Letter from Stephen Mouton dated December 4, 1995 requesting a permit to allow a Mozart Coffee & Specialty Espresso cart at a specific location at the base of the Hermosa Beach Pier. (over) THE HERMOSA BEACH FORM OF GOVERNMENT Hermosa Beach has the Council -Manager form of government, with a City Manager appointed by and responsible to the City Council for carrying out Council policy. The Mayor and Council decide what is to be done. The City Manager, operating through the entire City staff, does it. This separation of policy making and administration is considered the most economical and efficient form of City government in the United States today. The following explanations may help you to understand the terms found on most agendas for meetings of the Hermosa Beach City Council. GLOSSARY Consent Items ... A compilation of all routine matters to be acted upon by one vote; approval requires a majority affirmative vote. Any Councilmember may remove an item from this listing, thereby causing that matter to be considered under the category Consent Calendar items Removed For Separate Discussion. Public Hearings ... Public Hearings are held on certain matters as required by law -or by direction of Council. The Hearings afford the public the opportunity to appear and formally express their views regarding the matter being heard. Additionally, letters may be filed with the City Clerk, prior to the Hearing. Ordinances ... An ordinance is a law that regulates government revenues ' and/or public conduct. All ordinances require two "readings". The first reading introduces the ordinance into the records. At least 5 days later Council may adopt, reject or hold over the ordinance to a subsequent meeting. Most ordinances take effect 30 days after the second reading. Emergency ordinances are governed by different provisions and waive the time requirements. Written Communications ... The public, members of advisory boards/commissions or organizations may formally communicate to or make a request of Council by letter; said letters should be filed with the City Clerk by Noon the Tuesday preceding the Regular City Council meeting and request they be placed on the Council agenda. There are hundreds of carts in safe and successful operation all across the country. The Mozart Coffee & Speciality Espresso © cart has a fully sealed water system that supplies the espresso machine and provides hot water to the hand sink for hand sanitizing. The hot water temperature is suitable for hand washing. Pending permission from the Hermosa Beach city council to locate at the end of Hermosa Beachpier, our Architect will submit the final design plans to the County Health Department for the Mozart Coffee & Speciality Espresso © cart health permit. In order to meet the requirements of the health permit, a "commissary" must be designated to store the Mozart Coffee & Speciality Espresso © cart. The "commissary" is an approved location to store the Mozart Coffee & Speciality Espresso © cart with a drain, sink and running water, to reasonably ensure the healthy cleaning of the equipment at the end of the day. It would be preferable to have the commissary located near the pier. Two commissary possibilities have been tentatively identified near the pier. The first location is the storage building next to the pier; a second alternate location could include the construction of an enclosure at our expense on the unused space directly behind the public restrooms next to the pier. The commissary itself requires very little space, other than the availability of a drain, sink, running water and a place to store dry goods and a small refrigerator. A third commissary option, in the event that the two possibilities near the pier are unavailable or unsuitable for use as a commissary, is for Mozart Coffee & Speciality Espresso © to establish a commissary on private property away from the pier. Locating the commissary away from the pier • is less convenient and adds considerable expense to the operation of the Mozart Coffee & Speciality Espresso © cart. Modifying an existing space to meet the commissary requirements can be done with relative ease once Mozart Coffee & Speciality Espresso © has been granted permission to establish itself at the pier by the Hermosa Beach City Council. A licensed electrician and licensed plumber will handle all of the necessary hookups at no expense to the city. The success of the Mozart Coffee & Speciality Espresso © cart would be directly translated to additional funds for city projects which lack a funding base. A Mozart Coffee & Speciality Espresso © cart can be a real asset to the city by providing an upscale image, a quality beverage and a constant revenue source which can be used to maintain the quality of the pier itself, while attracting upscale visitors. The demographics that espresso drinks appeal to is especially important to a city projecting an upscale image. The typical customer is between the ages of 28 and 50, upper income, professional and female. In other words, the drinks attract exactly the kind of shoppers and visitors wanted by merchants in the Hermosa Beach area. Nordstrom, the University of California, Northrup Corporation, Microsoft, Safeway Inc. are just a few of the many organizations that enjoy the benefits espresso carts offer. All increase their income while enjoying their benefits. Why wouldn't any beach city want to add the charm of Mozart Coffee & Speciality Espresso © carts to their pier? WHEREAS, the City Council held a public hearing on November 28, 1995 to consider oral and written testimony and made the following Findings: A. The City Council has reviewed the draft ordinance that would amend the Municipal Code relative to City Council review of Planning Commission decisions which would make it a standard procedure for the City Council to decide whether to reconsider any Planning Commission decision at every regular meeting succeeding the meeting of the Planning Commission. B. The time period for private parties to submit appeals of Planning Commission decisions should thus start from the date of the Council decision on whether or not to review the decisions. Where the zoning ordinance or municipal code allows for an appeal to be filed with the City Council on matters regarding land use, a fee, established pursuant to Chapter 2, Article XIII of the Municipal Code shall accompany such an appeal. In addition to such an appeal fee, the appellant shall be responsible for providing any required public noticing and shall pay the direct cost of required newspaper ads. City Council review of decisions of the Planning Commission. Laj The City Council may on its own initiative review all actions of the Planning Commission. All Planning Commission actions, accompanied by the record of the proceedings before the Commission, shall be placed as a report item on the City Council's agenda at its regular meeting next following the Commission's action. The Council may at its next regularly scheduled meeting following the Commission's action, by an affirmative vote of two (2) members, initiate review of the action. In the event the Council initiates such review, the Commission's decision will be stayed until the Council completes its proceedings in accordance with the provisions of this Section. Background The Planning Commission, at their meeting of November 21, 1995, recommended approval of the clean-up amendments as proposed by staff. Article 7.2, Division 3 of the Zoning Ordinance sets forth the standards for commercial condominiums including requirements for a C.U.P., specific items for CC and R's, and some general design standards. The general design requirements in Section 7.2-13 do not contain any standards that would substantially differ from other commercial projects, and in most cases simply reference other requirements contained elsewhere in the code. The only exceptions are that landscaping plans require approval of the "Hermosa Improvement Commission"; specific requirements for on-site lighting; a requirement that "each unit have its own electric meter shut-off system;" and a parking requirement of 2 parking spaces per unit. In reviewing these provisions relative the potential development of a resort hotel that may be using some form of condominium ownership to finance the project, staff believes that clean-up amendments are necessary. The proposal includes an added clean-up amendment to the landscaping plan approval, to change "Hermosa Improvement Commission" to "Planning Commission." Analysis The parking requirement for two parking spaces per unit for a commercial building does not make sense . It seems to have been inappropriately copied from the residential condominium section. Parking requirements for commercial uses are specifically set forth in the Article 11.5, and usually are based on square footage requirements, or, in the case of a hotel/motel on the number of rooms. "Units" is not a useful standard of measurement for commercial condominiums as parking requirements in Article 11.5 are not based on the same, nor is it a useful description. If taken to mean each office unit, retail unit, or hotel/motel room it could lead to excessive or inappropriate parking requirements. As such, staff recommends eliminating this reference to 2 -parking spaces per "unit" since parking requirements for commercial uses is specifically set forth in Article 11.5. Further, the type of use should be the basis for required parking, not the form of ownership. The provision relating to separate electric and gas metering and shut-off also seems to have originated from the residential condominium section, where it is intended to protect individual resident -owners in attached housing projects from paying for another resident's excessive power or gas usage. While the same separate metering might be useful in office or commercial condominiums, making it an absolute requirement to for all cases seems inflexible and unwarranted. Given the varieties of possible commercial condominium arrangements (ranging from occupant owned to investor-owned but managed by a separate leasing company) the choice on whether to have separate shut-off systems should be the developers based on the project design, and the anticipated ownership and use of the project. The current design standards for commercial condominiums include requirements for parking per "unit" and for electric and gas meters and shut-off valves for each "unit"; B. "Unit" is not a description or standard of measurement for commercial projects that is referenced elsewhere in the zoning ordinance. Commercial land uses are typically described or measured by square -footage, or number of rooms, making it questionable whether these referenced sections are reasonable or useful; C. The subject text amendment is exempt from the requirements of the California Environmental Quality Act (CEQA), pursuant to the general rule set forth in Section 15061(3) of the CEQA Guidelines, as there is no possibility that the modification to the hotel definition may have a significant effect on the environment. NOW, THEREFORE, the City Council of the City of Hermosa Beach does hereby ordain that the Municipal Code, Appendix A, Zoning Ordinance, Article 7.2, Division 3, be amended as follows: SECTION 1. Amend Section 7.2-12(g) by eliminating the last paragraph the reads "Furthermore, a minimum of two (2) parking spaces per unit shall be required," and amend Section 7,2-13(0 sub -section 1., by eliminating the last paragraph that reads "Furthermore, a minimum of two (2) parking spaces per unit shall be required," SECTION 2. Director Blumenfeld said this item arose in connection with a proposed hotel project. This article contains restrictions for CUPs and CC&Rs, and includes an obsolete provision referencing the Hermosa Improvement Commission, which is defunct. He explained the various changes reviewed and proposed by Staff, which were applicable to residential condominium development, not necessarily reflecting commercial condominium development. Staff recommended approval of this Text Amendment in order to delete obsolete references and eliminate use currently -established use restrictions. Commissioner Perrotti noted a typographical error on page 3, line 27, which should read, "Section 7. Subsection 1". Director Blumenfeld said this correction would be made. Commissioner Perrotti suggested that at a future meeting, paragraph D on page 8 dealing with assessments should be changed giving a more flexible definition. Chmn. CONSTRUCTION, MAINTENANCE AND DEVELOPMENT—CONII IERCIAL/INDUSTRIAL Sec. 7.2-7. Applicability. This division applies to new construction of commercial and industrial condominiums. (Ord. 81-675, § 3, 10-13-81) Supp. No. 5-88 466.40 Sec. 7.2-8. Findings and intent. (a) The city council finds that such condominium, stock coop- erative, and commercial planned development projects are differ- ent from other types and forms of commercial and industrial land use ownership development and so require different zoning and subdivision regulations. • • (b) It is the expressed intent of the city to treat such projects differently from commercial rental structures and other like struc- tures. The intent of this division is to further the city's general plan goal of providing a balanced mix of commercial stock in the city by regulating the placement and design of condominiums and like projects. (Ord. No. 81-675, § 3, 10-13-81) Sec. 7.2-9. Purpose. The purpose of this division is to establish criteria for commer- cial and industrial condominiums: Supp. No. 5-88 • 466.40.1 Q § 7.2.9 APPENDIX A—ZONING ' § 7.2-9 (a) Architectural unity and harmony should be achieved both within the project and the surrounding neighborhood so that it promotes stability of and does not constitute a dis- ruption to the established character of the neighborhood. (b) Provide for a high level of safety, compatibility and quality of the design of buildings, signs, parking areas, landscap- ing, luminaries, and other site features. These may in- clude functional aspects of the site development such as automobile and pedestrian circulation. (c) A comprehensive and integrated design, providing its own open space, off-street parking, and amenities for contem- porary living. Insofar as the scale of the project allows, open space, walkways, and other areas for people, should be separated from parking areas, driveways, and other areas for automobiles. (d) A layout of, structures and other facilities to effect conser- vation in street, driveway, curb cut, and other public and quasi -public improvements. Additionally, structures should be designed to minimize, within the context of accepted architectural practice, the consumption of natural resources such as sunlight, air circulation, view sheds, and energy. (e) A design that maintains as much of the natural topogra- phy and environment as practical. Trees over six (6) inches in diameter should not be removed unless it can be demon- strated that their removal is an unavoidable consequence of development and that any trees removed will be re- placed by comparable landscaping. (f) A configuration and orientation which respects reasofiable design limits imposed by the natural and man-made envi- ronment. Structures should be situated to take advantage of view, topography, sun, and wind, while at the same time not obstructing comparable advantages for adjacent prop- erties. Structures should also be situated to minimize or buffer any undesirable characteristics of the site such as street noise and nearby deleterious commercial or indus- trial uses. (g) The layout of units and open space within the project should establish, through the use of structure and man-made and Supp. No. 4-87 466.41 § 7.2-10 HERMOSA BEACH CITY CODE § 7.2-12 landscape materials, a perceptible spatial transition from the public street, through semiprivacy of common areas. The environment of each condominium unit should be free from visual, audio, and other intrusions. (h) Provision by the project sponsor of adequate parking space to meet the needs of long term property owners. (i) Covenants, conditions, and restrictions ensuring that po- tential problems, resulting from lack of continuous and centralized management, do not impact upon the public health, safety, and welfare. (Ord. No. 81-675, § 3, 10-13-81; Ord. No. 83-717, § 1, 1-25-83) Sec. 7.2-10. Standards for uses. All commercial/industrial condominiums require a conditional use permit. The use restrictions for the zone in which the prop- erty is located shall apply. (Ord. No. 81-675, § 3, 10-13-81) • Sec. 7.2-11. Permits required, application procedure. All commercial and industrial condominiums shall meet the restrictions, submit the applications and secure the permits re- quired by the applicable provisions of this article. (Ord. No. 81-675, § 3, 10-13-81) Sec. 7.2-12. Covenants, conditions and restrictions. No tentative map or permit shall be approved upon the condi- tion that a declaration of covenants, conditions, and restrictions, containing the following provisions, be approved by the planning director and the city attorney prior to the approval of the final map: (a) Maintenance of common areas. Perpetual maintenance by the associated owners, in good sanitary and attractive condi- tion, of all common areas and improvements, including landscaping areas, walls, driveways, parking areas, trash areas, and buildings, in accordance with plans and docu- ments on file in the Department of Building and Safety, City of Hermosa Beach. The management structure shall be in existence for the life of the building and that struc- ture must clearly be delineated. Supp. No. 4-87 466.42 l/ § 7.2-12 C APPENDIX A—ZONING § 7.2-12 (b) Maintenance of fire protection equipment. All fire hydrants, fire alarm systems, portable fire extinguishers and other fire protection appliances shall be maintained in operable condition at all times by the owner's association. (c) Right or public entry to common areas. The City of Hermosa Beach, County of Los Angeles, State of California and Government of the United States, and any department, bureau, or agency thereof, shall have the right to access to the common area of the project at all times for the purpose of preserving the public health, safety, and welfare. (d) Assessments. Provisions shall be made both for annual assessments for maintenance and special assessments for capital improvements. The amount of the annual assess- ments as well as the data and procedure for its increase shall be specified and shall be limited to the estimated yearly payment of real property taxes and maintenance and improvement expenses incurred with respect to the common area. The manner in which special assessments may be levied for the purpose of defraying, in whole or in part, the cost of any construction, reconstruction, repair or replacement of any capital improvement upon the common area shall be specified. Both annual and special assess- ments must be fixed at a uniform- rate for all units and may be collected on a monthly basis. (e) Remedies for nonpayment of assessments. The remedies which the association may bring for the nonpayment -of assessments shall be specified and may include .penalties for late payment. In consideration for the city's approval of a condominium project, the declaration shall provide that the city may act as the agent of the association and may in the name of the association do any of the following in the event of abandonment of individual units of the project: 1. Do or perform any act that the association may do or perform. 2. In the event of default by the association according to its own bylaws and declarations, the city may, without otherwise complying with the provisions of the decla- rations, fix the annual assessment against each unit. Supp. No. 4.87 466.43 § 7.2-12 HERMOSA BEACH CITY CODE § 7.2-12 3. If the city, in its discretion, determines the association is not diligently attempting to collect the amounts owed the association, the city may, in the name of the association, take any legal steps to collect such amounts by actions of law as the city may determine to be necessary. It shall be specified that in the, event the city should exercise any of the above specified remedies, any sums recovered from such suit or suits shall be applied first to cover the city's cost. The bal- ance shall be applied against any amount which is then lawfully owing to other public or private entities. All remaining sums belong to the association. (f) Nonconforming projects. If the condominium project has become nonconforming due to changes in the zoning ordi- nance or the general plan and if it is determined by the fire and building departments that three-fourths of the project has been destroyed or substantially damaged, the project shall not be rebuilt or reconstructed, unless it is done according to existing development standards. Further, if the fire and building departments find that the project has been damaged or destroyed to such an extent that a mate- rial part of the project has not been rendered unfit for its prior use and has not been repaired for a period of three (3) years after such damage or destruction, then said noncon- forming status would be lost and the project could only be reconstructed in conformity with existing zoning require- ments. Any property owners affected by the findings of the fire and building departments may, within thirty (30) days after written notice of these findings, appeal to the city council. (g) Parking spaces. All parking spaces shall be used solely for the purpose of parking motor vehicles, as defined in the Motor Vehicle Code of the State of California (Vehicle Code, Section 415). When the intensity of use is increased through the addition of floor area or change in use, addi- tional parking and loading shall be provided as required by Section 1150 of the City Zoning Code. Furthermore, a minimum of two (2) parking spaces per unit shall be required. Supp. No. 4-87 466.44 ' -A3 § 7.2-13 APPENDIX A—ZONING § 7.2-13 (h) Approved plans binding on association. The covenants, con- ditions, and restrictions shall state that the final city ap- proved building plans and landscaping plans are binding on the association. Any changes to these items must first secure the approval of the planning commission. Within thirty (30) daysof submitting covenants, conditions, and restrictions to the Los Angeles County Recorder, applicant shall provide the city with a certified copy of the cove- nants, conditions, and restrictions recorded with the Los Angeles County Recorder. (Ord. No. 81-675, § 3, 10-13-81; Ord. No. 82-717, § 1, 1-25-83) Sec. 7.2-13. General design standards. The project shall conform to the following general design standards: (a) General plan. The project shall be consistent with the gen- eral plan. (b) Architectural unity and harmony. Architectural unity and harmony should be achieved within the project between the project and the surrounding neighborhood so that it promotes the stability of and does not constitute a major disruption to the established character of the neighborhood. (c) Landscaping. Provision of permanently maintained land- scaping as approved by the- Hermosa Improvement Com- mission shall be required. (d). Lighting. The developer shall install on-site lighting in all parking areas, vehicular accessways and along major walk- ways of more than twenty-five (25) feet. Such lighting shall be directed onto driveways and walkways within the project, and away from dwelling units and adjacent properties, and shall be of a type approved by the building department. (e) Residential standards. A commercial planned development, where it includes residential units, shall meet the residen- tial standards of sections 7.2-4 through 7.2-6. (f) Technical standards. 1. All condominium projects shall meet current State of California energy conservation standards. All commercial condominium projects shall be required to comply with Article 800, Section 805, Placement of Buildings. All condominium projects shall comply with the parking requirements stipulated in Article 11.5 of the Zoning Code of Hermosa Beach. Furthermore, a minimum of two (2) parking spaces per unit shall be required. • 2. All condominium projects shall comply with the fire, plumbing and electrical codes of the City of Hermosa Beach. 3. All industrial condominium projects shall be required to comply with Article 9 of the zoning code. 4. Each unit shall have its own electric meter and shut- off system, and the same shall apply to gas where it is possible. This requirement is to be met within sixty (60) days of closing of escrow of each unit. (g) Compliance with fire protection standards prior to final map approval. All condominium projects shall be subject to review by the fire department to determine whether the current water delivery system complies with the city's fire flow requirements as they would apply to new construc- tion, and if not, whether the installation of additional water service improvements should be required for fire protection purposes. The subdivider shall install such ad- ditional water service improvements as may be specified by the fire department, in accordance with city standards and specifications. Installation of required water service improvements shall be completed prior to approval of the final map unless an agreement for this subsequent instal- lation is entered into between the subdivider and the city. A smoke detection system which rings a local alarm sys- tem and transmits a signal to the fire department dispatch shall be provided. A final report shall be submitted by the fire department by the time a final map is filed, or a permit becomes effective. (Ord. No. 81-675, § 3, 10-13-81; Ord. No condominium or planned unit development project may be occupied until a certificate of occupancy is issued by the building department. An occupancy certificate shall not be issued until all the requirements of this division and the conditional use permit are satisfied. (Ord. No. 81-675, § 3, 10-13-81) DIVISION 4. CONVERSIONS TO RESIDENTIAL* Sec. 7.2-15. Findings and intent. (a) Effect upon community. Condominium conversions, commu- nity apartments and stock cooperative projects provide for indi- vidual ownership or its functional equivalent of separate dwell- ing units which usually are in close proximity to one another. The area surrounding the dwelling units is a common area that is normally managed and maintained by the individual owners of dwelling units in accordance with an owner's association agree- ment. These hybrid forms of ownership, that mix individual own- ership and ownership in common, magnify the impact on public health, safety, welfare, convenience and economic prosperity of a large community when conditions of poor land use and site plan- ning, mismanagement, neglect and blight are allowed to occur. Additionally, the conversion of existing apartment and other multiple -family dwelling structures into condominium conversions, community apartments or stock cooperative apartments has the potential of displacing long-term residents, particularly senior citizens and families with school-age children, who may be re- quired to move from the community due to shortage of replace- ment rental housing. (b) Findings. The city finds and determines that condominium conversion, community apartment and stock cooperative projects differ from apartments in numerous respects and for the benefit of public health, safety and welfare, such projects should be treated differently from apartments. *State law references—Conversion of condominium or community apartment house projects from residential real property,.Gov.
