Honorable Mayor and Members City Council Meeting of of the City Council February 14, 1984 MEN'S OPEN SUMMER VOLLEYBALL TOURNAMENT SPONSORSHIP CONTRACT Recommendation It is recommended that Your Honorable Body approve the attached contract between the City of Hermosa Beach and Event Concepts for joint sponsorship of.the Men's Open Volleyball Tournament, July 21 and 22, 1984, as recommended by Staff and the Community Resources Commission. Background Event Concepts sponsored this Tournament last year, July, 1983. At that time, the City received total revenue of $2,792.50. Expenses for.the tournament were $1,340.10. The net gain from that tournament was $1,452.40. Analysis The tournament of 1983 was very successful. However, one area of possible potential trouble is the blatant violation of drink- ing on the beach. As we are aware, the drinking will never stop even if another sponsor is found. However, staff feels it can be controlled and monitored more.closely.. Measures have been taken to mitigate this problem as much as possible. Event Concepts will have a security force of no less than eight people at any one time for crowd control and to quietly inform individuals of the open container ordinance. This is done at the Cuervo Tournament in Redondo'Beach and has worked out very well. As a follow up to last year's tournament, staff solicited evalu- ations from elected officials, Department Heads, and various merchants in the City. The overwhelming response was approval -2- of the tournament. The few negative remarks were the concern for the blatant abuse of drinking on the beach. And as indicated above, we believe we have taken steps to mitigate that for next year's tournament. Also, the Department was approached by a new volleyball organization called The Association of Volleyball Professionals, to sponsor this same tournament. Meyer City Manager I " J AC,RFRMF.NT This agreement is entered into on February 14, 1984, at Hermosa Beach, California by and between EVENT CONCEPTS, INC., a California corporation (EC) and the CITY OF HERMOSA BEACH (CITY), with regard to the following facts: a) EC is a sales promotion company which annually promotes professional beach volleyball tournaments comprising the Pro Beach Volleyball Tour. b) CITY administers beaches in Hermosa Beach, California, and annually stages beach volleyball tournaments, in- cluding the Hermosa Beach Open. c) EC and CITY are desirous of entering a relationship with regard to the 1984 Hermosa Beach Open. Therefore it is agreed as follows: 1) Event Concepts will, upon gaining sponsorship support from a major beer company, pay to the CITY a fee of $1,750 for use of the Pier Avenue volleyball courts July 21-22, 1984. 2) Event Concepts will provide up to four portable toilets; at same location as previous year. 3) Event Concepts will pay costs for a maximum of four hours supplemental trasli pick-up, Saturday and Sunday nights, July 21 and 22. 4. Event Concepts will guarantee a minimum prize purse of $10,000. In no event is the CITY liable for the prize money. 5) Event Concepts will guarantee a minimum advertising support expenditure of $10,000. 6) Event Concepts will produce a minimum of 2,000 posters in support of the event and a minimum of 5,000 special Hermosa Beach Open issues of BEACH VOLLEYBALL MAGAZINE. Event Concepts is responsible for distribution. 7) Event Concepts will include the Hermosa Beach Open in all Tour -wide schedules, posters, ads in the National Outdoor,Volleyball Association schedule ar ity listings of the Tour. 8) Event Concepts will provide the CITY a Certificate of Insurance providing liability insurance naming the CITY, its officers, employees and agents as additional insured with a minimum coverage of $1,000,000 combined single limit coverage. 9) Event Concepts will provide a tournament scoreboard, volleyballs, trophies and fees for referees, at no cost to the CITY. Event Concepts has the option to use the CITY'S scoreboard. 10) EC will pay the cost for Police officers to supervise the event both days; the chief of police will mandate the num- ber of officers and hours worked. In the event of an'emer- gency or other situation arising which necessitates addi- tional security, Event Concepts is responsible for the additional costs incurred. 11) Event Concepts will supply a security force of their own, minimum of eight at any one time to supervise the crowd and alert all present to the "Open Container" Ordinance of the City. All such personnel shall be wearing identifiable T-shirts. 12) Event Concepts will be permitted to sell custom Hermosa Beach Open volleyball T-shirts at the beach subject to prior approval of the graphics by the CITY of HERMOSA BEACH. 13) Event Concepts will have the first right of refusal to sponsor the event in the years 1985 and 1986, with a new agreement signed no later that December of each year. Each party shall review the success of the event following its conclusion, and either party may terminate continua- tion or renewal of this agreement by submitting written notification of termination to the other party prior to August 31, 1984. 14) Event Concepts will collect entry fees from players which projects to approximately 40 teams at $10 apiece, or a total of $400. Event Concepts shall pay all entry fees to CITY. 15) The CITY will permit the attachment of the.sponsor's name to the official event title and shall permit use of spon- sorship signage, product replicas and other props to iden- tify tournament sponsors on the beach. 16) The CITY shall be notified no'later than May 15, 1984, of any co-sponsors supporting the Tournament. Each co-sponsor shall pay to CITY a fee of $100. 17) CITY shall provide a tournament director and eight volley- ball courts with nets, suitable for tournament competition. x. .. .. ..�,x.r... Al 18) CITY shall permit Event Concepts to place two event banners announcing the tournament, at mutually agreed locations, for the period of two weeks preceding the event. 19) CITY shall permit the staging of a regional bathing.beauty competition for one hour, beginning at 1:OO p.m., July 21, in conjunction with the volleyball tournament. Procedures and guidelines for staging the bathing beauty competition will be submitted to CITY's Community Resources Department for approval. Said competition shall take place at the south side of the Pier and shall not impede lifeguarding activities. 20) CITY shall request the Los Angeles County Department of Beaches to level the beach before 7:00 a.m. on July 21 and July 22. 21) CITY shall make its best effort to arrange parking facilities around Hermosa Beach and arrange shuttle bus service to the tournament, at no cost°to EC. EC shall include parking and shuttle information in pre -event advertising and publicity. EC shall also produce directional signs for the event for posting at locations. specified by the CITY. I reside in Manhattan Beach and as a result could not vote on the two referendums pertaining to the establishment of a "Landscaping Maintenance District" or a "Crossing Guard Maintenance District." I will be out of town on February 28th, the date the Council expects to take action. This letter requests some answers to some questions which I will include in this epistle, each question will be underlined, and all of which I would appreciate an answer from you. If you have had landscaping in the past in certain areas, who took care of it and how was it paid for? The same question applies to the crossing guard question. What benefit on landscaping is available in the area of my property at 225 Longfellow? What do you mean by approximately $1.00 per lineal frontage foot? Does approximately mean more or less than $1.00? How have you paid for crossing guards up to this time? Why cannot this payment for crossing guards be continued as it was? I do, however, believe that crossing guards are essential. It is apparent to me that my taxes will escalate substantially as a result of the referendum. Background Due to declining enrollment, the Hermosa Beach School District --the project applicant proposes to consolidate the entire student body of the district and all school operations at the existing Hermosa Valley School site. Two elementary schools in the District have already been closed --Prospect Heights School in 1977, and South School in 1980. Furthermore, two currently underenrolled elementary schools --North School and Hermosa View School --are scheduled to be closed in 1985 and their students transferred to Hermosa Valley School. In order to accommodate the additional students, Hermosa Valley School will require renovation and new improvements. As a means of financing the improvements at Hermosa Valley School, the District proposes the sale of the South School site. To prepare the South School site for sale and future development, the School District proposes to rezone the property for residential and park purposes and to amend the General Plan accordingly. In addition to the proposed zone changes and General Plan amendments for Hermosa Valley School and South School, the School District is also proposing a series of zone ' changes and General Plan amendments on the remaining three school sites --Hermosa View School, North School and Prospect Heights School (see attachment I). There are no plans to sell these sites in the near future. The School District has been experiencing a steady decline in enrollment. The following is a summary of enrollment history for the School District: 1962-1963 2,141 students 1966-1967 1,918 students 1970-1971 1,758 students 1974-1975 1,368 students 1978-1979 1,049 students 1979-1980 944 students 1980-1981 910 students 1981-1982 884 students 1982-1983 815 students The School District is specifically asking for the following changes: (See attached ZONING AND GENERAL PLAN SUMMARY). To accompany these changes is a request to adopt a development agreement and to amend the Local Coastal Plan accordingly. On December 19, 1983, the Board of Zoning Adjustments reviewed the environmental impact report (see attached EIR for their comments). The Planning Commission reviewed the proposal and EIR on January 3, 17, and 31 of 1984. The Planning Commission denied the project application on 1-31-84. Attached is Resolution #84-3 which describes their action: Analysis GENERAL PLAN The existing community park and recreation areas (exclusive of the beach) represents only .74 acres per thousand persons, which is well below various national standards that range from 2.5 to 10 acres per thousand persons. The net effect of this project is that 7.10 acres of General Plan open space would be converted to residential uses. The open space element of the General Plan: "In order to assure that the open spaces shown on the Open Space plan shall remain available to the citizens of Hermosa Beach, the following action plan is to be followed: Policy 24: School Grounds. The City and the Hermosa Beach School District shall maintain the agreement whereby those school lands shown on the Open Space Plan as permanent open space shall be preserved in public ownership. To accomplish this, the City may: 1. Purchase or lease surplus school properties should such become available, -2- 1. so that property can be maintained for open space and recreation use. 2. Prohibit the use of designated open space for development for other than open space purposes even though sold to private ownership." The school district's project proposes to preserve, by virtue of sale donation, some open space at each site (attachment 1): Proposed City Acquisition Prospect Heights Playgrounds .57 acres South School Park Site 1.30 acres North School Play Field 2.22 acres Seaview Parkette .29 acres TOTAL: 4.38 acres This proposal is consistent with the following statement derived from the open space element: "All possible steps will be taken to maintain property owned by the Hermosa Beach Elementary School District for open space/recreation use without detriment to the education system." It can be argued that the school district's future efforts might be hampered through inadequate funding, which could have been avoided had the school district been permitted to sell its surplus land. Although staff is of the opinion that a greater percentage of school district land set aside for permanent open space would be preferable, the fagts remain that the school district: 1. By State Law, does not have the option to "give" property to the City and the City does not own the property designated open space in the Genral Plan, and therefore, must consider the property rights of the district from a legal perspective; and 2. Requires funds in order to centralize and more efficiently provide an effective service to this community. "1 he school district is funded by all property tax payers, yet not all property tax payers derive a benefit from the school district; many households have no children. Now that the school district is considering revamping its activities and departing with much of its underused property, it can validly be argued that such property should transform into a use that benefits the community at large, i.e., the majority of those who have provided the revenue to operate the school system through the years; a benefit to the communtiy at large is open space. The school district's intention of centralizing its activities is a logical move. It is also quite apparent that it will require additional funding to adequately provide for the additional students, administrative offices, maintenance equipment, increased parking, baseball and soccer fields at Hermosa Valley School, new landscaping buffers, etc. Therefore, the sale of additional sites can be viewed as augmenting planned improvements at the central location, and as serving as a contingency fund to mitigate unforeseeable circumstances. The proposal reduces the -4- potential by 18 units. This premise is based on construction of units i.e, single family residences or apartment units which require no descretionary actions on the part of the City. However, if a planned or condominium development were proposed, the project would have to be consistent with the General Plan according to Government Code Section 65680. In this case, the only portion of school property which can presently be residentially developed is the northern 2.3 acres zoned R-3/low density (maximum 13 du/a) which would yield a maximum of 30 units. PARCEL MAPS Three parcel maps have been submitted, the first (map #16022) is associated with subdivision of Prospect Heights School into two parcels, one to be sold to the City, the other to be eventually developed residentially. The second (map #16023) demonstrated the subdivision of Hermosa View School into two parcels, one to be sold to the City, the other to be eventually developed residentially. The third (map #16128) describes the division of North School into two larger parcels so that the existing small lot subdivisions are deleted. DEVELOPMENT AGREEMENTS The purpose of the development agreement is to protect both the City and the School District that the stipulations agreed to pursuant to this project application are met. It guarantees the City the ability to acquire more open space land and guarantees the School District the zone changes irrespective of future Boards or City Councils. The development agreement is consistent with local and state requirements (Government Code Section 65864-65869.5); there is a question about Provisions 10(a), (4), and (b)(4) which indicate R-1 zone and low density for Seaview Parkette (Hermosa View School). The inconsistency here is that the application for zone change (et al) for Hermosa View School indicated that Seaview Parkette would be sold to the City. Staff recommends this property be rezoned to open space. EIR REVIEW It is the responsibility of the Planning Commission and the City Council to include the environmental information presented in the draft EIR as part of their decision-making -5- process. If there are any negative environmental impacts indicated, then the mitigation measures identified in the EIR must be required as a condition of approval of the project. It is also the responsibility of the Commission and Council to review the EIR and comment if there are any environmental impacts which have not been addressed. The BZA and Planning Commission's comments have been responded to in the attachments. Any comments made by State agencies will also be given to your Honorable Body. The Council is expected to certify the Final EIR. Please see attachment for a further description of the EIR process. In reviewing the draft EIR, the Council should be aware that the project description addresses the original proposal of the School District. The School District has proposed to the Council the alternative described as the environmentally superior alternative (VI -3). LOCAL COASTAL PLAN AMENDMENT If the School District's project is approved, the City and applicant would then go to the Coastal Commission and request an amendment to the Local Coastal Plan to record the adjustments west of Valley Drive (Coastal Zone), i.e., North School, Hermosa Valley School, and South School. COMMENTS ON PROPOSED DEVELOPMENT AGREEMENT As a result of the Planning Commission's meetings on this matter, staff has heard several issues raised which, in our opinion, deserve further consideration by Your Honorable Body. Specifically: A. General Plan/Zoning Perhaps South School should accommodatea larger recreational facility than currently proposed, particularly if the portion of the property is to be developed residentially. If a playing field were to be incorporated on the site, at least two acres of land should be donated rather than 1.3 (a soccer field requires [1.49 acres] 64,800 square feet). Staff suggests the portion of the property to be donated should be indicated in the development agreement rather than left up to negotiations between the developer and the City at the time of donation. As to density on the South School site, it can reasonably be argued that the density should be reduced to 60-85 units which represents 18-25 du/a on the portion not being donated (3.38) and 11-16 du/a on the overall parcel (5.38). -6- Residential development of this site should be not only compatible with the surrounding area but should have the infrastructure available to support it. The traffic impacts described in the EIR of 99 units will be difficult to mitigate given the existing infrastructure. Zoning on South School should reflect the development standards requested. R-3 zoning is not compatible with mediun; density residential development. The appropriate zone is planned development - R'-2 where the development standards are agreed to in the development agreement: i.e., height of 35 feet and all other development standards equal to R-2. B. The Development Agreement 1. The property to be donated at South School should be specifically designated in the development agreement and be consistent with the Staff recommendation in "A" above. 2. Why shouldn't the mineral rights of the property to be bought by the City be retained by the City. 3. The Zoning of South School should be designated R-2 planned development with 35 foot height limit. 4. Some guarantee in the development agreement should be given that North and Hermosa View Schools will not be developed for a given period of time; i.e., five to ten years. 5. A provision should be made to allow a grace period for the parties to "cure" any conditions not met. For example, if the City's check to the School District for purchase of the property is lost in the mail, the City has a ten day grace period to reissue the check. 6. Unified Building Code standards to be met by any projects on the sites should be those in effect at the time of construction. (Section 7 -page 8) 7. Infant care centers are currently almost non-existent, and infant care costs privately are prohibitive, particularly for single parents. St. Clare's has a particular emphasis on single parents, and provides activities geared to specific single parent family needs. I personally object to the sale of the South School site and the development: of 99 condominiums because I feel St. Clare's Preschool is providing a much-needed community service. We do not need more condominium development in Hermosa Beach. What we do need is a community that is oriented towards the needs of families, and this includes providing proper school facilities which segregate children by age to minimize drug exposure from older children. Background Event Concepts sponsored this Tournament last year, July, 1983. At that time, the City received total revenue of $2,792.50. Expenses for the tournament were $1,340.10. The net gain from that tournament was $1,452.40. . Analysis The tournament of 1983 was very successful. However, one area of possible potential trouble is the blatant violation of drink- ing on the beach. As we are aware, the drinking will never stop even if another sponsor is found. However, staff feels it can be controlled and monitored more closely. Measures have been taken to mitigate this problem as much as possible. Event Concepts will have a security force of no less than eight people at any one time for crowd control and to quietly inform individuals of the open container ordinance. This is done at the Cuervo Tournament in Redondo Beach and has worked out very well. As a follow up to last year's tournament, staff solicited evalu- ations from elected officials, Department Heads, and various merchants in the City. The overwhelming response was approval -2 - of the tournament. The few negative remarks were the concern for the blatant abuse of drinking on the beach. And as indicated above, we believe we have taken steps to mitigate that for next year's tournament. Also, the Department was approached by a new volleyball organization called The Association of Volleyball Professionals, to sponsor this same tournament. Event Concepts has the option to use the CITY'S scoreboard. 10) EC will pay the cost for Police officers to supervise the event both days; the chief of police will mandate the num- ber of officers and hours worked. In the event of an emer- gency or other situation arising which necessitates addi- tional security, Event Concepts is responsible for the additional costs incurred. 11) Event Concepts will supply a security force of their own, minimum of eight at any one time to supervise the crowd and alert all present to the "Open Container" Ordinance of the City. All such personnel shall be wearing identifiable T-shirts. 12) Event Concepts will be permitted to sell custom Hermosa Beach Open volleyball T-shirts at the beach subject to prior approval of the graphics by the CITY of HERMOSA BEACH. 13) Event Concepts will have the first right of refusal to sponsor the event in the years 1985 and 1986, with a new agreement signed no later that December of each year. Each party shall review the success of the event following its conclusion, and either party may terminate continua- tion or renewal of this agreement by submitting written notification of termination to the other party prior to August 31, 1984. 14) Event Concepts will collect entry fees from players which projects to approximately 40 teams at $10 apiece, or a total of $400. Event Concepts shall pay all entry fees to CITY. 15) The CITY will permit the attachment of the sponsor's name to the official event title and shall permit use of spon- sorship signage, product replicas and other props to iden- tify tournament sponsors on the beach. 16) The CITY shall be notified no later than May 15, 1984, of any co-sponsors supporting the Tournament. Background Event Concepts sponsored this Tournament last year, July, 1983. At that time, the City received total revenue of $2,792.50. Expenses for the tournament were $1,340.10. The net gain from that tournament was $1,452.40. Analysis The tournament of 1983 was very successful. However, one area of possible potential trouble is the blatant violation of drink- ing on the beach. As we are aware, the drinking will never stop even if another sponsor is found. However, staff feels it can be controlled and monitored more closely. Measures have been taken to mitigate this problem as much as possible. Event Concepts will have a security force of no less than eight people at any one time for crowd control and to quietly inform individuals of the open container ordinance. This is done at the Cuervo Tournament in Redondo Beach and has worked out very well. As a follow up to last year's tournament, staff solicited evalu- ations from elected officials, Department Heads, and various merchants in the City. The few negative remarks were the concern for the blatant abuse of drinking on the beach. And as indicated above, we believe we have taken steps to mitigate that for next year's tournament. Also, the Department was approached by a new volleyball organization called The Association of Volleyball Professionals, to sponsor this same tournament.
