the City of Hermosa Beach, California, held on Wednesday, May 18,
1983 in the Council Chamber, City Hall at the hour of 7:30 P.M.

10. FOLLOW UP REPORT REGARDING SHORT RANGE TRANSIT PLAN,
MF.1IVRAND[M FROM PLANNING DIRECTOR SAPETTO, DATED MAY 13,
1983. SUPPLEMENTAL INFORMATION LETTER DATED 5-14-83
FROM FRANCES BARNER, 1638 HERMOSA. AVENUE, HER? OSA
BEACH. (Continued from May- 17, 1983 meeting)
PROPOSED ACTION - To schedule a workshop meeting for a date
in June, the date to be decided by staff. All interested
parties, including staff, transit consultants and other persons
to prepare amendments to SRTP and provide direction for a
longer term transit plan.

This motion was withdrawn by maker with the concurrence of

ACTION -
1) To hold a workshop in June at which substantive program
changes will be developed.
2) To direct staff to start negotiations with the Coastal
Commission to allow parking fees for Beach Shuttle, and
to investigate increasing parking fees in the impact
zone so as to create a significant financial incentive
to use the Beach Shuttle parking lots.
3) Further,to direct staff to inform the Coastal Commission
that it will operate the Beach Shuttle as a show of
good faith through September 1, 1983, at which time it
will cease operations unless negotiations have been
satisfactorily concluded.
4) To direct staff to investigate the feasibility of
contracting out or franchising the Beach Shuttle/
parking operation once the right to charge for parking
has been established with the Coastal Commission so
as to remove all financial burden from the City with
strong emphasis on communicating this idea to the
VDP forinvolvement and input.
5) Except as stated below, to terminate. Free;. Bus operations
effective July 1, 1983.

In recognition of the fact that some senior citizens
in Hermosa Beach depend on the Free'Bus for trans-
portation, and so as not to unnecessarily disrupt
their lives, to continue to operate limited service
(two loops in the A.M. and two loops in the P.M.)
until a paratransit system for senior citizens
is established, or until. December 16, 1983, whichever
comes first.
In order to maintain eligibility for possible
alternative funding and so as not tojeopardize.
funding for current year obligations, approve a short
range transit plan reflecting all of the above for
submittal forthwith to. the Los Angeles County Trans-
portation Commission. Pursuant to Part 1 of this.
motion, the submittal letter should explicitly state
the City's intent to substantively amend.the plan in
the near future.
The Short Range Transit Planwill also• indicate that
the following programs will be considered for possible
implementation in FY83-84:
a) An express service to the El Segundo employment
centers to be operated in conjunction with other
beach cities.
b) A dial -a -ride for elderly and handicapped
citizens.
a) A potential limited service which would operate 3 •to 4
hours per day( before -and after school during the
non -summer months). Feasibility of charging a
fare for such service will also be investigated.

11. ON -STREET PARKING IN THE VICINITY OF THE HERMOSA BEACH

T. MEYER, DATED MAY 13, 1983.
ACTION - Direct staff to prepare an ordinance to
cover the proposal to provide four. -hour on -street parking
meters in the vicinity of the Hermosa Beach Community
Center; to bring that to the Council at the June 14, 1983
Council meeting; to notify the Community Resources
Commission of this proposal; and to solicit their considera-
tion and input on this proposal with that input available
by June 14, 1983. Staff is asked to come back with
alternate hours and times.

12. SOUTH BAY CABLE NEWS REQUEST FOR SUPPORT. LETTER DATED
MAY 10, 1983. SUPPLEMENTAL INFORMATION FROM GENE MARLO,
SOUTH BAY CABLE NEWS.
City Manager Meyer noted it was his understanding that it
is Storer Cable Television's policy to make available
"for free", access to the channel as long as the dissemina-
tor is not for profit.
Gene Marlo, #7 - 18th Street, Hermosa Beach, representing
Crackerjack Productions, South Bay Cable News. Mr. Mario
presented South Bay Cable News' request for City Council
support either through direct financial support or financial
support through its franchisee, Storer Cable. South Bay
Cable intends to operate as a non-profit corporation hoping
to further benefit the city at large, but do desire to use
commercial sponsors.
Councilmembers queried Mr. Marlo extensively on all aspects
of the operation of South Bay Cable News. Mr. Mario
requests support from the City Council and Storer Cable
Television for local -origination programming.
PROPOSED ACTION - Direct staff (Director of General Svcs.)
to meet with Storer Cable Television and South Bay Cable
News and come back with a recommendation of whatever the
outcome of those meetings by June 14, 1983.

ACTION - To concur for a substitute motion .that the City
Council authorize its Business Relations Subcommittee to
approach South Bay Cable News and other interested tele-
vision production organizations and to formulate a series
of requests of Storer Cable Television and then to meet
with, Storer Cable to negotiate those requests including
the staff liaison, and to report back to the City Council
the second Council meeting in July.

13. BILTNORE INITIATIVE ORDINANCE, MEt RAND1M FROM CITY ATTORNEY
POST, DATED MAY 13, 1983.
City Attorney Post presented staff proposal with the
recommendation that the Council consider the ordinance attached
to Atty. Post's memorandum.
ACTION - To place the Schumacher Biltmore Initiative Ordin-
ance on the ballot of the election of November 8, 1983.

16. MISCELLANEOUS ITEMS AND REPORTS - CITY COUNCIL
a) Report from Parking Development Subcommittee, May 10th
meeting with Vehicle Parking District - Brutsch.
The sub -committee agreed that the VPD Committee should go
back to the VPD and ask if they will support 100% of the
financing for the purchase of the property behind the
Community Center, commonly known as the Ilth Avenue
lot. Also discussed was the feasibility of a secondary
parking structure downtown and an agreement was reached
that if a major hotel were built downtown that the City
would work with.VPD to establish some appropriate
parking. They are awaiting the outcome of VPD meeting
held May .24,1983..
It was also agreed that the administration of the
parking lot would be by VPD.
Report from City/School Subcommittee regarding May 16th
meeting - Mayor Schmeltzer
A number of topics were discussed: Sobs Bill monies;
School properties and their potential rezoning and
sale; concept of Crossing Guard District. Committee
will meet on May 28 to put together a document for
presentation to Council to be followed by a public
forum.
PROPOSED ACTION- To direct staff to issue fee exempt preferen-
tial
referential parking pemits, for this program year only, to
North School staff subject to verification from the
:.school staff as to their employment at North School.
At the end of June 29, 1983, parking permits are to be
submitted back to the City.

c) Railroad Right -of -Way Subcommittee Reports
- Post
City Attorney Post reported that the letter that was
sent to the Secretary of Commerce received a reply
which states that the National Ocean Service which is
part of the Department of Commerce says that the
abandonment is an activity of the Federal Government
which requires a consistency determination or a finding
that the abandonment is consistent with the California
Coastal Management Plan. The Coastal Commission has
stated that the abandonment is not consistent and so
the Department of Commerce says what the Interstate

Commerce Commission did in granting the abandonment is
wrong.
Also the letter from the California Coastal Commission
to the Department of Commerce requests mediation
by the Secretary of Commerce. The informal informa-
tion Atty. Post has from the Coastal Commission
indicates that the more public information there is
that there is a lot of activity locally on this right-
of-way, the greater likelihood that the Interstate
Commerce Commission will agree to this mediation.
City Attorney Post has met with the City Attorney of
Redondo Beach and they are in the process of putting
together the petition to the Court of Appeal on the
abandonment proceeding and they are confident that
it will be put together in a timely manner and feel
they will be able to make a persuasive case.

Delma Perry, 720 8th Street, Hermosa Beach, acknowledged her
birthday greeting and addressed both Mr. Marlo's presenta-.
-- fiion on behalf of South Bay Cable News and making public
the'Patterson and County Civil Service letters.
18. OTHER MATTERS - CITY COUNCIL
a) MINUTES OF CLOSED SESSIONS._
PROPOSED ACTION - The City Manager record the motions, the
failed motions and the voting on all motions at closed
sessions and keep a log on those motions.

ACTION - Staff to return with a resolution which would
comply with the Brown Act authorization for the keeping of
minutes of closed sessions for the June 14, 1983 agenda.

FREE BUS ROUTE
Letter from Frances Barney regarding the accusations
that the Free Bus is not following the established route.
Councilmember Wood asked that Ms. Noon look into the matter.
SENATE BILL 910 - AIDS RESEARCH
Letter from State Senator David Roberti asking for a letter
of support from the City Council on his Senate Bill 910 -
AIDS Research.

ACTION - That Mayor Schmeltzer be authorized to submit a
letter to the State Senate supporting the passage of Senate
Bill 910.

Behavioral Health Services, Inc. Conditional Use Permit
Item 3 Council Meeting 5-17-83.
City Manager Meyer requested clarification of the following
conditions on Resolution 83-4600 adopted 5-17-83.
5. The windows at the West end of the building shall be
eliminated.
10. Behavioral Health Services to negotiate with. the
Building Director to determine adequate foliage and other
screening techniques at the rear of the property with an
effort to mitigate the impact of the facility on the adjacent
residents with the proviso that if they are unable to reach an
agreement, City Council will review the conditions.
PROPOSED ACTION - Item 10 of the Behavioral Health Services, Ind.
list of conditions be removed and that the Resolution be
renumbered Conditions 1 through 12.

adjourned on May 18, 1983 at the hour of 9:45 P.M. to a workshop
on ballot measures and budget considerations to be held on
June 6, 1983 from 6:00 P.M. to 9:30 P.M.
Note: There will be a workshop session on June 8, 1983 at
7:30 P.M. regarding detailed budget proposals.
The next regular meeting of the City Council of Hermosa Beach
will be held on June 14, 1982 at the hour of 7:30 P.M., Council
Chambers, City Hall, preceded by a closed session. at 6:30 P.M.
