Boone, Burt, Learned, Chmn. Collis Absent: Comm. Loosli, Rosenberger Also present: Rod Merl, Planning Director, and Ed King, Staff. APPROVAL OF THE MINUTES Motion by Comm. Burt, seconded by Comm. Learned, to approve the minutes of November 24, 1975, as submitted. Ayes: Comm. Burt, Learned, Chmn. Collis Noes: None Abstain: Comm. Boone Absent: Comm. Loosli, Rosenberger APPROVAL OF RESOLUTIONS Motion by Comm. Bert, seconded by Comm. Learned, to approve Resolution P.C. 154-1078 as submitted. Ayes: Comm. Burt, Learned, Chmn. Boone, Learned RE: CON31MO LOT ORDINANCE - 1220 FIRST PLACE Request by Mr. and Mrs. Louis Stricker for relief from Combined Lot Ordinance require- ment of the Zoning Ordinance. Mr. Merl reviewed the request and analysis with reference to Section 1203.1. He said the applicants have two lots which do, under the ordinance, constitute a combined lot; shaven on the tract map as lots 19 and 20, on a block of deminished size; one lot being 25 x 60, the other 25 x 60, totaling 3192.97 sq. ft.; presently repre- sen ting 13.6 du/a, in a low density residential area (0-13 du/a). Public hearing peened 7:45 p.m. Mr. Robert Lininger, 1546 Prospect, Hermosa Beach, representing the applicants, said these are two of the smallest lots in Hermosa Beach; other owners on that block have 25' homes going up; there is parking on the street; the lots are taxed individually; and they have explored all alternitives. He said they cannot be denied the use equivalent to two R-1 properties; and it would be financial hardship i if this cannot be accomplished. Mr. Tom Miller, 839 7th Street, asked the zoning (R-1) and clarification of the applicants' request. HERMOSA PLANNING COMMESSION - Minutes - December 8, 1975 Mrs. Ruth Brand, 1231 First Street, presented a petition from property owners within the immediate vicinity opposing the granting of an exemption from the combined lot ordinance., with 24 signiuures. She said the present building is a small structure, not even one bedroom, but one large room with a bedroom curtained off at the back, detached garage; these having to be built across the property line. She said the petitioners feel the property should not receive the exemption. Public hearing closed*7:55 p.m. Comm. Boone noted that the ordinance requires 4000 sq. ft. per parcel whereas this combined lot does not have 4000 sq. ft.; also that they could not build two units under Planned Unit Develappment because it would be double the density allowed by the General Plan. Chmn. Collis said the granting of this request Would create a single-family lot with,1600 sq. ft., which would be about 40% of that required; the density would be double that which should be allowed; he felt it would be entirely inadequate and recommended denial of the application. Mr. Lininger said they are two lots of record, and every lot must be buildable in Hermosa Beach. Motion by Comm. Boone, seconded by Comm. Burt, to approve the application for relief from the combined lot requirement of the zoning ordinance. Ayes: None Noes: Comm. Boone, Burt, Chmn. Collis Abstain: Comm. Learned Absent: Comm.Loosli, Rosenberger Motion by Comm. Boone, seconded by Coma. Burt, to adopt Resolution P.C. 154-1080 denying the request for relief from the combined lot requirement of the zoning ordinance. After public hearing, the Planning Commission denied the request for the following reasons: The lot size of the combined lots is substantially less than that required for a new lot; That to divide the combined lot into two would make each only about 40% of the requirement; That it would be in conflict with the General Plan; That dividing the lots would cause the density to be 27du/a, allowed density being 13 du/a, That it would increase the parking problems; That even under Planned Unit Development, more than one unit could not be allowed. Loosli, Rosenberger 2INAL DEVELOPMENT PLANS AND TE�VNMTIVE TRACT MAP - 821-82 SEVENTH AND 822 EIGHTH STREETS Comm. Boone said she has read the minutes and acquainted herself with information relative to this item. Mr. Merl said the preliminary plan was approved at tee last meeting. He.said the applicant, at the Commission's request, changed the plans so there would be no vehicular access from Eight Street, all vehicular access now being from Seventh Street. Mr. Merl said the correctiion will be made. Public hearing opened 8:10 pm Mr. Robert Beck, 1004 Second Street, said he believes everything is in order, and he will. correct the error in the map. Mr. Robert miller, 839 Seventh Street, said he lives two lots from thisproperty, and believes the Planning Commission is allowing a lot splits He said he is not protesting the three units, but the lot split. Chmn. Collis explained that they are discussing condominiums, not a lot split, that the density being allowed is consistent with this zone, the land area requirement is met, and all the criteria has been met. Public hearing closed 8:21 p.m. Motion by Comm. Boone, seconded by Comm. Learned, to approve the final development plans and the tentative tract map. Ayes: Comm. Boone, Burt, Learned, Chmn. Collis Noesy None Abseht: Comm. Loosli, Rosenberger Motion by Comm. Boone, seconded by Comm. Burt, to adopt Resolution P.C. 154-1081 approving the final development plans and tentative tract map for three -unit condominium. The tentative tract map meets all the conditions and is consistent with the General Plan and density. Ayes:, Comm. Boone, Burt, Learned, Chmn. Collis Noes: One Absent: Comm. Loosli, Rosenberger TENTATIVE TRACT MAP - ] 10 STRAND Request by Mr. Jay Berggren for a tentative tract map for a seven -unit condominium. Mr. Merl said this was origlinally approved Dec. 10, 1973, and final plans approved Feb. 1974, but the map expired under state law deadlines at 18 months. He said the map is identical with the original. Public hearing opened 8:24 p.m. Mr. Jay Berggren, 1500 Ardmore, Hermosa Beaeb, said he was not aware that the map would expire; apparently it could have been renewed for 12 months had he known. Chmn. Collis noted that this is normally a function of the engineering firm. Public hearing closed 8:26 p.m. Motion by Comm. Burt, seconded by Comm. Boone, to approve. Ayes: Comm. Boone, Burt, Learned, Chmn. Collis Noes: None Absent: Comm. Loosli, Rosenberger Motion by Comm. Burt, seconded by Comm. Learned, to adopt Resolution P.C. 1082, with the same language as provided in the original, that it is consistant with the City requirements and the iptent of the General Plan. Ayes: Comm. Loosli, Rosenberger MINUTES OF THE PLANNING COMMISSION MEETING, DECEMBER 8, 1975 Page 4 STAFF REPORTS Mr. Merl said a petition has been received from residents of Tract 1130 requesting that their property be rezoned from R-3 to R-2 to make it consistent with the General Plana He said the person carrying the petition stated that they are trying to preserve the area as a single-family area. Comm. Boone said the Commission should know how many bona fide owners are for it and how many bona fide owners are not for it; she is in favor of pursuing a study on it. Chmn. Collis requested that staff get in touch with the person who circulated the petition, tell him the Planning Commission is encouraged by the interest shown, and ask for more explicit information. He suggested that the applicant get a map of the area, and indicate on each lot the property owners contacted and whether they are in favor or against the change. In response to a request for status report on the Hermosa Car Wash sign at 1000 Pacific Coast Highway, Mr. Merl said the Planning Commission initiated a complaint to be filed,and a response from Mr. Pat Brown indicates that matters being processed. Mr. Merl said the Economic Element is now available, has to go through Environmental Impact Report, and will probably go on the agenda for public hearing in January. Mr. Merl said the City Council has interviewed personnel and will be making appointments to the Planning Commission. COMMISSIONERS' ITEMS Comm. Burt asked what progress is being made on the City Council suggestion that all R-2 property that is below 2400 sq.ft. be rezoned. He said it has not yet been returned from Board of Zoning Adjustment. Chmn. Collis requested that the Commissioners be called in advanced of the Commissioners' walk, which is to be rescheduled in in January. Comm. Boone requested that the memorandum from City Attorney be placed on the agenda for di discussion at the next regular meeting. Meeting adjourned 8:47 p.m., to regular meeting of 23rd December at which time there will not be a quorum.
