McDaniel, City Man.a SUBJECT: Enterta inment Ordinance Gentlemen: When the emergency ordinance was adopted in late fall adding live entertainment'to the 'Conditional Use Permit list, it was enacted without any public hearing and thus was effective.for only ninety • days. This wilt soon expire. While the Planning Commission is considering the same provisions, in more studied form, completion of that action in the normal manner will obviously take sone more time. To protect ourselves in the interim, adoption of a second similar ereaergency ordinance, with a public hearing, for another six month period, is recommended. Edgerton, City.Clerk SUBJECT: RELOCATION OF VETTER WINDMILL - Financial Report to Date There is little left to reporton the relocation of the Vetter Windmill that is not known to all of the members of the City Council, with the exception of the current financial status of receipts and expenditures. .Due to the many', many friends of the Windmill who contributed time and money toward the accomplishment of saving our oldest historical land a' we are happy to report that the status of the Windmill Account Reimbursible now stands as follows: Funds col ted as of January .16, .1970 $549.45 Funds expended as of .anuary 20, 1970 546.34_ Balance The Department of Public Works provided the labor for a total of seven man-hour days at an approximate cost to the City of $250.00; however, the major portion of the work and planning was accomplished by the United States Naval Reserve Seabee Unit I 1122 'ander the direction of Lt. Commander Curtis Pettigrew. The Seabees undertook the project due to the efforts of r. Mike Foote, local architectend intemsted citizen, who did an outstanding job of coordination between the City, the Seabees and the Improvement Commission as well as contributing generously of his own money to purchase materials to be used to repair the windmilL To try to list the Friende.of the Windmill in order of their importance would be an impossible task; however, the preserVation and relocation Of this old structure could never have been accomplished without the enthusiastic support of the following: Kenneth Komick, the developer of the property, who gave the windmill to the City as a gift. Robert Allen, Los Angeles'.Times news reporter who wrote the first news story. Rosemary Foreman, South Bay Publishing, the all-time winner as the reporter who published more pictures than any other. 13111 Rempelo South Bay Daily Breeze, who wrote many, many column inches in support of the project. Prints are still on sale at the Either/Or Book Store) r and all of the wonderful people who purchased prints. Mx. and 'Mrs. Peter Hendrix, owners of the Either/Or Book: Store. The large number of interested grade School childrerA, and local atists, who have drawn and painted so many portraits of the windmill for public disPlay. Mrs. john Hales; who researched and wrote the history of the Windmill. M. jack. Dunn, Printer, who contributed announcements of the raiiVing date for distribution throughout the City. John Stevens, Director of Public Woeks, who spent ffiany hours of his own time to assist the Seabees. Robert Crawford, City Planner, who bought the windmill to the attention of the Improvement COMMIS sion. And, last but not least, the Hermosa Beach Improvement Commissioners, who sponsored the project, and, in particular, the Windmill:Committee, Improvement Commissioners Joanne Purpus.and Carol Tanner, who provided the inspiration and determination to see the project through to a successful conclusion. One further bit of information: Seabee. Unit 41122. plans to return to the scene in the near future and paint the base of the structure. Following this, the Improvement Commission plans to hold a Dedication Ceremony and to invite the granddaughters of Herman Vetter, who have been in contact with City Hall and have written of their • fond memories of early childhood days spent on the land where the windmill formerly rested for 67 years. Gentlemen: The general statewide subject of, beach planning, development, and con- servation is heating up rapidly. A number of bills will be considered this session concerning the issue, some of rather sweeping import. I attended a meeting in Newport Beach last Friday of beach cities, and jack Wise and I are attending a special Lieutenant Governor's one day meeting on the subject tomorrow (Thursday) tn Sacramento. In addition, we were directed last Council meeting to report on formation of a beach plan study committee scheme, to provide input into a Master Plan for Beach Area Development. "SECTION 14A-2, Nuisance. Section 317 of said Los Angeles County Health Code is hereby amended to read as follows: "Whenever a nuisance or condition endangering the public health shall be ascertained to exist on any premises, or in any house, or any other place, the Health Office shall notify in writing the person having control of, or acting as agent for • • "such premises, house or other place, to abate or remove such nuisance or condition within a reasonable time, to be stated on such. notice. Upon the neglect or refusal of such person to comply with such notice, the Health Officer may abate such nuisance or condition; and the person having control of such house, premise, or place, in addition to the penalties provided by this ordinance, shall be Liable to the City of Hermosa Beach for the cost of such abatement, to be recovered in a civil action in any court of competent jurisdiction. If no person can be found upon whom to serve such notice, the Health Officer may proceed to abate such nuisance or condition at the expense of the City at a cost not to exceed Fifty ($50.00) Dollars per day. "SECTION 14A-3. peneral Reap/Jr:et-gents: Section 802 of said Los Angeles County HealthCode is hereby amended to read as follows: "(A) - 'Family' means an individual, or two or more persons related by blood or marriage, or a group of not more than four persons, excluding servants, who are not related by blood or marriage, living together as a single housekeeping unit in a dwelling unit. "Section 810 of said Los Angeles County Health Code is hereby amended to read as follows: "03) AmrtLentHouse - 'Apartment House' is any building or portion thereof which is designed, built, rented, leased, let, or hired out to be occupied, or which is occupied, as the home or residence of three or more families living independently of each other and doing their own cooking in the said building, and shall include flats and apartments." SECTION 2. The City Clerk of the City of Hermosa Beach shall certify to the adoption of this ordinance, and shall cause said ordinance to be published once in the Hermosa Beach Review, a weekly newspaper of general circulation, published and circulated in the City of Hermosa Beach, within fifteen (15) days after its adoption.
