(c) Letter from Anna Parker dated February 28, 1984 (to item 4). PUBLIC HEARINGS 3. APPEAL FROM DENIAL BY THE BOARD OF ZONING ADJUSTMENTS OF A VARIANCE ON PROPERTY LOCATED AT 906 - 15th PLACE. Michael Schubach, Appellant. Memorandum from Acting Building Director William Grove dated February 9, 1984. (Continued from 2-14-84 meeting). This appeal was withdrawn by Mr. Schubach per his letter of February 28, 1984, received that date. 4. APPEAL FROM DENIAL BY THE PLANNING OCOMMISSION TO AMEND THE ZONING MAP, GENERAL PLAN, LOCAL COASTAL PLAN, APPROVE A DEVELOPMENT AGREEMENT AND PARCEL MAPS FOR A PROJECT SUBMITTED BY THE HERMOSA BEACH SCHOOL DISTRICT. Memorandum from Planning Director Pamela Sapetto dated February 8, 1984. Supplemental Information -Letter, from School District dtd 2-23-84. City Manager Meyer advised Council that since this item was placed on the agenda, a letter had been received from the School District requesting a withdrawal of this item. ACTION - To continue this item to the meeting of March 13 on the basis that the record before the Council is not complete and to instruct the City Attorney to clarify for the School District the question of the subdivision of the zoned properties. Motion Schmeltzer, second Barks (discussion) Councilman Wood arrived at 7:55 P.M. during the discussion on the above motion. Wilma Burt made a point of order from the audience regarding the fact that if this item is continued to the meeting of March 13 after the School Distict requested withdrawal, then . item 3 above should also be continued rather than a withdrawal granted. City Attorney Post advised Council that if an applicant requests withdrawal of an appeal before it is acted upon, then it is withdrawn. However, if Council feels, because of the expressed public interest in the matter, that further discussion would be appropriate, the public hearing could be continued even though there is nothing to act on. CREATION OF A LANDSCAPING MAINTENANCE DISTRICT FOR FISCAL YEAR 1984-85. Memorandum from Public Works Director Charles Clark dated February 23, 1984. City Clerk Malone stated that the mailing, publication and posting regarding this hearing had been completed and affidavits were received for same. Public Works .Director Clark presented the staff report indicating that 6,042 notices for the public hearing had been sent out and 284 of these returned. Noting that a protest is based on 50% of the owners of 50% of the assessable area in the City which has 28 million square feet, protests were received in reference to only 61,280 square feet. City Manager Meyer advised Council that the purpose of this district was to raise funds for a specific project, namely the maintenance of the landscaped areas of the City and portions of the other open space, specifically City parks. These areas, are currently maintained but, through this special assessment, monies would be earmarked for only that purpose. It was stressed, that although seven different ways to calculate the assessment were established, 80% of the people would fall within two of these zones - homes $.60-$1.10/lineal ft. frontage. As proposed, approximately three-fourths of the amount presently spent by Public Works for these tasks,.or $237,000, would be .raised by this assessment. When questioned by staff, Public Works Director Clark stated • that the only parcels in the City that would not be affected by this.assessment would be government property. City Manager Meyer presented a list, prepared by the Assessment Engineer, of elected officials, candidates and other parcels within the City showing lot sizesand assessments as proposed._ r. Clark advised Council that there are presently two maintenance people assigned to the medians and seven to parks maintenance. City Attorney Post noted that each year Council would make a determination as to what it would cost to maintain the district and, if you have a surplus in one year, you could reduce the amount that is assessed in the following year. Minutes 2-28-84 LANDSCAPING MAINTENANCE DISTRICT (continued) The Public Hearing was opened. City Clerk Malone noted that 15 protests had been received. Assessment Engineer Patrick Rossetti stated that written protests must be read at the time the district is established, however, City Attorney Post advised that if Council receives and considers written protests this would be sufficient. Cost too high' -:'use volunteers. Not within present law to add local tax. Senior citizen on small fixed income would feel hardship. Public Works does not have expertise to manage. Present maintenance adequate. Objection to formation of district. Exorbitant fees already asked for over and above what is paid. Genevieve Batchelor - 631 Longfellow - keep hands off tax bills Anna Belche - 505 Hollowell - re maintenance of Prospect Heights School Jim Listener - 2715 El Oeste - provision for cost control, yearly renewal, protests both districts. Mildred Michaels - 515 - 8th Street - unfairness of assessment for single family versus multi -unit lots - approves but not method of taxation. Charles Bowman - 1821 Pacific Coast Highway - supported advisory ballot measure but urges further evaluation. Lorraine Jensen - 1222 - 14th Street - one house on two lots, limited income, stressed protest and questioned where money that was freed up would go. Marymae;: Cioffi - 850 - 18th Street - requested cap on upper limits of expenditures -and questioned source of General Fund. Bob Parker - 1415 Prospect -.felt Notice of Improvement should have been Notice of Proposed Improvement or Notice of Assessment; also questioned change in maintenance costs as follows: 1981-1982 -$96,000 1982-1983 - 115,000 medians only 1983-1984 - 300,000 - includes all open space, parklands, medians, etc. Protests vigorously. The Public Hearing was closed. PROPOSED ACTION - To receive and file and thank staff for their effort. Motion Wood. Dies for lack of a second. Motion Barks, second Mayor Brutsch AYES - Barks NOES - Webber, Wood, Schmeltzer, Mayor Brutsch Motion fails Upon questioning of Council, City Manager Meyer stated that the General Fund two years ago had a deficit of $1.2 million and last year the deficit was $200,0.00. Mr. Meyer also stressed that the substitute motion would provide a 0 tax rate for 198485.and should this measure pass in November, the on-line time for the creation of the District assessments would be for the tax year 1985-86. FURTHER PROPOSED ACTION - To approve the Landscaping. Maintenance District as recommended by staff. District before the voters at the November election reducing the rates by 50% and altering it to be in force for one year. Motion Barks, second Schmeltzer Councilman Wood called this motion out of order stating that a failed motion can only beintroduced once a meeting. CREATION OF A CROSSING GUARD DISTRICT FOR FISCAL YEAR 1984-85. Memorandum from Public Works Director Charles Clark. dated February 23, 1984. City Clerk Malone stated that the mailing, publication and posting regarding this hearing had been completed and affidavits were received for same. Public Works Director Clark presented the staff report noting that certain modifications that were made in the assessment methods require a resolution and schedule of modifications be adopted creating benefit zones in the assessment district. ACTION-- To adopt Resolution No. 84-4685 entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH, CALIFORNIA, MODIFYING THE ASSESSMENTS AS SHOWN ON THE ATTACHED SCHEDULE. Wilma Burt - 1152 - 7th Street - asked for clarification of City Manager's portion of proposed budget. Burt Bussiere - 1857 Harper - questioned zoned benefit theory and suggested uniform taxation level. -9- Minutes 2-28-84 CROSSING GUARD DISTRICT (continued) City Manager Meyer replied to questions noting that the money allocated for the City Manager in the proposed budget is for administrative costs.only. AL,so.•inreply to Mr. Bussiere's question regarding the ad valorem philosophy, Mr. Meyer stated that staff's recommendation to do it by zone was because,in view of Proposition 13, this was the most legally defensible method. The Public Hearing was closed. City Attorney Post advised Council that the law setting up Maintenance Districts calls for their adoption by ordinance. Therefore, the resolution and enacting clauses should be changed from a resolution to an ordinance.. ACTION - To waive full reading of Ordinance No. 84-747 entitled "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH, CALIFORNIA, CONFIRMING THE REPORT OF THE DIRECTOR OF PUBLIC WORKS DATED JANUARY 20, 1984, PREPARED PURSUANT TO RESOLUTION NO. 83-4652 AND APPROVED PURSUANT TO RESOLUTION NO. 84-4678 OF SAID COUNCIL, AND THE PLANS, SPECIFICATIONS, ESTIMATE, DIAGRAM AND ASSESSMENT CONTAINED IN SAID REPORT: ORDERING CERTAIN CROSSING GUARD MAINTENANCE SERVICES TO BE FURNISHED AND .MAINTAINED FOR THE FISCAL YEAR BEGINNING JULY 1, 1984." Motion Wood -)withdrawn by the maker of the motion. -10-Minutes 2-28-8 FIFTEEN MINUTE GRACE PERIOD (continued) The staff report was presented by General Services Director Joan Noon. A correction was made in the original estimate of the number of warning notices that had been given since the inception of the program. The correct figure is 17,050, not the 45,000 as originally stated. This figure represents approximately 40 warning notices per day issued. City Manager Meyer advised Council that if the 17,050 warning notices had been issued as tickets, the revenue to the City would have been between $150,000-$200,000. Councilman Wood suggested to Council that after the Hearing is concluded, rather than acting on this issue, have a workshop to address General Services' problem. The Hearing was opened. Speaking were: Bill Fowler - Hermosa Beach Chamber of Commerce - noting improvement in image, business increase, goodwill generated in a positive way. James Smith - 2200 Hermosa Avenue - reputation has improved. Gary Frost - 2900 Tennyson - owner of Coast Drugs - feels Hermosa Beach is a "parking trap" and is opposed to eliminating the 15 -minute grace period. Mark Cowan - Pacific Screen Prints - 138 Pier Avenue - stated that feedback was not solicited from the local merchants, suggested amnesty program for ticket -holders, and represented other business' in the downtown area in favor of retaining the grace period. Charles Bowman- 1821 Pacific Coast Highway - in favor of the. grace period. Maryniae..•= Cioffe - 850 - 18th Street - in favor of grace period. George Soulakis -.2726 El Oeste - encouraged promotion of the grace period but urged strict enforcement. Jim Listener - 2715 El Oeste — suggested amnesty program with receipts from Hermosa Beach merchants. The Hearing was closed. ACTION - To receive and file. REQUEST TO AWARD A SERVICES AGREEMENT TO MANHATTAN CAR WASH TO CLEAN AND WASH CITY SEDANS AND PICKUP TRUCKS. Memorandum from City Manager Gregory T. Meyer dated February 2, 1984. City Manager Meyer presented the staff report.., City Attorney Post advised Council that the Supreme Court has ruled invalid a City's local preference in hiring. ACTION - To approve the staff recommendation authorizing the City to enter into a Services Agreement with Manhattan Car Wash to clean and wash City sedans and pickup trucks at, the rate of $2.00 per vehicle. MISCELLANEOUS ITEMS AND REPORTS - CITY COUNCIL (a) ATSF Railroad Right -of -Way Subcommittee Report - Councilman Wood - Suggested this item for the closed session of. March 13, 1984. Councilman Wood reported on his trip to Sacramento this date noting that mention was made during a presentation regarding help being available for utilities and rail transportation - B. T. Collins, Peabody, Kidder, Peabody & Company who finance railroads. He suggested someone contact this person - the subcommittee will discuss this. -12- Minutes 2-28-84 MISCELLANEOUS ITEMS AND REPORTS - CITY COUNCIL (continued) (b) Business Subcommittee - Report on Possible Assessment District - Councilman Wood. A meeting was.held with property owners and, business owners at the Chamber of Commerce office regarding the parking/parking lot issue West of Pacific Coast Highway in the area of 2nd and 3rd Streets. 25 people were in attendance at this meeting. All were in agreement to have staff reports, etc, to begin,the formation of a Parking Assessment District from the South side of 4th Street to the City border on the South, on the West side of Pacific Coast Highway to some undetermined depth,to float a bond.to make some improvements and put in parking meters or Tic -Fax machines. Also to do some exchanging of properties which would satisfy Vasek Polak's requirement, free up the City's lot for parking and engineer a swap of one of the lots that Vasek Polak owns in exchange for other City lots. Councilwoman Webber reported that the•27th Street Environmental Protection Association would like to table this issue until after the April 10 election - no solutions were presented by the 27th Street group. ORAL COMMUNICATIONS FROM PUBLIC —MATTERS OF AN URGENCY NATURE Parker Herriott - 224 - 24th Street - spoke regarding the proposed Heliport at Portofino's in Redondo Beach. Having been present at the Redondo Beach City Council meeting on February 27,. Mr. Herriott reported that a decision was made that they would listen to the residents •who were opposed to the heliport. There will be a demonstration of the helicopter landing, etc. at 5:00 P.M. on Monday, March 12. He advised Council that Torrance Airport knows nothing about this proposal and would not allow any type of shuttle service out of their airport because of the noise. Motion Schmeltzer, second Brutsch. So ordered. (c) 'Sacramento Trip - Councilman Wood Councilman Wood reported on his trip to Sacramento this date. He stated that both representatives from this District look favorably on the Mark Portesi proposals which essentially providea predictable source of funding. and do away with the bail-out provision terms in the legislative acts. It will probably provide that the cigarette tax and, vehicle in -lieu fee be funded directly to the cities. The only possible resistance would be from the school districts whichare:concer-ned. about a potential loss of funding, the consensus being that it would have no effect on the schools. Also the liens for vehicles legislation was discussed. Mr. Beverly has it in the Senate and it is in Committee and will come out on March 6. .There is no apparent opposition. (d) Hermosa Beach School District SCHOOL DIGEST - Councilman Wood Councilman Wood would like '..the opportunity to show the other side of the issue of the sale of the school sites. He referred to a recent issue of the SCHOOL. DIGEST which was sent home with the .school children.
