been received by the department on this establishment. Staff recommends continuance of the conditional use permit for one year. Motion by Comm. Burt, seconded by Comm. Loosli, to continue for one year with the same conditions. Ayes: Comm. Burt, Loosli, Rosenberger, Chmn. Collis Noes: None Absent: Comm. Boone, Learned 320 MASSEY Six-month review, convent and parish hall, Our Lady of Guadalupe. Mr. Merl noted that it is not in operation but is still under construction. John J. Dee, Attorney, 800 Wilshire, Suite 400, Los Angeles, 90017, askef if it is necessary for the applicant to appear at the next review. Chmn. Collis said the Planning Commission does reserve the right of review even though no problem is expected due to the nature of the activities. Motion by Comm. Rosenberger, seconded by Comm. Burt, to continue until six months after completion. Ayes: Comm. Burt, Loosli, Rosenberger, Chmn. Collis Noes: None Absent: Comm. Boone, Learned 66 HERMOSA AVENUE Three-month review, live entertainment, Incredible Edibles. Mr. Merl said the conditional use permit, issued June 23, 1975, had two parts con- sisting of outside service and live entertainment. It was subsequently found that public property was involved, so that portion concerning outside service was not valid. He said Mr. King has researched and found that there are no problems, and no objections have been filed with the. department. Concerning the entertainment, staff recommends review in one year. Motion by Comm. Rosenberger, seconded by Comm. Burt, to schedule review for the first meeting in August, 1976. Ayes: Comm. Burt, Loosli, Rosenberger, Chmn. Collis Noes: None Absent: Comm. Boone, Learned PLANNING COMMISSION MINUTES - OCTOBER 27, 1975 PAGE 6 AREAS OF ZONING -GENERAL PLAN CONFLICT Mr. Merl displayed a map delineating areas of zoning and general plan conflict. The Commission discussed the various areas and alternate procedures. Comm. Loosli requested that staff check on whether R-1 might be medium density because of small lot sizes. Comm. Rosenberger suggested starting with the R-2 area that City Council rejected and sent back. Chmn. Collis asked what responsibility the city has to the applicant if a building permit is requested where zoning is inconsistent with the General Plan; and if it falls within the Coastal Zone Commission jurisdiction, what procedure is followed. Mr. Merl said the Coastal Zone Commission has apparently established it own criteria with an effective zoning overlay of about 33 dwelling units per acre maximum. He said concerning consistency, there is a "good faith" requirement by the state, of the city moving toward consistency between zoning and the General Plan, leading toward fulfillment of the General Plan. Chmn. Collis requested staff to create recommendations of study areas on a geo- graphical basis to be studied in depth. Mr. Merl said staff will establish present level of development in each area. CAPITAL IMPROVEMENT PROGRAM Mr. Merl said staff is in the process of interviewing all departments in the city for their veiws on one year and five year programs. When the list is completed it will go to Engineering for cost figures, and will then be brought to the Planning Commission to establish priorities . He said he could have the Park s material at the next meeting. Chmn. Collis said the Commission prefers to have all the proposed capital improve- ment programs at one time in order to establish priorities. STAFF REPORTS Mr. Merl read the memorandum from the City Cler, dated October 15, 1975, con- cerning R-2 zone requirements and City Council Resolution of Intention No. N.S. 4004. He said 4004 will go to the Board of Zoning Adjustments and then be returned to the Planning Commission. Chmn. Collis said the city is creating a real problem by changing lots within the R-2 area to something lesser. It is against all principles of planning, which is concerned with areas rather than single lots. COMMISSIONERS' ITEMS Comm. Rosenberger asked about the status of the Car Wash, and the storage lots on 5th and 6th, in regard to legal aspects. Mr. Merl said complaints have been filed according to his request, and he beloeves that it is under administrative action. PLANNING COMMISSION MINUTES - OCTOBER 27, 1975 PAGE 7 League of California Cities Conference -- Comm. Loosli said many cities were concerned with too much growth of cities. Mr. Merl said there was considerable discussion of legislation concerning the Petaluma decision; and the decision in the case of Vons v. City of Cerritos may result in dramatic changes in zoning policies. He said other statements indicate that the present financial situation will result in more restrictive approach to city services, which directly relates to the development of the Social Element.
