Work requested may be performed at any location chosen by Stevens including but not limited to the Public Works Department offices of the Hermosa Beach City Hall, 5. Any work performed by Stevens for City shall be secondary in precedence to work required of him by the City of Santa Ana, and as such, shall normealy be performed during evening hours or on Saturdays and Sundays. 6. When specifically requested by the City Manager, Stevens will personally ppear before the City counci or any other body or group to be designated, for the purpose of making ora/ presentations, discourses, testimony or advice. 7. Compensation for rot:Noted work shall be made to Stevens by the City at therate of Fifteen Dollars 101.5.00) per hour with proportionate payments for fractionml Lacremfautei 44 not less than one-quarter hour. Mnimum fee for any singl- service shall be Fifteen Dollars ($15.00). If the personal presence of Stevens is required in the City of Hermosa Beach or at any other location as may be designated by the City Mmnager, travel fee in the amount of Four Dollars ($4.00) will be paid for each requested attendance. Should Stevens, at his own convenience, elect to perform rwearch, study or review work in Hermosa Beach or at any other location, no travel fee shall be payable. 8. This agreement may be terminated at any time by either party hereto upon the giving of five days notice t* the other party. 9. McDaniel, City Manager SUBJECT: Refuse Contract Gentlemen: Acting upon authorization at the last meeting, we have negotiated and prepared the five year (actually 4 years, 13. months) contract with ABCO. It should be noted that no problems were encountered, the discussions— though lengthy --were harmonious, and each party gained respect for the other's The contract bears ABCO's signatures and needs only our own City Council approval to be put into effect on August 1. Some specific notes are these: 1. The price method was resolved by using method "C", requiring an annual request by the Company, but putting in a limit of method "B", the annual escalation. Thus, we get the best of both methods 2. A later Switch to bags was protected by writing in an automatic rate decrease at the time of switching, depending on the year. 3. Two omissions in the original specifications .were filled in: a rate for increased frequency of apartment house containers $1.00 monthly per unit per added weekly collection) and a commercial barrel rate ($2.00 monthly per weekly collection, with multiples thereafter). These rates refair and competitive. (Exhibit "D' 4. A revised grievance system was employed, along with a section allow- ing tho pity to license added commercial haulers—at which time the resi- dential rate would increase. 5. Although the commercial hours of operation (5:00 a. m. 7:00 p. m.) were not changed, a revised clause grants the City Manager authority to require more limited times if necessary. (Rules & Rags. MB). Contractor is the person, firm or corporation having a contract with the City of Hermosa Beach for the work mentioned these specifications. Refuse shall man all waste from and incidental to the use of homes, residences, dwelling units, comnercial, or professional establishments, including but not limited to newspapers, magazines, wrappings, discarded clothing, empty packing cases, packing mater- ials, such as paper, hay, straw, shavings, excelsior, metals, bottles, ashes, broken glass, carbage, garden and yard trimmings, leaves and other household refuse. Not included in the definition of refuse are any dead animal, dirt or earth. Construction or industrial waste materials such as plaster, lumber, bricks,til, or fixtures, resulting from build- ing construction, alterations, or manufacturing processes shall not be considered refuse when in cgoess of seventy-five pounds in total weight and rjnined in an approved refuse container. especial Refuse shall mean furniture, appliances, television sets, water heater tanks, refrigerators, stoves, davenports, sinks, lawn furniture, doors, vii ows, screens, mattresses, beds, rugs and pads, which are incidental to fmmity living and which exceed seventy-five pounds in weight and/or forty-eight inches in length. Miscellaneous Refuse shall mean newspapers, magazines and flattened cartons tied securely in bundles by moans of heavy twine, rope, or wire, not: excezding seventy-five pounds in weight per bundle nor forty-eight inches in length; branches, cuttings, and brush similarly bundloBd and limi td to forty-eight inches in length and seventy-five pounds in weight; and domestic items not suitable for containers but weighing less than seventy-five pounds and less than forty-eight inches in length, to include bundled rugs and carpets, bicycles and toys. II. FRES,M.ENCYOF COLLEcTIOK All refuse shall be collected at frequencies not less than those specified in these rule and mgulations. The frequency of collection currently est0Aished is as follows A. However, the Contractor • shall be recTonsible for collecting and disposing of all Christmas trees, regardless of size, within the City under payment provision of the normal residential and apartment house collection, service. Collection Vehicles - All refuse collection vehicles shall b of a load packing variety capable of accommodating refuse up to forty-eight inch in length, with watertight bodies so that no material shall leak or be spilled from the vehicle on the streets or alloys of Hermosa Beach. Each and every vehicle operated by Contractor in the City of Hermosa Beach hall be equipped with a functioning and properly maintained smog control device of type certified by the State. of California in the Health and Sty Code. Refuse vehicles shall not be stored within the boundaries of the City for more than two houre without the specific permission of the City Manager having been previouoly dbtained, unless pre- vented from moving by mechanical difficulties. Under no circum- stances are collection vehicIec to be 'regularly stored within the City limits. The Contractor shall be responmible for, cleaning from the streets and collection places ra/ refuoe spilled resulting from the Contractor's operation. Each truck shall be equipped with an adequate shovel and broom for this purpose. In addition, the Contractor shall be responsible fox rmoving an cleaning all oil, grease, paint, glase or other sdbotance on the public streets due to equipment failure or refuge leakage resulting from refuse operations. If said spillage o: leakage is not cleaned promptly and thoroughly by the Contractor, the City may clean up same and deduct the cost thereof from the amount due caid Contractor. F. Personnel - Refrain from Use_ofyrofanitv. Contractor's employees, in the performance of the duties herein called for, shall refrain from the use of profanity, loud talk or boisterous conduct which may annoy householders, and ell work done pursuant to these specifications shall be carried on with the least Possible disturbance or annoyanbe to residents of the City. VII. -PLACING OF REFUSE The Contractor, under the provisions of these specifica- tions herein contained, shall perform hie services in accordance with the provisions of the applicable ordirgarge of. the;. city City of Hermosa Beach pertaining to the collection and disposal of all refuse. Contractor shall carefully replace container to its proper place after emptying. The collector, hie agents and employees shall not throw refuse containers from the truck to the pavement, or in any other way break or damage or roughly handle vatm. Contractor shall be charged for any unreasonabie danage to containers, upon the deter- mination of the City. Manager or his designated representative. VIII. FAILURE OF CONTRACTOR TO COLLFCT REFUSE • Should the Contractor to whom the tract is lot for the collection of refuse fail to collect and remove any refuse which shall be properly set out and in proper containers at the tine required of him, the City of Hermosa EGach may collect and dispose of the same, or cause it to be colle.sted and disposed of, and may deduct the expense of co doing Prom the next monthly payment due to said Contractor, provided, hovever, that the City shall first make reasonable efforts to notify Contran,tor by telephone or other informal means. McDaniel, stated to the City Council that effective Monday, June 0, 197:), Coast Disposal Company, licensed refuse collector for the City of Hermosa Beach, had refused to pick up any rubbish not placed in regulation containers or any refuse which was over the legal weight limit, as provided for in the Agreement between the City and Coast Disposal Company. The City Manager explained that Coast Disposal was within its rights to exercise this part of the contract. The City Manager then outlined for the information of those present the contents of a temporary interim ordinance amending Chapter 14 of the City Code of the City of Hermosa Beach. Absent: None Mayor Thelen called the regular adjourned meetin- to order in the Council Chamber, and then adjourned the meeting to Ander on Memorial Hall where the City Councilmen continued their review of the 1970-71 Preliminary Budget. 1970-71 PRELIMINARY BUDGET DISCUSSION - After reviewing the budget of the Department of Finance, Mayor Thelen called upon Mr. Frank Hickerson, Treasurer of the Hermosa Beach Chamber of Commerce, who presented two proposed budgets for the Council's consideration. Mr. George Hall, Manager of the Chamber of Commerce, and Mrs. Rosemary Foreman, 68 - 14th Street, also spoke in behalf of the Chamber of Commerce proposed budget. The City Council directed the City Manager, Wesley C. McDaniel, to review the Chamber proposal and report back to the Council at the next budget meeting. The Council then reviewed the budget of the City Planner and the Department of Public Works. Mr. John E. Stevens, resigning Director of Public Works, was asked by Mayor Thelen to comment on his proposedbudget for the coming year as he would not be available in this city after Friday, June 12, 1970 for consultation. Others present in the audience who spoke during the meeting were Mr. John B. Schmolle, 931 Montgomery Drive, and Mrs. Betty Ryan, 532 Pine Street.
